AN ACT
PROVIDING FOR A NATIONAL POLICY AGAINST ENFORCED DISAPPEARANCES,
EXTRAJUDICIAL KILLINGS, AND OTHER ACTS OF UNDUE INTRUSION OF THE
GOVERNMENT RESULTING TO DANGERS ON THE FUNDAMENTAL RIGHTS OF THE
PEOPLE

Be it enacted by the Senate or the House of Representatives of the Philippines in Congress


assembled:

SECTION 1. Short Title. This act shall be known as the Abolishment of the Toxic Chain
Act of 2024

SEC. 2. Declaration of Policy The State owes the people their protection against any
arbitrary design against their life, liberty, and property.

The State shall be the forerunner against subjecting the people to torture or to cruel and
inhuman or degrading treatment or punishment.

The State has the obligation and must have the initiative to be aware of the continual
suffering of those who are currently at large, missing, or those whose security is compromised
because of their escape from the shackles of undue or unlawful detention.

The State must guarantee not only through promises but in act that enforced
disappearances, extrajudicial killings, and other acts of undue intrusion by the government shall
forever be eradicated from the problematic issues surrounding our society.

The State shall guarantee that atrocious acts of the government resulting to the use of
the tool Writ of Amparo and Habeas Data shall be defined and punished. That all public officials
who violate the policies that will herein be stated shall be severely punished.

SEC. 3. Definition of Terms For the purposes of this act, the following terms shall be defined
as follows:

a. Enforced Disappearances These are disappearances that resulted from a
tactic, manhunt, or arrests done by the State through its military that resulted into
disappearances by certain individuals with their fates unknown.

b. Extrajudicial Killings These are deaths presumably done by the State or its
constituents in the local scene. Deaths reportedly done by local leaders that hungers from
further scrutiny and investigation that must be put into light, justice, and must be answered for
by the real perpetrators.

c. Undue Intrusion The ironic act of the government that opposes its function to
uphold the fundamental rights of the people. Such intrusion includes unlawful arrests, searches
and seizures, manhunts, and privately contracted kidnappings or killings.

d. Government The entity of the State supposedly tasked to help and promote
the welfare and development of the people. The supposed entity that should supposedly protect
the people and their rights, and to ensure their convenience in life and enjoyment of their liberty.

e. Fundamental Right The peoples right to life, liberty, and property. The
government is tasked to secure such rights for the people.

SEC. 4. The Commission for Humanity and Anti-intrusion (CHAIN) An organization that
shall have the power to question the government about current unsettled cases of enforced
disappearances, and extrajudicial killings in the present and in the future. The very commission
that will have the power to have its entity defined in the court representing the victim and shall
have the power to seek justice for those who are reportedly tortured during interrogations, raped
through grave abuse of authority, and killed to hide the atrocities of the government. They shall
be both the conscience and the checks and balance for the government. Basically, they shall be
considered the chain of the mostly unrestricted acts of the government.

SEC. 5. Proper measure to address the Orwellian Tendencies of the Government The
government is the big brother of our state. All information, important or otherwise, are
documented and stored within the states various private database. This provision calls for the
following:

An open database where the people may edit, hide, or delete their vital information
A website or a database wherein all information of the people may be stored and may be
controlled by them. The government will still have access to these data until the person, with
proper permission, shall have deleted the same. Information may be deleted but only subject to
its importance. The government shall still have a transcript on the date and the kind of
information deleted or edited.

A safe haven for those who suspects that they are being spied upon CHAIN (see
sec. 4) shall also be the investigative unit of supposed spies and other dangers against the
privacy of a person caused by the government or otherwise. Anyone suspected of endangering

anothers privacy shall be notified by the commission that a court proceeding against him is
imminent if probable cause has properly been found. The state may also be investigated upon
as the commission will also have unmitigated power in checking the actions of the same.

SEC. 6. All Military branches shall be reorganized All leaders of the branches of the
military will be met by the commission. The same will be reorganized to avoid confusion and to
identify who will be accountable if another illegal disappearance or an alleged extra-judicial
killing takes place. The commission shall only provide a recommendation and the Chief
Executive shall have the power to confirm or reject the same.

SEC. 7. All local government entities shall now be accountable Each of our local
governments shall have their own personality in the court. This will be necessary to ease the
investigative process and proceedings necessary.

SEC. 8. All local government entities held accountable shall be forced to produce all
demanded missing documents, evidences, and persons in their knowledge An
aggrieved individual may not anymore invoke any kind of writ to produce everything to protect
himself. Every information shall be given him to secure his person once a proceeding ahs been
decided in favor of the aggrieved.

SEC. 9. Former Mayors, Vice-mayors, Governors and other officials of high sanding in
local government shall be subject to thorough investigation if they are found to be in an
issue involving a disappearance or killing of a human person. CHAIN will be tasked to
investigate upon these harrowing issues both from the past and present and, if found with
probable cause, may proceed against these individuals.

SEC. 10. Torture in any way, or kind and for any purpose shall be banned Interrogations
or any kind of intensive questioning will be limited to safer means of extracting answers.
Physical abuse during interrogation may be reported directly to the commission.

SEC. 11. Enforced Disappearances is now a crime Anyone proven to be involved in the
enforced disappearance of an individual shall be forced to disclose of the location of the missing
individual. If the missing person is dead, then the location of the body. Anyone involved in such
heinous crimes shall be punished accordingly.

SEC. 12. Extrajudicial Killing is punishable by life imprisonment Extrajudicial and Political
killing, if proven by the commission that that is indeed the case, is now a capital offense.
Offenders include the perpetrators themselves and those who commanded or contracted the kill.

SEC. 13. Rumored Assassination organizations shall be investigated thoroughly CHAIN


shall have the task of investigating organization contracted by powerful individuals to kill.
Although not all are involved in political and extrajudicial killings, it is still in the best interest of
the public to hunt these organizations down and bring them to justice. After all, it is the right of
any person to be secured from fear of the taking of any of their fundamental rights.

SEC. 14. Penalties The proper city or municipal court shall have jurisdiction in any
proceeding instigated by The Commission for Humanity and Anti-Intrusion. Penalties for
Extrajudicial Killings and Enforced disappearances shall be a capital punishment of life
imprisonment and a fine ranging from 100,000 pesos to 200,000 pesos. Politicians who are
accused therefor cannot be proceeded against during their stay in public office. Assassins or
contract killers involved, military men, or police officers accused of the same or followed the
commands of a political authority shall have the same level of punishment and fine.

SEC. 15. Separability Clause. - If any part, section or provision of this Act is held invalid or
unconstitutional, other provisions not affected thereby shall remain in full force and effect.

SEC. 16. Repealing Clause. - All laws, decrees, orders, issuances, rules and regulations
contrary to or inconsistent with the provisions of this Act are hereby repealed, amended or
modified accordingly.

SEC. 17. Effectivity. - This Act shall take effect fifteen (15) days after its publication in at least
two (2) newspapers of national circulation.
