Benjamin Higbee's Descendants

! !Clinton D. Higby's work, Edward Higby and His Descendants, has been an authoritative
source for Higby-Higbee researchers since it was published in 1927. The author was a long-time
correspondent of many of the families covered in it, and he researched, cited, and sometimes
transcribed many of the early family documents in archives and court houses in eastern Pennsyl-
vania and New Jersey. Recently online access to images of some of those records has made it
easy to confirm that his work was careful and faithful. Mr. Higby was aware that his information
about Benjamin, son of Obadiah and Ann (Brower) Higbee, was incomplete: "I have found very
little about Benjamin, and nothing more reliable than the vague recollection of the family as to
his children."
! !It was surprising to realize that Benjamin lived within a few miles of the rest of Obadiah's
and Ann's other descendants in southwest Pennsylvania, and yet they apparently knew very little
about him and his family. He attended Peters Creek Baptist Church in Library, where many fam-
ily members attended, and he was related to the pastor, David Philips, by marriages. Did his
brother Obadiah's departure for Peters Creek Disciples Church (also called Church of Christ or
Campbellite) cause a rift? Did his obligations as executor of his father's will drive a wedge be-
tween them? Did his first or second wife cause friction in the family? Did they simply have no
correspondents in the family?
! !In any case, recent electronic access to early documents from court houses in western
Pennsylvania and to Revolutionary soldiers' pension files has made it possible to expand on and
correct Clinton Higby's work on the family of #115 Benjamin6 Higbee (Obadiah,5 Peter,4 Ed-
ward,3 Edward,2 Edward1).
! !The central documents for the early generations shown here are the wills of Obadiah the
father, Benjamin, Benjamin's second wife, Sarah, and documents related to her pension, claimed
under her first husband's Revolutionary service. They are abstracted in the following pages. Note
that the spelling of Higbee-Higbe-Higby-Higbie-Hickby has varied with the documents cited and
sometimes within a single document. Higbee has been used in writing this narrative, although
the original spellings have been retained in citing the sources. There are similar variations in the
Herron/Heron/Herring/Harron name.

To my much beloved wife, all that part of my present dwelling house that she and I have been occupying
heretofore, as long as she wishes to remain in it, and also the movable property that she brought here that
is now in our possession and also the one half of all my household property at her own choice (or divide)
and also one cow and two hogs of her own choice.

To the heirs of my son John Higbee one hundred dollars, to be equally divided among them share and
share alike.

To the heirs of my daughter Abigal the sum of one hundred dollars to be divided among them, except
her two daughters, Catherine & Harriet. To them I give one dollar each.

To the heirs of my son Benjamin Higbee the sum of seventy? dollars, to be divided among them, except
Gilbert and Sarah Ann to them I give one dollar each.

To the heirs of my daughter Margaret, the house & lot in which Henry Alley now lives, as soon as the
youngest of them arrives at the age of eighteen years. I do give the same? in trust to my son Joseph Hig-
bee or his proper representative for their use until the youngest shall have attained the above age.

To my two sons Joseph and Henry all my horses, except... and also my plows, harness, gears, mattock,
and axes.

And to my son Henry my waggin.

To my three sons Joseph Higbee, Marks (sic) Higbee and Henry Higbee the farm on which I now re-
side equaly, share and share alike, to be divided among them by three persons ... upon whom they may
agree. And in consideration for which I do require them to provide their mother at all times with a suffi-
ciency of good food carefully put up as she may want it. And also the keeping of one cow, and also things
necessary for her table if she wishes it as long as she ___ to remain here. And also at all times to treat her
in a kind and christian like manner. The same to be given in lieu of dower.

.!..Thomas Harron volunteered in Carlisle, Pennsylvania, on May 8, 1779, served as conductor of pack
horses through January 1780. He was discharged at Pittsburgh, Pennsylvania, and was paid by Archibald
Steele, Deputy Quartermaster General.

! homas Herron married September 7, 1797, in Washington County, Pennsylvania, Sarah Hopkins.

!Thomas Harron died September 27 or 29, 1832, at his home in Washington County, Pennsylvania.
!The soldier's widow, Sarah Harron, married May 14, 1840, Benjamin Higbee, who died September 28,
1854.
!Sarah Higbee was allowed a pension on her application executed May 1, 1855, in Allegheny County,
Pennsylvania, by reason of the service in the Revolutionary War of her first husband, Thomas Harron.

! ecember 14, 1855, Sarah Higbee, then aged seventy-nine years and a resident of Washington County,

Pennsylvania, made application for the bounty land which was due on account of the service of her
first husband, Thomas Harron, in the Revolutionary War. She was granted one hundred sixty acres of
bounty land on Warrant No.36731 under the Act of March 3, 1855.

No reference was made to children.

I! n December 1855, Joseph Higbe and Henry Higbe (they signed Higbe) were living in Washington
County, Pennsylvania. One A.W. Foster and one J.Heron Foster were present in 1855, in Allegheny
County, Pennsylvania, where Sarah Higbee applied for pension. No relationship of these four persons to
the other families is shown. ...

First Generation

1. Benjamin Higbee1,2,3 (Obadiah,5 Peter,4 Edward,3 Edward,2 Edward1) was born in New Jersey, maybe
near Trenton, on 8 Jan 1776, a son of Obadiah and Anna May (Brower) Higbee.1,2,4,5,6,7,8,9,10 His parents
settled their family in St. Clair Twp., Allegheny Co., Pa., about 1785, where they were farmers. His father
named Benjamin as the executor of his will, on 24 Dec 1808.3 By 1820, Benjamin and his family lived at
Peters Twp., Washington Co., Pa., but he had moved to Union Twp. by 1840, and lived there at the time
that he signed his will and died, 28 Sep 1854.4,11 He was buried at Peters Creek Baptist Church Cemetery,
Library, Allegheny Co., Pa., and he was noted as the father of Henry A. Higbe by the compiler of grave-
stones there.4

In 1798 Benjamin was reported to first marry Catherine8,12 ___; according to Clinton Higby, they married
near Finleyville, Washington Co., Pa., but it was more likely across the line in Allegheny Co.12 She was
born about 1770-178010 and appears to have died after the 1830 census, when a woman her age was in
Benjamin's household listing, and before May, 1840, when he remarried. In 1800 and 1810, they resided
at St. Clair Twp., Allegheny Co., Pa.10 By 1820 and 1830, they lived in Peters Twp., Washington Co.6.7 In
1840, Benjamin was in Union Twp., Washington Co., presumably with his second wife, Sarah.5

Benjamin and his first wife (Catherine?) had the following children:

born in Delaware in the 1850 US Census, and was not mentioned in Benjamin's
or Sarah's will. He lived in Indiana and apparently was unrelated to this family.

On 14 May 1840, Benjamin second married Sarah (Hopkins) Herron,2,5,13 the widow of Thomas Herron,
a Revolutionary soldier, according to her pension file. She was born in New Jersey about 17762 and
probably died at the Higbee family farm in Union Twp., Washington Co., Pa., about Nov 1858,13 based
on the fact that she signed her will on 9 Nov 1858, saying that she lived in Union Twp., and it was proved
on 9 Dec 1858. Sarah was buried beside her first husband at Mingo Cemetery, Washington Co., Pa. Her
gravestone was visible when Mr. and Mrs. Walter Hoffman* read the cemetery on 27 May 1961, and re-
corded this:
Mingo Presbyterian Church and Cemetery is located at the Junction of Venetia Road with Route 88
one mile south of Finleyville, Pa. This is one of the most historic churches west of the Allegheny

Mountains. About 1783 the bravest of the Mingo Creek Settlers gathered near the present site of the
Mingo Church, posted sentries and began the services of Christian worship which have continued
there uninterrupted to this day.

Second Generation

Children of Benjamin Higbee (1) & Catherine

2. John Clark Higbee (Benjamin1).14,15,16 He was probably born in St. Clair Twp., Allegheny Co., Pa., on
2 Dec 17988,14,15,16,17 and died at age 55y1m3d, probably near Grindstone, Fayette Co, Pa., of injuries
from a horse-powered threshing machine, on 5 Jan 1854.11,14,16,18 He was buried at Peters Creek Baptist
Church Cemetery, Library, PA.4 His children were mentioned as "heirs of my son John" named in his fa-
ther Benjamin's will, in Sept 1854.11

About 1821 John married his first wife14 possibly in Finleyville, Washington Co, PA.12,20 She apparently
died before 1829, when he married Betsy.14

John and his first wife had the following children:

According to the author Clinton Higby, John next married Elizabeth "Betsy" (Bouton) Bell14,15,16 about
1829 in Washington Co., Pa., and they moved to Grindstone, Fayette Co., about 1836.12 Her FindaGrave
memorial says that she was born in Indiana Co., Pa., on 19 Jun 180615,17,21,22,23 and died at Fayette Co.,
Pa., on 8 Dec 1881.16,24 She was buried at Grindstone First Christian Church Cemetery.

John and Betsy had the following children:

3. Abigail W. Higbee (Benjamin1)11,25 was born in Allegheny Co., Pa., about 1 Aug 180025,26,27 and died
at Luzerne Twp., Fayette Co., Pa., on 12 Apr 1850.11,25,27 She was buried at Beallsville Cemetery, Wash-
ington Co., Pa., in the "old section."25 Her father referred to the "heirs of my daughter Abigal" in his
will, written in Sept 1854.11

Abigail married William Holmes,26,28,29 son of Andrew Holmes and Fannie or Faney Wells. He was born
in Washington Co., Pa., about 1804.26,30,31 The 1850 US Census enumerator was very specific and re-
corded the county of birth for everyone in the household, including Abigail, who had died a few months
earlier. The census listed Washington County as the birthplace for William and all the childrenbut it
showed Allegheny County for Abigail.

According to his biographical summary in Thomas Cushing's Genealogical and Biographical History of
Allegheny County, William moved to Ohio after his wife's death and died there. That summary appears to
have been written by his eldest son, John Holmes, who was probably in a position to know, but his state-
ment was surprisingly vague. Some researchers have stated that William died in Pittsburgh in 1880, but
the William Holmes there differs from "our" William.32,33 The William who died on 2 April 1880 in Pitts-
burgh was a "gentleman," widower, age 76, born in Chester County, living on Enterprise Street, previous
residence Blairsville. 32,33Abigail and William Holmes had the following children:

5. Benjamin Higbee (Benjamin1).11,34 He was probably born in St. Clair Twp., Allegheny Co., Pa., in
1800-1810, where his parents lived at that time.35 He was living in Union Twp, Washington Co, PA, at
the time that he died, about Dec 1847.34 His will was proved at Washington Co., Pa., on 30 Dec 1847.34

About 1833 Benjamin married Jane Jordan34,36,37 based on their children's birth years. Jane was born in
Virginia, about 1810-1820.35,36 She was named as Benjamin's expected heir in his will, but no mention of
her has been found in 1850 or later. In the1850 US Census, her sons Gilbert and James appeared with her
brother-in-law's family, daughter Catherine lived with the Benjamin Little/Lytle family, but Jane and
daughter Mala are elusive. Possibly Jane died soon after Benjamin's death or remarried, changing her
name. It appears that their uncle, Joseph Higbee, became the boys' guardian.

Benjamin and Jane had the following children:

Finleyville, Washington Co., Pa., and moved to New Albany, Indiana, in the 1830s.38,39 He was, however,
listed in the 1850 US Census as born in Delaware, and he was not named in Benjamin's or Sarah's will.

For the purpose of distinguishing him from Benjamin and Sarah's family, these details might prove help-
ful: Clement died near New Albany, Ind., 40,41,42 and was buried at Fairview Cemetery, New Albany,
Floyd Co., Ind., Plat 1, Range 3, Lot 26, on 6 Nov 1871.42 About 1838 Clement married Hannah
Dempster39,43 in New Albany, Ind. She was born in Indiana, about 181938,39,43 and probably died at New
Albany, Ind., about 16 Aug 1850.41,43 She was also buried at Fairview Cemetery, Plat 1, Range 3, Lot 26,
on 18 Aug 1850.43

Clement and Hannah had the following children, although they appear to be unrelated to Benjamin's fam-
ily:

7. Margaret Higbee (Benjamin1)11 was born in Pennsylvania, about 180744 and died between Sep 1850
and Sep 1854.11,44 Her death was implied by the phrase "heirs of my daughter Margaret" in her father
Benjamin's will in Sep 1854.11

About 1840 Margaret married Henry Alley,11,44,45 who was born in Pennsylvania about 1807.44,45,46 It
appears that he moved to Mansfield, Ohio, after 1870 with his daughter, Roxanna, where they appeared in
the 1880 US Census.45

Margaret and Henry Alley had the following children:

8. Mark Higbee (Benjamin1)2,5,11,47 was born in Pennsylvania, about 1809,47,48 and died after the 1860
Census.11,13 In 1850 he lived next door to his father and stepmother, with his brother Henry and Henry's
wife Mariah.2 He was named in his father's will in 1854 but not in his stepmother's in 1858.11,13 It appears
that he never married.

9. Joseph Higbee (Benjamin1)2,5,13,47 was born in Pennsylvania, aboutt 1811.2,47,49,50 He died on 9 Nov
1880,51 probably in Union Twp., Washington Co., Pa, He signed his will on 18 Apr 1880, and it was
proved on 17 Nov 1880.52 Joseph lived next to, and with, his brothers, Henry and Mark in 1850 and
1860.2,47 He was named in his father's will in Sep 1854.11

Joseph married Sarah ___2,47,49,50 in about 1849. She was born in Ohio or Pennsylvania, about 18222,4,50
and died at age 51 years, on 8 Jul 1873.4,49 She was buried at Peters Creek Baptist Church Cemetery, Li-
brary, Pa.4

Joseph and Sarah had the following children, and they fostered his brother's sons, Gilbert and James
Higbee.

10. Henry A Higbee (Benjamin1)2,4,11,53,54 was born in Pennsylvania, about 18192,5,47,53 and was named in
both his father's will (1854) and his stepmother's will (1858).11,13 Henry died on 10 May 1873, probably
in Union Twp., Washington Co., Pa.54,55 He was buried at Peters Creek Baptist Church Cemetery, Library,
Pa.4

Based on their children's birth years, Henry married Mariah Atcheson,2,47,53,54,56,57,58 daughter of James
Atcheson and Susan Hudson,2,53 about 1850. She was born in Union Twp., Washington Co., Pa., on 27
Feb 18342,4,53,56,57,58,59 and died at Gastonville, Pa., on 21 Aug 1921.4,55,56,59 Mariah was buried at Peters
Creek Baptist Church Cemetery, Library, Pa.4,59 After Henry Higbee's death she married Henry Robson,

The 1910 census recorded that she'd had only one child, and James H. Higbee was living with her and
Henry Robson.57 Was that the enumerator's mistake? She was living at Gastonville, Pa., when she con-
sented to daughter Ethel's marriage in 1888.60 According to her obituary, she was a member of Peters
Creek Baptist Church for 70 years.55

name has not appeared in the readings of that cemetery. He was farming on Little Mingo Creek Rd., on

In the name of God amen I Benjamin Higby Jr of the County of Washington and state of Pa. Being weak of body
and of sound mind memory and understanding but considering the uncertainty....
To my dear wife Jane all the household furniture togeather with whatever other property may be found to me at my
death, excepting that otherwise disposed of hereafter to my children to have and dispose of as she thinks best.
Unto my son Gilbert Higby all my clothes to have them as they will suit him.
Unto my son James Higby the watch which I now have when he become Eighteen years of age, to remain in the
hands of my executor for his use untill that time
Unto my daughter Catherine my large Bible
Whatever may come or be on hand at my death shall be put to interest as soon as it can which interest my wife is to
have yearly so long as she remains my widow... the principal not to be broak? unless my executor of the gardeans
appointed by court for the children shall think it absolutely necessary for her support.... If my wife marry or at her
death whatever money shall be left shall be divided between my live children as they become of age shear and shear
alike.

37. Analysis: The biographical entry for J. W. McCreedy in Cushing's Allegheny County History, 1889, says that
his wife was Mary, daughter of Benjamin and Jane Higbee. It seems unlikely that Mr. McCreedy would have in-
vented this about his wife, but it is the only record I've found of Mary's maiden name or family. Mary/Mala was not
named in Benjamin's will, which was signed 6 Nov 1847, proved 30 Dec 1847, Washington County, Pa. (Benjamin's
other three children and wife were mentioned by name.) Mary/Mala might have been born in the months following
Benjamin's death. Benjamin didn't have very much to leave: furniture, clothes, watch, and Bible. In the 1850 US
Census, the three known children were split up and living with neighbors and relatives. I have not found Jane or
Mary Higbee in 1850-1870. Does anyone have records about Mary/Mala McCreedy?

To my much beloved wife, all that part of my present dwelling house that she and I have been occupying heretofore,
as long as she wishes to remain in it, and also the movable property that she brought here that is now in our posses-
sion and also the one half of all my household property at her own choice (or divide) and also one cow and two hogs
of her own choice.

To the heirs of my son John Higbee one hundred dollars, to be equally divided among them share and share alike.
To the heirs of my daughter Abigal the sum of one hundred dollars to be divided among them share and share alike,
except her two daughters, Catherine & Harriet. To them I give one dollar each.
To the heirs of my son Benjamin Higbee the sum of seventy? dollars, to be divided among them share and share
alike, except Gilbert and Sarah Ann to them I give one dollar each.
To the heirs of my daughter Margaret, the house & lot in which Henry Alley now lives, as soon as the youngest of
them arrives at the age of eighteen years.
And further I do give the same? in trust to my son Joseph Higbee or his proper representative for their use until the
youngest shall have attained the above age: the bounds of said lot to be ___ within the present enclosure.
To my two sons Joseph and Henry all my horses, except my ___ mare as they now have them and also my plows,
harness, gears, mattock, and axes.
And to my son Henry my waggin.
To my three sons Joseph Higbee, Marks (sic) Higbee and Henry Higbee the farm on which I now reside equaly,
share and share alike as in quantity and quality, the same to be divided among them by three persons persons (sic)
upon whom they may agree. And in consideration for which I do require them to provide their mother at all times
with a sufficiency of good food carefully put up as she may want it. And also the keeping of one cow, and also things
necessary for her table if she wishes it as long as she ___ to remain here. And also at all times to treat her in a kind
and christian like manner. The same to be given in lieu of dower.

In the name of God, Amen, I, HENRY HIGBEE, of Union Township County of


Washington, being sick and weak in body, but of sound mind and memory and
understanding (Praise be God for it) considering the certainty of death and
the uncertainty of the time thereof, and to the end I may be the better
prepared to leave this world whenever it shall please God to call me hence,
do therefore make and declare this my last will and testament in manner
following, (that is to say:)
First and principally: I commend my soul into the hands of Almighty God my
creator, and my body to be buried with as little expense as decency will
permit and that all my debts and funeral expenses be paid as soon after my
decease as conveniently may be.

Second: I will and bequeath unto my Dear wife MARIAH [ATCHESON] HIGBEE all
my personal property, to make use of it to the best advantage for herself
and family, and to pay her funeral expenses.

Third: I will and bequeath unto JAMES H. HIGBEE thirty five dollars to be
expended by himself in clothes as a freedom, which he has all ready
received.

Fourth: I will and bequeath unto my daughter ELIZABETH C. HIGBEE twenty five
dollars to be expended by herself in clothes as a freedom.

Fifth: I will and bequeath unto SUSAN C. HIGBEE my daughter twenty five
dollars to be expended by herself in clothes as a freedom.

Sixth: I will and bequeath to my son NEWTON H. HIGBEE thirty five dollars
to be expended by him self in clothes as a freedom.

Seventh: I will and bequeath unto my daughter ETHEL B. HIGBEE twenty five
dollars to be expended by herself as a freedom, in clothes.

The above bequests to be paid by my widdow(sic) or cause to be paid, as my


daughters arive(sic) at the age of eighteen and my son NEWTON H. HIGBEE at
the age of twenty one years.

Eighth: I will and bequeath to my Dear wife MARIAH HIGBEE all the income
and proceeds of all my real estate located in Union Township, Washington
County, adjoining lands of JOSEPH HIGBEE, ----Grunn(?) and others. She is
to occupy and have the control of the same while she remains my widow for
her support and maintenance and the support and maintenance of my three
daughters to the ages of eighteen and son NEWTON H. HIGBEE to the age of
twenty one years, provided they remain at home with their mother.

Ninth: If my widow in the providence of God is called away by death before


my youngest child arrives to the age of twenty one years, then it is my will
that my executor is to have control of the real estate and to rent or lease
it for the benefit of my heirs until my youngest child arrives to the age of

Gastonville, Aug. 21 - Another old and respected resident of Gastonville passed to the great beyond August 21,
Mariah Robson, in her 88th year. She was the widow of Henry Robson who died August 28, 1920. She was twice
married, first to Henry A. Higbee of Union township, who died May 10, 1873, to which marriage were born five
children, two of whom are dead. Surviving are J. H. Higbee and N. W. Higbee of Gastonville and daughter Mrs.
Ethel H. Sebolt of Castle Shannon. The second marriage was to Henry Robson, who was a member of the cele-
brated Ringgold Battalion and who died August 28, 1920. To this marriage was born one daughter, Lulu, now Mrs.
Archie Kerr of Russellton. She has been with her mother since the beginning of her last sickness. For 70 years Mrs.
Robson had been a member of the Peters Creek Baptist church at Library, at which place her body was interred at
2:30 this afternoon. She lived all of her life within a radius of ten miles of Gastonville at which place she died. She
had a great many friends, made during her long life, who showed their sympathy, respect and kindness for her dur-
ing her sickness. She is survived by one sister, Mrs. Emma Neal of Holidays Cove, W. Va., who was with her during
her sickness.

"Edward Carter Higbee was born October 28, 1869, in Jefferson township, Fayette county, Pa., the son of Israel J.
Higbee and Eliza Higbee. He studied law and was admitted to practice at the Fayette county bar June 11, 1897, and
later at the bar of the Supreme Court of Pennsylvania and in the United States Courts. He is a member of the law
firm of Sterling, Higbee & Matthews, and a director of the First National Bank of Connellsville. He was a member
of the school board of Connellsville from 1901 until 1906, and was largely responsible for the efficient reorganiza-
tion of the Connellsville schools. Mr. Higbee was appointed by Geo. W. Guthrie a member of the Democratic Com-
mittee to draft legislation in 1903. He is a thirty-second degree Mason. Mr. Higbee married Miss Emma Lint Sep-
tember 22, 1897. There are five children."

Henry Higbee, 87, of New Corcord Route 2, a retired farmer, died at home at 2 p.m. Tuesday (April 7). He was born
March 1, 1883, at Grindstone, Pa., a son of John and Amanda Strong Higbee. Mr. Higbee lived in Westland Town-
ship, Guernsey County, 50 years.

He was a member of New Corcord United Methodist Church and New Concord Grange.

Surviving are two daughters, Mrs. Elizabeth Scott of Canton and Mrs. Anna Downing of Cambridge of Cambridge;
a son, James of New Concord Route 2; a sister, Mrs. Ella Nicely of Waynesburg, Pa.; and 10 grandchildren. His
wife, Ethel, died in 1966. A daughter and two brothers are also deceased.

Friends may call at Mock Funeral Home in New Concord 7 to 9 p.m today and 2 to 4 and 7 to 9 p.m. Thursday.
Services will be held at 2 p.m. Friday at the funeral home. Burial will be in New Concord Cemetery."

"Another Soldier Gone"
The Subject of this notice, James M. Welch, was born in Union Township 1833. He was the eldest son of J.S. and
Susan Welch. He Enlisted from Finleyville in the military service of the United States in 1861. On the organization
of the 85th Reg. PA Vol.., Being a sergeant in CO. A of said regiment. He served in the Peninsular campaign under
McClellan; after which his regiment was transferred to the department of the South where he was engaged in the
siege of Charleston. He was commissioned second Lieutenant in Co A. 85th Reg., on the 20th day of Nov. 1862.
Early in August 1863, he was prostrated by a sunstroke or heatstroke, by which he lost his speech and was therefore
unfitted for further military service, On the 15th of August, 1863 he was honorable discharged from ,military service
of the United States on account of physical disability . Two years passed by before he recovered his speech, but he
never fully recovered from the heat stroke, being ever after subject to severe headaches. His death which occurred at
West Elizabeth about midnight on Friday, May 3rd was the result of a hemorrhage of the brain. which took place
early in the evening on the said day.

The deceased was the father of eight children, three sons and five daughters. Six of these children survive him, one
of them being Mrs. Henry Stang of Monongahela City. His Wife, who was Miss Catherine Higbee, also survives

him. Three of his Brothers, besides himself entered the military service of the United States during the late rebellion.
One of them J.S.G Welch, was killed at the siege of Richmond under General Grant.

The deceased participated in every battle in which his regiment was engaged. From the time of his enlistment to his
discharge. That he discharged his full duty towards his country in the time of her sorest need cannot be denied, and
now he is, AD PATRES.
