1. The supreme court, under art. VIII, sec.

1 of the Philippine constitution and the


sandigangbayan under PD 1606 as amended are the constitutional courts in our country.
It is called constitutional courts because the congress cannot abolished nor legislate it
out for only the constitution can do so. While the statutory courts existing in our
country today are the RTC, CA, court of tax appeals, and mtc/mctc and city courts, for
they can be legislated out by the congress. ( modify your aanswer lok p. 61 riano.)

2. The law approved by the congress abolishing the sandiganbayan is void and ineffective
for it violates the highest law of the land, the constitution. I, being the president of the
philipines cannot approve the law passed by congress for it violated the supreme law.
Otherwise, the congress can assemble constitutional convention/ constitutional
assembly to amend or repeal the existing constitution.

3. under BP 129 the MTC can exercise jurisdiction originally belonging or pertaining to the
RTC in cases of forcible entry and unlawful detainer of land and buildings. It is also
enshrined in rule 70, sec.1 of the rules of court that forcible entry and unlawful detainer
shall commenced in MTC.
