WARSAWCONVENTIONANDMONTREALCONVENTION
PASSENGERSONAJOURNEYINVOLVINGANULTIMATEDESTINATIONORASTOPINA
COUNTRYOTHERTHANTHECOUNTRYOFDEPARTUREAREADVISEDTHATINTERNATIONAL
TREATIESKNOWNASTHEMONTREALCONVENTION,ORITSPREDECESSOR,THEWARSAW
CONVENTION,INCLUDINGITSAMENDMENTS(THEWARSAWCONVENTIONSYSTEM),MAY
APPLYTOTHEENTIREJOURNEY,INCLUDINGANYPORTIONTHEREOFWITHINACOUNTRY.
FORSUCHPASSENGERS,THEAPPLICABLETREATY,INCLUDINGSPECIALCONTRACTSOF
CARRIAGEEMBODIEDINANYAPPLICABLETARIFFS,GOVERNSANDMAYLIMITTHELIABILITY
OFTHECARRIER.

NOTICEOFLIABILITYLIMITATIONS
TheMontrealConventionortheWarsawConventionsystemmaybeapplicabletoyourjourney
andtheseConventionsgovernandmaylimittheliabilityofaircarriersfordeathorbodily
injury,forlossofordamagetobaggage,andfordelay.

WheretheMontrealConventionapplies,thelimitsofliabilityareasfollows:

1. Therearenofinanciallimitsinrespectofdeathorbodilyinjury.
2. Inrespectofdestruction,lossof,ordamageordelaytobaggage,1,100SpecialDrawingRights
(approximatelyEUR1,300US$1,700)perpassengerinmostcases.
3. Fordamageoccasionedbydelaytoyourjourney,4,694SpecialDrawingRights(approximately
EUR5,400US$7,100)perpassengerinmostcases.
ECRegulationNo.889/2002requiresEuropeanCommunitycarrierstoapplytheprovisionsofthe
MontrealConventionlimitstoallcarriagebythemofpassengersandtheirbaggagebyair.Manynon
EuropeanCommunitycarriershaveelectedtodosoinrespectofthecarriageofpassengersandtheir
baggage.

WheretheWarsawConventionsystemapplies,thefollowinglimitsofliabilitymayapply:

1. 16,600SpecialDrawingRights(approximatelyEUR20,000US$20,000)inrespectofdeathor
bodilyinjuryiftheHagueProtocoltotheConventionapplies,or8,300SpecialDrawingRights
(approximatelyEUR10,000US$10,000)ifonlytheWarsawConventionapplies.Manycarriers
havevoluntarilywaivedtheselimitsintheirentirety,andUSregulationsrequirethat,forjourneysto,
fromorwithanagreedstoppingplaceintheUS,thelimitmaynotbelessthanUS$75,000.
2. 17SpecialDrawingRights(approximatelyEUR20US$20)perkgforlossofordamageordelayto
checkedbaggage,and332SpecialDrawingRights(approximatelyEUR400US$400)for
uncheckedbaggage.
3. Thecarriermayalsobeliablefordamageoccasionedbydelay.

Furtherinformationmaybeobtainedfromthecarrierastothelimitsapplicabletoyourjourney.
Ifyourjourneyinvolvescarriagebydifferentcarriers,youshouldcontacteachcarrierfor
informationontheapplicablelimitsofliability.

RegardlessofwhichConventionappliestoyourjourney,youmaybenefitfromahigherlimitof
liabilityforlossof,damageordelaytobaggagebymakingatcheckinaspecialdeclarationof
thevalueofyourbaggageandpayinganysupplementaryfeethatmayapply.Alternatively,if
thevalueofyourbaggageexceedstheapplicablelimitofliability,youshouldfullyinsureit
beforeyoutravel.

Timelimitforaction:Anyactionincourttoclaimdamagesmustbebroughtwithintwoyearsfromthe
dateofarrivaloftheaircraft,orfromthedateonwhichtheaircraftoughttohavearrived.Baggage
claims:Writtennoticetothecarriermustbemadewithin7daysofthereceiptofcheckedbaggagein
thecaseofdamage,and,inthecaseofdelay,within21daysfromthedateonwhichitwasplacedat
thedisposalofthepassenger.

1. Yourcontractofcarriagewiththecarrierthatprovidesyouwithcarriagebyair,whether
international,domesticoradomesticportionofaninternationaljourneyissubjecttothisnoticeto
anynoticeorreceiptofthecarrierandtothecarrier'sindividualtermsandconditions(Conditions),
relatedrules,regulationsandpolicies(Regulations)andanyapplicabletariffs.
2. Ifyourcarriageisbymorethanonecarrier,differentConditions,Regulationsandanyapplicable
tariffsmayapplyforeachcarrier.
3. TheConditions,Regulationsandanyapplicabletariffsofeachcarrierare,bythisnotice,
incorporatedbyreferenceintoandmadepartofyourcontractofcarriage.
4. TheConditionsmayinclude,butarenotrestrictedto:

Conditionsandlimitsonthecarrier'sliabilityforthebodilyinjuryordeathofpassengers.
Conditionsandlimitsonthecarrier'sliabilityforthelossof,damagetoordelayofgoodsand
baggage,includingfragileorperishablegoods.
Rulesfordeclaringahighervalueforbaggageandforpayinganysupplementaryfeethatmay
apply.
Applicationofthecarrier'sConditionsandlimitsofliabilitytotheactsofthecarrier'sagents,
servantsandrepresentatives,includinganypersonprovidingeitherequipmentorservicestothe
carrier.
Claimsrestrictions,includingtimelimitsbywhichpassengersmustfileclaimsorbringactions
againstthecarrier.
Rulesaboutreconfirmationsorreservationscheckintimestheuse,durationandvalidityofair
transportationservicesandthecarrier'srighttorefusecarriage.
Rightsofthecarrierandlimitsonthecarrier'sliabilityfordelayorfailuretoperformaservice,
includingschedulechanges,substitutionofalternativecarriersoraircraftandrerouting,and,
whenrequiredbyapplicablelaw,theobligationofthecarriertonotifypassengersoftheidentity
oftheoperatingcarrierorsubstitutedaircraft.
Rightsofthecarriertorefusecarriagetopassengerswhofailtocomplywithapplicablelawsor
whofailtopresentallnecessarytraveldocuments.
5. Youcanobtainmoreinformationaboutyourcontractofcarriage,andfindouthowtorequestacopy,
atplaceswheretransportationonthecarrierissold.Manycarriersalsohavethisinformationon
theirwebsites.Whenrequiredbyapplicablelaw,youhavetherighttoinspectthefulltextofyour
contractofcarriageatthecarrier'sairportandsalesoffices,anduponrequest,toreceiveacopyby
mailorotherdeliveryservicefromeachcarrierfreeofcharge.
6. Ifacarriersellsairtransportationservicesorchecksbaggagespecifyingcarriageonanothercarrier,
itdoessoonlyasagentfortheothercarrier.
YOUCANNOTTRAVELIFYOUDONOTHAVEALLREQUIREDTRAVELDOCUMENTS,SUCHAS
PASSPORTANDVISA.

GOVERNMENTSMAYREQUIREYOURCARRIERTOPROVIDEINFORMATIONONORPERMIT
ACCESSTOPASSENGERDATA.

DENIEDBOARDING:Airlineflightsmaybeoverbooked,andthereisaslightchancethataseatwill
notbeavailableonaflightforwhichapersonhasaconfirmedreservation.Iftheflightisoverbooked,
noonewillbedeniedaseatuntilairlinepersonnelfirstaskforvolunteerswillingtogiveuptheir
reservationinexchangeforcompensationoftheairline'schoosing.Iftherearenotenoughvolunteers,
theairlinewilldenyboardingtootherpersonsinaccordancewithitsparticularboardingpriority.With
fewexceptions,includingfailuretocomplywiththecarrier'scheckindeadline(carriershallinsert
either"of_minutespriortoeachflightsegment"or"(whichareavailableuponrequestfromtheair
carrier)"here),personsdeniedboardinginvoluntarilyareentitledtocompensation.Thecompleterules
forthepaymentofcompensationandeachairline'sboardingprioritiesareavailableatallairportticket
countersandboardinglocations.Someairlinesdonotapplytheseconsumerprotectionstotravelfrom
someforeigncountries,althoughotherconsumerprotectionsmaybeavailable.Checkwithyourairline
oryourtravelagent.BAGGAGE:Excessvaluationmaybedeclaredoncertaintypesofarticles.
Carriersmayapplyspecialrulesforfragile,valuable,orperishablearticles.Checkwithyour
carrier.CheckedBaggage:Carriersmaypermitafreecheckedbaggageallowance,whichissetby
thecarrierandmaydifferbyclass,and/orroute.Carriersmayapplyextrachargesforchecked
baggageinexcessoftheirpermittedallowance.Checkwithyourcarrier.Cabin(Unchecked)
Baggage:Carriersmaypermitafreecabinbaggageallowance,whichissetbythecarrierandmay
differbyclass,route,and/oraircrafttype.Itisrecommendedthatcabinbaggagebekepttoaminimum.
Checkwithyourcarrier.Ifmorethanonecarrierisprovidingthetransportationforyourjourney,each
carriermayapplydifferentrulesonbaggage(bothcheckedandcabin).SPECIALBAGGAGE
LIABILITYLIMITATIONSFORUSTRAVEL:FordomestictravelwhollybetweenUSpoints,federal
rulesrequireanylimitonacarrier'sbaggageliabilitytobeatleastUS$3400.00perpassenger,orthe
amountcurrentlymandatedby14CFR254.5.

CHECKINTIMES.Thetimeshownontheitinerary/receiptisthedeparturetimeoftheaircraft.Flight
departuretimeisnotthesameasthetimeyoumustcheckinorthetimeyoumustbeavailablefor
boarding.Yourcarriermayrefuseyoucarriageifyouarelate.Checkintimes,asadvisedbyyour
carrier,arethelatesttimesatwhichpassengerscanbeacceptedfortravelboardingtimes,asadvised
byyourcarrier,arethelatesttimesatwhichpassengersmustpresentthemselvesforboarding.

DANGEROUSGOODS(HAZARDOUSMATERIALS).Forsafetyreasons,dangerousgoods
mustnotbepackedincheckedorcabin(unchecked)baggageexceptasspecificallypermitted.
Dangerousgoodsincludebutarenotlimitedto:compressedgases,corrosives,explosives,flammable
liquidsandsolids,radioactivematerials,oxidisingmaterials,poisons,infectioussubstances,and
briefcaseswithinstalledalarmdevices.Forsecurityreasons,otherrestrictionsmayapply.Check
withyourcarrier.
