2017-43

1 AN ORDINANCE OF THE CITY OF ORLANDO, FLORIDA,


2 RELATING TO DISORDERLY CONDUCT; AMENDING
3 CHAPTER 43, SECTION 43.06 OF THE CODE OF THE
4 CITY OF ORLANDO, FLORIDA, MAKING IT UNLAWFUL
5 TO DISTRIBUTE TO OR RECEIVE MATERIALS FROM
6 THE OCCUPANT OF A VEHICLE STOPPED AT A
7 TRAFFIC DEVICE; PROVIDING FOR SEVERABILITY;
8 PROVIDING FOR CODIFICATION, CORRECTION OF
9 SCRIVENERS ERRORS, AND AN EFFECTIVE DATE.

11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ORLANDO,
12 FLORIDA:

14 WHEREAS, entering any roadway to approach motor vehicles creates a dangerous
15 situation, already causing two individuals to tragically lose their lives; and
16
17 WHEREAS, the City of Orlando is constantly striving to improve public safety within
18 our roadways.

20 SECTION ONE: AMENDING SECTION 43.06. Section 43.06 of the City Code of the
21 City of Orlando is hereby amended as follows:

23 Section 43.06. Disorderly Conduct.

25 Commission of the following acts shall constitute disorderly conduct:
26 (a) Any person who shall act in a violent or tumultuous manner toward another so as
27 to place him or any other person in reasonable fear of safety of his life, limb, or
28 health;
29 (b) Any person who shall act in a violent or tumultuous manner toward another with
30 the result that his property, or that of any other person is placed in danger of being
31 destroyed or damaged;
32 (c) Any person who shall cause, provoke or engage in any fight, brawl or riotous
33 conduct;
34 (d) Any person who shall assemble or congregate with another or others with the
35 intent to engage in conduct which is prohibited by the ordinances of the City or by
36 State or Federal law;
37 (e) Any person who shall frequent any public place with intent to obtain money from
38 other persons by illegal or fraudulent schemes, tricks, artifices or devices;
39 (f) Any person who shall accost or attempt to force his company upon any other
40 person;
41 (g) Any person who shall use "fighting words" directed towards any person who
42 becomes thereby outraged;
43 (h) Any person who shall by acts or threats of violence interfere with another's
44 pursuit of a lawful occupation;

45 (i) Any person who shall, after being ordered by a law enforcement officer to
46 disperse, congregate with another or others in or on any public way so as to halt
47 or materially impair the flow of vehicular or pedestrian traffic;
48 (j) Any person who, after being ordered to move by law enforcement officers,
49 remains in or on any public street or sidewalk in such a manner as to block or
50 impair movement of vehicles or pedestrians.;
51 (k) Any person who distributes any object to, or receives any object from an occupant
52 of any motor vehicle that is stopped on a public roadway in obedience to a traffic
53 control signal light, stop sign, or any other traffic control device.

55 Any person deemed guilty of disorderly conduct as above defined, and, being convicted thereof,
56 shall be fined or imprisoned as provided in Section 1.08 of this Code.

58 SECTION TWO: SEVERABILITY. If any provision of this ordinance or its
59 application to any person or circumstance is held invalid, the invalidity does not affect other
60 provisions or applications of this ordinance which can be given effect without the invalid
61 provision or application, and to this end the provisions of this ordinance are severable.

63 SECTION THREE: CODIFICATION. The City Clerk and the City Attorney shall
64 cause the Code of the City of Orlando, Florida, to be amended as provided by this ordinance and
65 may renumber, re-letter, and rearrange the codified parts of this ordinance if necessary to
66 facilitate the finding of the law.

68 SECTION FOUR: SCRIVENERS ERROR. The City Attorney may correct
69 scriveners errors found in this ordinance by filing a corrected copy of this ordinance with the
70 City Clerk.

72 SECTION FIVE. EFFECTIVE DATE. This ordinance takes effect immediately upon
73 final passage.
