STATEMENTOFPROBABLECAUSE

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

OnoraboutDecember2,2016,atapproximately8:25p.m.,officersoftheMinnesotaStatePatrol
respondedtoareportofacarcrashthathadoccurredintheareaofInterstate494andHighway5in
HennepinCounty,Minnesota.

Uponarrival,lawenforcementfoundablue,JeepCherokeethathadbeenstruckbyatan,ChevyMalibu.
TherewereatotaloffivepeopleintheJeep.Alloftheseindividualswereeventuallyidentifiedreferredto
hereinafterasVictim1(born12/15/1965),Victim2(born11/3/1966),Victim3(born10/22/1992),Victim4
(born2/17/1998),andVictim5(9/6/2014).Thetan,ChevyMalibuwasdrivenbyPATRICKJOHNHAYES,
born5/4/1982anddefendantherein.

Whenlawenforcementarrivedatthescene,allofthevictimswereinjuredinsomemannerandonlylimited
statementswereobtained.Victim3reportedthattheyhadjustpickedupVictim4fromtheairportand
weredrivingherhome.

Victim1waspronounceddeadatthescenebytheemergencymedicalresponders.Victim2was
transportedtoHennepinCountyMedicalCenterwhereshewastreatedforherinjuries.Victim3was
transportedtotheHennepinCountyMedicalCenterwhereshediedasaresultofherinjuriesonDecember
2,2016.Victim4wastransportedtotheHennepinCountyMedicalCenterwhereshewastreatedforher
injuries.Victim5requiredCPRfromtheinitialresponders.Victim5wastransportedtotheUniversityof
MinnesotaMasonicChildrensHospital.Victim5eventuallydiedonDecember9,2016,asaresultofhis
injuries.

ThedefendantwastransportedtotheRegionsHospitalwherehewastreatedforhisinjuries.

StatePatrolwasabletoobtainvideosurveillanceofthecrash.ThedefendantsChevyisseentraveling
westboundon494.Thedefendantthenpullsovertotherightshoulderofthefreeway.Thedefendantturns
andheadseastboundeastofthe24thAvenueexit.Thedefendantcontinueseastboundinthewestbound
lanesof494.Meanwhile,thevictimsvehicleistravelingwestboundonHighway5enteringonto494.The
defendantsvehiclepassesseveralvehicles,appearstoaccelerate,andthencollideswiththevictims
vehicle.

Thefrontdriverssideofthedefendantsvehiclehitsthefrontdriverssideofthevictimsvehicle.Both
vehiclesspinaroundandstopinthewestboundlanesof494.

Surveillancevideofromtheairportshowsthevictimsloadinguptheirvehicleandenteringit.Victim1was
drivingthevehicle.Victim2wasthefrontpassenger.Victim3wasseatedintherear,driversside
passengerseat.Victim4wasseatedintherear,centerpassengerseat.Victim5wasseatedintherear,
passengerssidepassengerseat.

OfficersconductedaMirandainterviewwhilethedefendantwasstillbeingtreated.Thedefendant
indicatedthathecouldnotspeaksoofficersaskedhimyesornoquestionsandhadhimspelloutsomeof
hisanswers.Thedefendantindicatedthathewasnotunderanydoctorcareormentalhealthcareatthe
timeofthecrash.Thedefendantsaidhewaslostandthereasonhewasgoingthewrongwayonthe
freewaywasthathewasnotthinking.

Thenursetendingtothedefendantindicatedthatthedefendanthadbeenspeakingtoherearlierthatday.

OnDecember15,2016,officersspokewiththedefendantsex-wife,Witnessherein.Contrarytowhatthe
defendanthadsaid,Witnessinformedofficersthatthedefendanthasahistoryofepilepticseizuresand
wasunderdailymedicationforit.Shestatedthatthedefendantwasstillabletomovewhenhehad
seizures,buthewoulddooddthings.Witnessstatedthatatonepointthedefendantjumpedoffabalcony
duringoneofhisseizures.WitnessstatedthedefendantwasapatientatNeurologicalAssociatesforhis
condition.Witnesssaidthedefendanthadstoppedbyherresidence(inWhiteBearLake)priortothe
crashonDecember2nd,2016.Shefiguredthedefendantwouldhavetaken694to494to169inorderto
gohome.

FurtherinvestigationrevealedthatthedefendanthadbeeninvolvedintwopriorcaraccidentsinMinnesota.
OnoraboutMarch17,2015,intheareaofSavage,witnessesreportedseeingthedefendantdriving
approximately90-100milesperhour.Thedefendantwasweavingthroughtrafficwhenhecollidedwith
anothercarandrolledhisownvehicle.Thedefendantthenfledonfoot.Thewitnessesapprehendedthe
defendantandbroughthimbacktothescene.Thedefendanttoldofficersthathelostcontrolofhisvehicle.

OnoraboutAugust17,2016,thedefendantcausedaneleven-vehiclecrash.Witnessesatthescene
describethedefendantasbeingoutofitimmediatelyafterthecrashandstillmanipulatingthesteering
wheelactinglikehewasdrivingdowntheroad.

FurtherinvestigationrevealedthatthedefendantwasinvolvedinacaraccidentonoraboutAugust26,
2014,inTexas.Thecrashreportindicatesthatthedefendantwentthroughanintersectionandhitabuilding
becausehesufferedaseizurewhiledriving.

AreviewofthedefendantsMinnesotadriverslicenseapplicationsforthelastfiveyearsshowsthatthe
defendantneverindicatedthathehadaconditionthatmayimpairhisabilitytosafelyoperateamotor
vehicleorthatheusesanymedicationthatcausealossofcontrol.

OnFebruary7,2017,officersreceivedareportfromtheMinnesotaBureauofCriminalApprehension
submittedareportfromablooddrawthatwastakenfromthedefendantafterthecrash.Thereport
indicatedthattheonlycontrolledsubstanceinthedefendantssystemwasmidazolam.

Thedefendantsmedicalrecordsindicatethatthedefendantwasgivenmidazolamatthesceneofthe
December2,2016,crashashewasobservedhavingaseizure.Thedefendantsmedicalrecordsfurther
indicatethathehashadaseizuredisordersincehewassixteenyearsoldandlastsawaneurologistdays
beforethecrash.

MedicalrecordsforVictim2indicatethatshewasdischargedonDecember20,2016.Victim2suffered
numerousinjuriesasaresultofthecrash.Victim2sufferedmultiplefracturestovariousbones.Victim2
hadtobeintubatedforseveraldays.OnthedayVictim2wasdischarged,shewasstillreceivingnutrition
viaafeedingtube.

MedicalRecordsfromVictim4indicatethatshewasdischargedonDecember23,2016.Victim4
sufferedextensiveinjuriesasaresultofthecrash.Victim4sufferedmultiplefracturestovariousbones.
Victim4alsosufferedalife-threateningaorticinjuryfromwhichmostpatientsdonotsurvive.

Thedefendantisnotincustody.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest
or other lawful steps be taken to obtain Defendants appearance in court, or Defendants detention, if already in custody,
pendingfurtherproceedings.Defendantisthereforechargedwiththeabove-statedoffense(s).
