When I learned that Bob Neace had requested an investigation on March 23, 2017, I immediately

made it clear to the Attorney Generals office that I will continue to fully cooperate in any review of
my conduct undertaken by their office or the Special Prosecutor. It is important to note that I
personally requested that a special prosecutor be appointed on October 3, 2016 when the original
allegations first surfaced. In the five months that followed, I provided full access to my office files and
my staff, met repeatedly with investigators and prosecutors from the AGs office, and even met with
defense counsel at my own suggestion.

Despite the fact that he did not sit through any of the testimony or review the evidence from the five
day hearing held March 13-20, 2017, Bob Neace sent an email to the Attorney General's office three
days after it concluded demanding an investigation. I testified under oath for hours over the course
of two days, and was subjected to cross examination by defense counsel who had full access to the
Dooley investigative file and the contents of the entire flash drive of materials stolen from my office
in March of 2016. Judge Schrand's fourteen page order issued May 12, 2017 specifically found that
no evidence was intentionally withheld in the prosecution of David Dooley by either me or
the investigating officers. Despite the judges findings, Mr. Neace has continued to insist that the
Attorney Generals Office investigate my conduct in connection with the Dooley case.

By letter dated June 2, 2017, the AGs Office requested that Hardin County Commonwealths
Attorney Shane Young serve as Special Prosecutor in a process routinely followed in Kentuckys
criminal justice system. I am hopeful that his review will put a stop to the endless barrage of baseless
accusations being leveled by a handful of those with political axes to grind and/or a personal stake
in the future of the Office of the Commonwealths Attorney for the 54 th Judicial Circuit. As I have
said publicly for months now, I have not withheld evidence in any criminal matter, and the
judges order confirmed that. I have committed no crimes whatsoever as Commonwealths
Attorney since 2000, so I have absolutely no reservations in my continued cooperation with
any investigations of my conduct.

Make no mistake about it, Mr. Neaces actions are motivated by politics and his own self interests.
Through filed pleadings and sworn testimony in the civil case and the Unemployment Commissions
denial of his claim for benefits, the law clerk that stole a flash drive of materials more than six months
before he was fired confirmed that he went to Mr. Neace for legal advice on how to proceed. The
clerk indicated that Mr. Neace advised him to do nothing, and took no action whatsoever in response
to learning of these matters months before the Attorney Generals Office was ever notified. However,
since the time the AGs office became involved, Mr. Neace has placed himself in situations where
his personal and professional conflicts should have been disclosed, yet failed to do so. He has
repeatedly made public and private statements to influence the actions of other elected officials and
the Boone County Republican Party, all in contravention of his own Rules of Professional Conduct.
By persistently demanding additional investigation, one can only presume that Mr. Neace does not
trust the investigation by the Attorney Generals Office or the conclusions reached by our circuit
judge after he had considered all of the testimony and evidence.

I will reiterate that I deeply regret my personal failings from two years ago, mostly because of the
pain that I have caused my own family and other persons. It is particularly regretful that the continued
waves of attack cause immensely private issues to be rehashed in the media, which prevents our
families from attempting to heal. However, the personal mistakes made during an extremely difficult
time in my life have not impacted the work that I have done as Commonwealths Attorney or the
rights of any persons prosecuted by my office.
