SHIELDSURE GADGET PROSSURANCE TM (The Product), is an exclusive

property of MEIRTEC SOLUTIONS PRIVATE LIMITED (The Company). All


rights, title and interest to the same are owned and held solely by the Company.
Unless otherwise stated, copyright and all intellectual property rights, trademarks and
logos appearing with this Product are the property of the Company, its parents,
affiliates and associates and are protected under applicable Indian laws. You agree
not to infringe upon any trademark or logo or other proprietary information contained
herein. Any infringement shall be vigorously prosecuted and pursued to the fullest
extent permitted by law.

These are the terms and conditions of your Gadget Insurance available to you as a
Qualifying Purchaser of the Product, SHIELDSURE GADGET PROSSURANCE
These terms and your certificate should be read as one document.

MEIRTEC SOLUTIONS PRIVATE LIMITED (we/us/our) provide the


Services, under this agreement, and have arranged the insurance cover
with the insurer with leading insurance companies in India.

All Terms and Conditions of Insurance Company will be biding upon you. By
purchasing this product, you acknowledge that you have read all terms and conditions
of Insurance Company as applicable for Mobile Phone Insurance scheme and you admit
and accept binding force of the said terms and conditions of Insurance Company.

Therefore, we are imposing additional terms and conditions in the process of getting
insurance cover. You hereby acknowledge the fact that all of Insurance claims will be
settled and paid by Insurance Company through us.

Therefore, SHIELDSURE GADGET PROSSURANCE will not be


responsible for any claim or loss, if, Insurance Company Rejects your claim.

All brands, trademarks which are provided with the product are not party to the present
Insurance Policy, therefore, they cannot be hold responsible for any claim.

The Policy will be applicable only on purchase of new gadget on Invoice.

Your insurance benefit is based on the information you gave to us verbally or otherwise
about you and your personal details when you registered for the insurance.
ACCEPTANCE OF AGREEMENT: Your acceptance of this Agreement shall be
deemed to be accorded upon the occurrence of physically signing, orally or
electronically accepting the terms of this Agreement.

I. COVERAGE

Subject to all of the terms and conditions of the issued certificate, we agree to become
service facilitator for the insurance as stated in the issued Certificate on a Year to Year
basis, provided that any covered damage or Loss to the Covered Property occurs while
your coverage is in effect.

The product (SHIELDSURE GADGET PROSURANCE) should be installed or


registered on the same day or within 11 days from the date of purchase in case of
counter purchase and within 11 days from the date of delivery of device for online
purchase.

Purchaser of the brand new equipment along with the product of the Proposer, whose
Details & Name is shown on the invoice, would be termed as the Insured in the said
policy.

II. INFORMATION ABOUT YOUR COVERAGE

With regard to all enrolment requests, the coverage specified in the issued certificate
begins within 48 hours on the day after purchasing the product. The information
pertaining to your communication equipment coverage included in your receipt,
invoice, or other documentation from your Service Provider is incorporated by
reference in the issued certificate and specifically includes the name and address of the
Insured Subscriber and information to determine the effective date of coverage.

III. BENEFICIARY/USERS:

Individual Purchaser or 1st owner his/her Spouse, Parents & Children.


Organization Any authorized representative/employee if purchased by company or
organization.

IV. GEOGRAPHICAL LIMIT: Indian Territory

V. INDEMNITY: Claims settlement directly to claimant as per terms & conditions


of the policy.
VI. POLICY COVERAGE:
Insurance against Accidental damage, Accidental Fluid damage, Fire Damage Insurer
in the event of following occurrence to the Insured Equipment will approve for repair
or replace equipment with same or similar equipment or at their option, will arrange
for payment if the equipment:

Suffers accidental physical damage to the Insured Equipment and/ or such damage
causes equipment to stop working.
Fails to work because accidentally fluid has entered its internal circuitry, resulting in
stoppage of the insured equipment.
Suffers accidental Fire Damage to the Insured Equipment that causes equipment to
stop working.

VII. PROPERTY NOT COVERED

The following is not covered:

1. Insurance will be invalid if coupon is registered after 48 hours of mobile purchase.


2. Any property or equipment that is not Covered Property.
3. Contraband or property in the course of illegal transportation or trade.
4. Property in transit to you from a manufacturer or seller that is not the Authorized
Service Facility.
5. Personalized data such as contact lists, photos, video, and music downloads.
Customized software, such as personal information managers (PIMs) ring tones,
games, or screen savers.
6. Covered Accessories will only be covered when they are part of a Loss to Covered
Property other than Covered Accessories.
7. Color face plates or other Non-Covered Accessories.
8. Preventive maintenance or preferential adjustments.
9. Accessories are not covered in insurance.
10.If customer do not submit documents within 30 days, case will be closed and claim
will be cancelled.
11.If the Customer is repairing his handset on his own, then the same should be done
from the Authorized Service center else we will not be able to process his claim in
future.
VIII. EXCLUSIONS

We will not pay for Loss caused directly or indirectly or resulting from events,
conditions or cause of Loss identified. Such Losses are excluded regardless of any other
cause or event that contributes concurrently or in any sequence to the Loss.

1) Indirect Loss, meaning: any delay; loss of market; loss of use or any other
consequential loss; interruption of business, or inconvenience; an increase of Loss
caused by or repair by strikers, other persons or any other cause of loss.
2) Loss due to the intentional parting of Covered Property by you or anyone entrusted
with the property. Loss due to intentional, dishonest, fraudulent or criminal acts by
you or your family members; any of your authorized representatives; anyone you
entrust with the property; and any of their family members; or anyone else with an
interest in the property for any purpose, acting alone or in collusion with others.
3) Loss due to obsolescence, including technological obsolescence, of the Covered
Property.
4) Loss caused by or resulting from change or enhancement in color, texture, or finish.
Loss caused by or resulting from expansion, contraction, or any cosmetic damage of
Covered Property, however caused. Such excluded causes of Loss include, but are
not limited to, scratches, marring, and cracked displays that occur to Covered
Property that do not affect the mechanical or electrical function of the Covered
Property.
5) Loss caused by or resulting from faulty repair, adjusting, installation, servicing or
maintenance, unless fire or explosion ensues and then only for Loss by ensuing fire
or explosion. Loss caused by or resulting from unauthorized repair or replacement.
6) Loss caused by or resulting from the discharge, dispersal, seepage, migration, release
or escape of Pollutants.
7) Loss caused by or resulting from use of the Covered Property in a manner for which
it was not designed or intended by the manufacturer. Loss caused by or resulting
from failure to follow the manufacturers installation, operation or maintenance
instructions.
8) Loss caused by or resulting from error or omission in design, programming, system
configuration, faulty construction, or any original defect in any Covered Property, or
manufacturers recall. Loss due to Mechanical and/or Electrical Failure occurring
during the term of the manufacturers warranty.
9) Loss or damage to or of batteries (unless otherwise covered as a Covered Accessory
when part of a Loss to other Covered Property) is not covered. Loss or damage to or
of personalized data, such as contact lists, photos, video, and music downloads is not
covered. Loss or damage to or of customized software, such as personal information
managers (PIMs), ring tones, games, or screen savers is not covered. Loss or
damage to or of antennas, external housings, or casings that does not affect the
mechanical or electrical function of the Covered Property is not covered.
10) Loss caused by or resulting from normal wear and tear, gradual deterioration,
inherent vice or latent defect.
11) Any Loss or damage caused by or through or in consequence, directly or indirectly,
of Computer Virus, whether intentional or unintentional, and whether such loss be
direct or indirect, proximate or remote or be in whole or in part caused by,
contributed to or aggravated by the covered causes of Loss insured against under the
issued certificate.
12) Any Loss or damage caused by or through or in consequence, directly or indirectly,
of Nuclear Hazard, meaning any weapon employing atomic fission or fusion; or
nuclear reaction or radiation or radioactive contamination from any other cause; but
we will pay for direct physical Loss caused by resulting fire, if the fire would be
covered under the issued certificate. Loss caused by or resulting from war, including
undeclared or civil war; warlike action by a military force, including action hindering
or defending against an actual or expected attack, by any government, sovereign or
other authority using military personnel or other agents; or insurrection, rebellions,
revolution, usurped power of action taken by government authority in hindering or
defending against any of these. Loss caused by or resulting from Governmental
Action, meaning seizure or destruction of property by order of governmental
authority including economic and trade sanction as provided under applicable law
and Government Department guidelines.
13) Insurance claim will be invalid if insurance kit is registered after 48 hours of mobile
purchase.
14) If the Customer is repairing his handset on his own, then the same should be done
from the Authorized Service center else we will not be able to process his claim in
future.

IX. LIMITS OF LIABILITY.

Customer is eligible to get claims upto insured value(Invoice Value) in twelve (12)
month period.
X. CONDITIONS IN THE EVENT OF LOSS

Subject to the terms and conditions set forth in the issued certificate, the Insurance Co
will make good any Loss covered under the issued certificate.

A. In the event of a covered Loss, we, the repair, of the Covered Property through the
Authorized Service Facility.
B. An Insured Subscriber will not be entitled to receive cash in lieu of actual repair of
the Covered Property.
C. Equipment failure evaluation performed by the Service Provider and/or our
authorized representative and/or the manufacturer may be required prior to approval of
your request for repair of the Covered Property.

XI. POLICY TERMS & " USER" AGREEMENT


The "User" is bound by the policy terms as enclosed in the pack. registration of the
Product deems acceptance of the Policy Terms & "User" Agreement.
Servicing of claims:
1. The "User" acknowledges and understands that claim or payment of any benefit
covered by an add-on group insurance cover shall be at the sole discretion of the Insurer
and "Organization" shall use best efforts to only provide assistance in facilitation of the
claim by liaising with the Insurer through Insurance Company. The "Organization", its
partners, distributor, retailers etc. is not liable in anyway if for any reason whatsoever
the claim has been fully or partially rejected or disapproved by the insurer. The decision
on claims is at the sole discretion of insurer.
2. Any claims made by the "User" as per the Policy Terms shall be subject to the
following:
a. The "User "having met and complied with the Policy Terms. This also applies to
terms and conditions set out herein and any others which may be added to the Policy
Terms and communicated to the "User" from time to time.
b. The "User "should provide the insurer by filing up the registration form of the
Product with full and accurate information as per this Agreement. The registration
form of the ' Application ' should be completed by the "User in all respect, failing
which insurer may, at its sole discretion, proceed and provide suitable claim decision.
c. The "User" having acted in a bona fide manner to make a claim.
d. The "User" having complied with the requirements of the Insurer for the purposes of
processing the claim as may be required from time to time

XII. CLAIM PROCEDURE:

INTIMATION :
Customer can intimate the claim to SHIELDSURE Customer Care Number
08451962001, 8651962002 within 48 hours of occurrence and get Complaint Number
(CN).
Immediately after intimation, following procedure to be followed CLAIM
DOCUMENTS TO BE FROM THE WEBSITE.
For Registration of Claim
Gadget to be taken to Authorized Service Centre OR Service Centre identified by
SHIELDSURE & Estimate for Repair to be obtained.
Claimant to send the following documents by E- mail to support@shieldsure.com
Claim Forms duly filled ,signed and scanned
All of the above to be downloaded from Website Scanned copy of Estimate from
Authorized Service Centre / Service Centre identified by if the damaged handset is
beyond economical repair, certification by the Authorized Service Centre / Service
Centre identified by SHIELDSURE.
If the damage handset is beyond economical repair, certification by the Authorized
Service copy of the beyond economical repaired certificate.
3 scanned Photos of the damage handset (1 photo showing IMEI No. and other 2
showing damage)
Scanned Invoice of Mobile Handset
Scanned copy Signature cum ID proof such as driving license, passport & pan card,
mentioning details such as date of birth, father/spouse, mother 's name in accordance to
the government of India;
Any other document as may be required by the respective Insurer.
On receiving the above documents by mail, decision on admissibility of the claim and
quantum will be communicated to claimant by E-mail within 4-24 hours on any
working day.
If claim is approved on REPAIR BASIS, following documents IN ORIGINAL are to be
sent to Insurance Company:
Claim Forms duly filled and signed
All of the above to be downloaded from Website.
Original Estimate from Authorized Service Centre OR Service Centre identified by
GADGETS SOLUTION.
Print out of 3 Photos of the damaged handset (1photo showing IMEI No and other 2
showing damage)
Invoice of Mobile Handset
Scanned copy Signature cum ID proof such as driving license, passport & pan card,
mentioning details such as date of birth, father/spouse, mother's name in accordance to
the government of India:
Cash Receipt or Invoice of Repair from Service Centre for the repaired handset
Any other document as may be required by the respective Insurer.
Claim form should be complete in all respect & duly signed, f ailing which insurer may,
at its sole discretion, proceed and provide suitable claim decision.
On receipt of above mentioned documents, the approved claim amount will be credited
to claimant's account in 21* working days.
If claim is approved on TOTAL LOSS BASIS, following documents I N ORIGINAL
are to be sent to Insurance Company:
Claim Forms duly filled and signed
All of the above to be downloaded from Website.
3 Photos of the damaged handset (1photo showing IMEI No. and other 2 showing
damage) Invoice of Mobile Handset
Scanned copy Signature cum ID proof such as driving license, passport S pan card,
mentioning details such as date of birth, father/spouse, mother's name in accordance to
the government of India.
Damaged Equipment
Any other document as may be required by the respective Insurer.
Claim form should be complete in all respect is duly signed, failing which insurer may,
at its sole discretion, proceed and provide suitable claim decision.
On receipt of above mentioned documents, the approved claim amount will be credited
to claimant's account in 21* working days.

XIII. DISCLOSURE:

Notwithstanding anything, the Company reserves the right to disclose any information
in response to / that it is required to be shared, disclosed or make made available to any
governmental, administrative, regulatory or judicial authority under any law or
regulation applicable to the Company.

XIV. RELATIONSHIP:

None of the provisions of the User Agreement shall be deemed to constitute a


partnership or agency between you and the Company and you shall have no authority to
bind the Company in any manner, whatsoever.

XV. GOVERNING LAW:

The Agreement shall be governed by the Laws of India. The Courts of law at Mumbai
shall have exclusive jurisdiction over any disputes arising under this agreement.

XVI. ENTIRE AGREEMENT:

These Terms of Service constitute the entire agreement between the parties with respect
to the subject matter hereof and supersedes and replaces all prior or contemporaneous
understandings or agreements, written or oral, regarding such subject matter.
XVII. SURVIVAL:

Rights and obligations under the Terms, which by their nature should survive, will
remain in full effect after termination or expiration of the Terms.

XVIII. WAIVER:

Any express waiver or failure to exercise promptly any right under the Terms will not
create a continuing waiver or any expectation of non-enforcement.

XIX. SEVERABILITY:

If any provision of the Terms is held invalid by any law or regulation of any
government, or by any court or arbitrator, the parties agree that such provision will be
replaced with a new provision that accomplishes the original business purpose, and the
other provisions of the Terms will remain in full force and effect.
