A BILL
To provide for the acquisition of lands by the United States
required for the reservoir created by the construction of
Oahe Dam on the Missouri River and for rehabilitation of
the Indians of the Standing Rock Sioux Reservation in
South Dakota and North Dakota, and for other purposes.

21 That title to all tribal, allotted, assigned, and inherited lands
22 or interests therein within the Standing Rock Reservation in
23 South Dakota'and North Dakota that are within the Taking

24 Area described in section 17 of this A is hereby taken

25 by the United States for the purposes of the Odhe Dam and

1 Reservoir project on the Missouri River in SouA Dakota:
2 Provided, That the effective date of this Act hall be the date
3 when the Secretary of the Interior shall by proclamatim
4 declare that the provisions of the Act have been accepted n
5 a three-fourths majority of the adult Indians of the Standing
6 Rock Rservation, as shown by the tribal rolls of the
7 reservation.
8 SEc. 2. The United States agrees to pay, out of funds
9 appropriated for construction of the Oahe project, as just
10 compensation for all lands and improvements and interests
11 therein conveyed pursuant to section 1 of this Act; and
12 for the bed of the Missouri River so far as it is the boundary
13 of said Standing Rock Reservation, the sum of $ ,6'8-t
14 $5,575,000; which sum shall be infinal and complete settlement
15 of all claims, rights, and demands of said tribe or allottees or
16 heirs thereof arising out of the construction of the Oahe proj-
17 ect, and shall be deposited to the credit of said tribe in the
18 Treasury of the United States, to draw interest on the
19 principal thereof at the rate of 4 per centarn per annum
20 until expended: Provided, That the sum of .7 .
21 $1,769,168 shall be distributed to the owners of the lands
22 whether individual or tribal in accordance with the tract and
23 ownership schedules prepared and submitted by Missouri River
24 Basin investigation staff with the approval of the tribal coun-
25 cil and the Secretary of the Interior. Said distribution shall

I be computed on a percentage of the amounts shown for
2 each tract and ownership by Missouri River Basin investi-
3 gation A& star: Provided further, That one-half the bal-
4 ane of said .um shall be consolidated with the appropria-
5 tions made pursuant to section 5 of this Act and hall be
6 ej-pended in accordance with the provisions of such section
7 5, and that no part of the remaining one-half of such funds
8 shall be used for per capita payments.
9 SEC. 3. The United States further agrees to appropriate,
10 and the Secretary of the Army is authorized and directed to
11 make available from sums so appropriated to be charged
12 against the cost of construction on the Oahe project, and not
13 from fwids provided from this Act, further additional appro-
14 priations for the special purposes of relocating and reestab-
15 lishing the Indian cemeteries, tribal monuments and shrines
16 within the taking area for said reservoir described in pa$
17 14 section 17 of this Act as the tribal council of said Indian
18 tribe shall select and designate, which sums shall be ex-
19 pended on the recommendation of the tribal council with
20 the approval of the Secretary of the Interior.
21 So. 4. The United States further agrees to appropriate,
22 and the Secretary of the Army is authorized and directed to
23 make available from sums so appropriated to be charged
24 against the cost of construction of the Oab0 project, further
25 additional appropriations which shall be expended for the

I relocation and reconstruction of all eaentidaegency facilities,
2 schools, hospitals, service buildings, agents and employees'
3 quarters, roads, bridges, and incidental matters or facilities
4 in connection therewith, the use of which may be impaired
5 by. the construction of Oahe Reservoir on Standing Rock

7 SC. 6. The United States agrees that all oal, oil, gas,

8 ore and mineral rights of whatsoever nature and including

9 all other elements of commercial value (other than agricul-
10 tural) at or below the surface within the taking area as
11 described in psii4 4 section 17 hereof shall be and hereby are
12 reserved to said Indian tribe or individual owners or holders
13 of lands or interests in lands as their interests may appear
14 under section 1 hereof, subject to future extraction and use
15 by said tribe or said members thereof or their heirs, suc-
16 cessors, or assigns, but also subject to all reasonable regula-
17 tions which may be imposed by the Chief of Engineers,
18 United States Army, for the protection and use by the

19 United States of the taking area for the purposes of the Oahe

3 8w. 7. The members of the said Indian tribe shall have
4 the right without charge to cut and remove all timber and to
5 salvage any portion of the improvements within said taking
6 area either by demolition or removal, and the owners of
7 the land whereon said improvements stand shall have a prior
8 right to such salvage but if said right is waived or not exer-
9 cised within nine months from and after the effective date of

12 shall have the right to designate others to demolish or re-
13 move said timber, structures, and improvements or in the
14 discretion of the tribal council, said demolition or removal
15 may be undertaken and carried out by said tribal council:
16 Provided, That the salvage permitted by this section shall
17 not be construed to be double compensation.
18 SWC. 8. The United States and the Indian parties to this
19 agreement recognize that a hazard to livestock is created
20 by the rise and fall of the waters to be impounded in Oahe
21 Reservoir. They also recognize that said hazard is not sub-
22 ject to exact determination at this time, therefore the par-
23 ties to this agreement agree that all hazards which may do-
24 velop when the annual rise and fall of Oa4e Reservoir can
 ~9.

1 reasonably be determined shall be met by the United States

2 by such protective measures as may be necessary to minimize
8 losses to the Indian parties hereto as to livestock only.
4 Swo. 9. Members of said Indian tribe now residing with-
5 in the taking area of the project shall have the right without
6 charge to remain on and use the lands hereby conveyed as
7 said lands are now being used from and after' the effective
8 date of this Act to the point in time where the gates
9 of Oahe Dam are to be closed for the impoundment of the
10 water of the Missouri River.
.11 All individuals and personal property shall be removed
12 from the taking area before the i; Of the t4fteP110-

14 shall not be liable for any loss of life and property not so
15 removed from the taking area from and after the expiration
16 of. said time.
17 Swc. 10. (a) Except as provided in subsection (b),
18 the schedule under which the tribe, and the members there-
19 of, shall vacate the taking area shall be as follows:
20 (1) Little Eagle and Wakpala districts, within twelve
21 months from the date of acceptance of the provisions of this
22 Act by the tribe under the first section of this Act;
23 (2) Kenel district, within eighteen months from such
24 dates;

(3) Agency district, within twenty-four months from
2 such dates; and
3 (4) Cannonball district, within thirty months from such
4 date.
5 (b) The Chief of Engineers, subject to approval by
6 the Secretary of the Interior at 4 4we -T ewt may
7 make such changes in the schedule provided in subsection
8 (a) of this section as he deems necessary, except that in
9 any event, all lands within the taking area shall be vacated
10 within six months after the date on which the Missouri River
11 is diverted through the tunnels at the Ophe Dam.
12 SEC. 11. After the Oahe Dam gates are closed and the
13 waters of the Missouri River impounded, the said Indian

20 f4wi there shall have the right to friaze stock on the land
21 between the water level of the reservoir and the Taking Area
22 described in section 17. The satd Tribal Council and the
23 members of said Indian tribe shall have without cost the right
24 of free access to the shoreline of the reservoir, including the
2P right to hunt and fish in and on the aforesaid shoreline and

1 reservoir, subject, however, to regulations governing the cor-
2 respoidinguse by other citizens of the United States.
3 SEQ. 12. The United States, through the Department
4 of the Interior, shall render all aid and assistance to individ-

5 ual members of said tribe whose lands are within the taking
6 area for the purposes of purchasing lm4 i t6eniie of4w

13 the title to which shall be taken in the name of the United
14 States in trust for such individual, exce4%t as otherwise pro-
15 vided in this section. Any such trust may be terminated
16 when in the judgment of the Secretary of the Interior the

17 Indian beneficiary is no longer in need of special assitance

18 in handling his affairs. The holders of exchange assign-
19 ments within the said taking area shall be regarded as holders
20 of trust patents and shall be accorded the same p privileges

21 and procedures as holders of land held in trust as in this

22 section provided.

23 The funds for the purchase of such substitute land in all

24 oases shall be provided by the individual applying for such

25 purchase a4 mfeoiveyeafee as is herein deset'ed out tf

1 moneys placed to his credit for the transfer of his lands, im-
2 provements, and timber under the authority of this agree-
3 ment but no service charge shall be made by the United
4 ,States in addition to the cost of the substitute allotment.
5 The lands so selected and purchased as substitute allot-
6 ments may be either within the boundaries of the Standing
7 Rock Reservation as diiniished by this agreement or out-
8 side said reservation as may meet the desires of the individ-

16 any lands so purchased that are outside and not adjacent to
17 the Standing Rock Reservation shall be taken in th name
18 of the Indian purchaser: Providd further, That for the
19 purpose of this section tribally owned land may be sold to
20 and purchased by or for individual members whose lands are
21 within the Taking Area.

3 Sc. 44 13. No part of any expenditure made by the

4 United StAtes under any or all of. the provisions of this agree-
5 ment and the subsequent acts of ratification shall be charged
6 as an offset or counterclaim against any tribal claim which
7 has arisen under any treaty, law, or Executive oider of the
8 United States prior to the effective date of taking of said land
9 as provided for in section 1 hereof and the payment of Sioux
10 benefits as provided for in section 17 of the said Act of
11 March 2, 1889 (25 Stat. 888), as amended, shall be con-
12 tinted under the provision of section 14 of the Indian Reor-
13 ganization Act of June 18, 1934 (48 Stat. 984), on the basis
14 now in operation without regard to the loss of tribal land
15 within the taking area under the provisions of this agreement.
16 SEC. 46 14. The United States agrees to reimburse the
17 said tribal council for expenses incurred by it and caused by,
18 or incident to, the negotiations which have led up to the
19 making and ratification of this agreement: Provided, That
20 such reimbursable expenses do not exceed in the aggregate
21 $100,000, of which not more than $50,000 shall he reim-
22 bursable as attorney fees under the terms of contract ap-
23 proved by the Secretary of the Interior. The tribal council
24 shall send a statement to the Secretary of the Army setting
25 out said expenses up to' the date of the proclamation to be

1 issued by the Secretary of the Interior declaring that the Act
2 of Congress approving this agreement is in full force aid
3 effect. The Secretary of the Army shall forward said state-
4 ment to the Congress for appropriation together with his
5 recommendation.
6 SEC. 4-6 15. The right of any individual member of said
7 Indian tribe to reject the final appraisal made on his land
8 and improvements shall be preserved and, if any individual
9 does reject such final appraisal, he shall file notice of such
10 rejection by notice in writing to the Chief of Engineers,
11 United States Army, who shall thereupon file a.proceeding
12 in the United States District Court of the District of South
13 Dakota or North Dakota as in a condemnation proceeding and
14 jurisdiction is hereby conferred upon said court to determine,
15 by procedure corresponding to a condemnation proceeding,
16 the value of said land and improvements and the said tribal
17 council shall deposit with the clerk of said court, the full
18 amount set out in the final appraisal which was previously
19 offered to said individual, which fund shall be used in pay-
20 ment in full or in part of the final judgment of said United
21 States district court. Cost of such proceedings shall be borne
22 by the United States and the individual involved shall be
23 entitled to counsel at his own expense. In the event the
24 amount of the -appraisal so deposited in said court is not
25 enough to cover the final judgment in said proceedings, the

1 United Stetes shall pay such difference from funds appro-
2 priated for Oahe project into the bands of the clerk of said

5 SEC. 4-7 16. There is hereby authorized to be appro-
6 priated not to exceed A' 6)' $14,075,000 as provided
7 by sections 2, 5, and 44 14, exclusive of the surns to be
8 charged against the cost of cmstruiction of the Oahe project
9 as provided in sections . ftH4 4 3, 4, and 15 hereof.
