AFFIDAVIT OF COMPLAINT

I, JOSEPHINE YENKO HO, Filipino, married and a resident of Bulahan Drive,

San Jose, Zamboanga City, Philippines, under oath, declare:

That on or about 1:00 AM of May 2, 2015, I was willfully and unlawfully

confronted by PO2 Augusto Malonzo, asking for my whereabouts while blocking my
path towards the gate of my house, and answered him back that its none of his business
and reminded him that there we are not in a relationship and not obligated to inform
him of my whereabouts;

That on the same time and date, PO2 Malonzo then grabbed and embraced me,
and attempted to bring me into his rented room near my house. I resisted and
immediately ran out of the house to seek immediate assistance from the nearby
Barangay Hall for fear of my life;

That PO2 Malonzo tried to chase me and in haste, I tumbled and he was able to
pull back my hair. I tried to stand up and managed to run away but PO2 Malonzo took
my bag as I continued to run towards the barangay hall where the police officers
immediately gave me their assistance to locate the whereabouts of PO2 Malonzo, who
happened to rode on board a tricycle according to the bystanders. The police officers
then asked the bystanders where the tricycle was headed to and told us where it went.
We followed the tricycle and were able to track him at Barangay Tugbungan, this city,
where I was able to recognize PO2 Malonzo inside the tricycle;

That PO2 Malonzo was apprehended by the police officers and where he was
caught in the possession of my bag, and was asked to return the bag to me;

That when I checked the items inside my bag, I found out that some cash, which
includes 100 US Dollar, and my daughters picture were already missing.

That the apprehending police officer asked PO2 Malonzo to return all the
missing items but he only returned the cash coming from his purse/ bag and did not
include my daughters picture;

That the apprehending police officer brought us to the Central Police Station to
file a formal complaint together with the blotter and incident report;

That when questioned as to my relationship to PO2 Malonzo, PO2 Malonzo

adamantly insisted that we are having a relationship, to which I denied by attesting to
its falsity and told the police officer that we were acquainted during our high school
days;

That just recently, I happened to met him downtown, had exchanged talks with
him, and freely gave him my cell phone number, without hesitation, knowing that he
was an old friend;

That PO2 Malonzo eventually started to visit me in my house in a frequent

manner and later on showed his interest by offering a marriage which I refused because
he is a married man and if he were to express his clean intention to have a relationship
then he should first clear his marital commitments.
 That despite the clear conversations with PO2 Malonzo on his intentions, it all
came out to nothing and I had no other recourse but to tell him that we should remain as
friends.

That PO2 Malonzo started to harass me by announcing to everyone he knew that

we are having a relationship;

That later on, PO2 Malonzo was able to rent a bed space in a boarding house
adjacent to my house to closely monitor and inquire of my whereabouts. He would even
berate me as though he is my husband and would wait long hours whenever I will go
out on parties and events;

That this complaint is the second time of similar event, which I decided not to file
for a formal complaint for fear of my life and my daughter as well;

That I am feeling helpless as PO2 Malonzo has equal access to go in and out of
my house as it has a common gate with the adjacent boarding house where he is renting;

That during the course of the investigation at the Central Police Station, PO2
Malonzo kept on threatening me should I opt to file a case in court. That until now, he
still unlawfully enforce his caprices and continuously invades my privacy and comfort
abode with my family through fraud, manipulations, lies and harassment.

That I am executing this affidavit of complaint on my own free will and volition.
