I, Daniel T. Satterberg, Prosecuting Attorney for King County in the name and by the
12 authority of the State of Washington, do accuse NATHAN CARL JOHNSON of the following
crime[s]: Assault Of A Child In The Second Degree, committed as follows:

Count 1 Assault Of A Child In The Second Degree

That the defendant NATHAN CARL JOHNSON in King County, Washington, on or
15 about August 6, 2017, being 18 years of age or older, did intentionally assault P.H., a child under
the age of 13, with a deadly weapon, to-wit: a firearm;
16
Contrary to RCW 9A.36.021(1)(c) and 9A.36.130(1)(a), and against the peace and
17 dignity of the State of Washington.
18 And further do allege the defendant, Nathan Carl Johnson at said time of being armed
with a black handgun, a firearm as defined in RCW 9.41.010, under the authority of RCW
19 9.94A.533(3).

Certification, discovery, and defendants criminal history; I further declare that according to the
defendants brother, the defendant was going through a tough time and had been very angry

lately; I further declare that the handgun that located next to the defendants bed, where the
defendant had been located by his mother, was fully loaded with one in the chamber; if ruther
9
declare that the victims date of birth is 7/26/2006.

15 Pursuant to CrR 2.2(b)(2)(i) and (ii), the State requests a warrant in the amount of

16 $100,000, because the defendant is likely to commit a violent offense and is unlikely to appear in

17 response to a summons. The defendant does have some warrant history. According to a Court

18 services interview from August 7, 2017, the defendant has had two King County warrants since

19 1999. He also has out of state history suggesting limited ties to this community. However, the

20 States chief concern is that of community safety. The victim is an eleven year old boy who was

21 riding his bike in the neighborhood. Unprovoked, the defendant approached the victim, after

22 exiting his car at his house, and pointed a fully loaded gun, with one in the chamber, at the

23 eleven year old after saying Hello. During the execution of the search warrant, officers

discovered at least three handguns, a twelve gauge shotgun, and an assault rifle (AR-15). In the
3
defendants brothers room, there were multiple other firearms. Considering the facts, the
4
defendants apparent access to firearms, and the fact that the victim and defendant live in the
5
same neighborhood, high bail is appropriate to ensure community safety of not only the victim
6
here, but of other children and adults who may come across the defendant.

The defendant's criminal history includes convictions for DUI (1997), DWLS Third
8
(1999). The defendant also appears to have out of state convictions for DUI (2010, 2005) and
9
Driving without Valid License (2002, 2001, 2000)

The State requests no contact with the victim and no possession of firearms or other
11
weapons.

Certification for Determination of Probable Cause

That Matthew Novak 115 is a Detective with the Federal Way Police Department and is familiar with the investigation
conducted in Federal Way Police Department 170011625. There is probable cause to believe that JOHNSON, NATHAN
CARL, 3/7/1971 committed the crime(s) of:

Assault Of A Child In The First Degree (Firearm, Deadly Weapon, Force), in Federal Way

County of King, in the State of Washington.

This belief is predicated on the following facts and circumstances:

On 8/6/17 at about 2145 hours, 11 year old P.H. was riding his bicycle in the roadway in the 29600 block of 22nd
Avenue South, a residential street. P.H. saw a male exit a blue Subaru parked in front of a residence. P.H. did not know
the male by name, but recognized him from around the neighborhood. The male was later identified as Nathan Johnson.

Johnson walked toward P.H. in the middle of the roadway and said "Hello". P.H. said hello back, and noticed Johnson
had his left hand concealed behind his left hip. Johnson lifted his left hand, exposing a black handgun, which he pointed
directly at P.H. P.H. clearly saw the handgun pointing directly at him from a distance of about3 feet. P.H. feared for his
life and peddled away from Johnson as fast as he could.

P.H. went to his friend's nearby apartment where he told his friend's mother, Angelica Lozano, what happened. Angelica
noted P.H. was visibly upset and crying. Angelica called 911 and notified the father of P.H. Officer Lara responded and
contacted P.H., who provided a physical description of Johnson as a tall, thin, white male in his 40's with balding hair.
P.H. also described the location of the residence where Johnson was parked, which officers determined to be 29612
22nd Av South. P.H. confirmed this was the correct location by looking on Google Maps. Officers noted that P.H.
appeared scared and had been crying, but was very articulate.

Officers searched the address in law enforcement records and found that Johnson was listed as a resident there and
matched the description provided by P.H. Officers compiled a photo montage containing Johnson's photo, and P.H.
subsequently identified the photo of Johnson as the person who pointed a gun at him.

Officers conducted a surround and call out at the residence, and Johnson exited and was arrested without incident.
When Officer Lemmon explained to Johnson that he was under arrest for pointing a firearm at somebody, he said,
"There aren't even any guns in the house. This is ridiculous". Johnson declined to make a further statement. Johnson
had an overwhelming odor of alcohol and appeared extremely intoxicated. Johnson was eventually booked into the
Score Jail by Officer Lemmon.

3 other occupants also exited the residence. They were identified as Karen Johnson (mother), Joel Johnson (brother),
and a 13 year old relative. Karen told officers that her sons had lots of guns in the house. Joel told officers that his
brother was having a tough time in life and was very angry lately.

A search warrant for the residence and vehicle was authored by Detective Adams and granted by Federal Way
Municipal Court Judge David Larson. Detective Adams and I arrived at the residence at about 0250 hours. I saw that
Corporal Wortman was maintaining security. I saw that the blue Subaru, WA/AYV2833, was parked in front of the
residence on the west side of the street. Looking through the windows of the vehicle, I could see a couple loose bullets
in the driver's door. I also saw several empty beer cans on the driver's floorboard area.

The residence was clearly marked with the house number beside the front door. Upon entering, I located Johnson's
bedroom on the bottom level in the northeast corner of the house, as evidenced by numerous documents of dominion
and control. I located a black handgun (Springfield XD-9) lying on the floor right beside the bed. The handgun had a
magazine inserted and was fully loaded with a bullet in the chamber. 2 additional handguns were located in Johnson's
bedroom. Both were in boxes and were fully loaded. A 12 gauge shotgun and an AR-15 style rifle were also located in
Johnson's room. The serial numbers returned clear and they were left on location. The handguns were seized as
