PROCEDURE FOR REGISTRATION OF COPYRIGHT

Step 1 The first step involved in the registration of a copyright is filing of an


application before the copyright office. The application has to be filed in form XIV
accompanied by the prescribed fees. The following documents must be attached
with the application: -

Name, address and nationality of the applicant


Name, address and nationality of the author of the work
Nature of applicants interest in the copyright i.e. OWNER / LICENSEE
etc.
Title of the work
A declaration signed by the author (if different from the applicant)
Language of the work
Whether the work is published or unpublished
If the work is published, year and country of first publication and name,
address and nationality of the publisher
Year and countries of subsequent publications, if any
Name, address and nationality of any other person authorized to
assign or license the rights in the copyright
Power of attorney for the firm
Six hard copies of the work and three soft copies

Step 2 After the application for copyright with complete details and copies, the
applicant has to wait for a mandatory period of 30 days for any objections that
may be filed in the copyright office against the claim that the concerned work
is created by the applicant. If any objection is filed, it may take some more
time to decide as to whether registrar of copyrights could register the work
after giving reasonable opportunity to be heard to both the parties.

If no objection is filed within the waiting period than the examiner will
scrutinize the application for any discrepancies. In case any discrepancies are
found notice will be sent to the applicant to which the applicant must reply
within 30 days. Thereafter the examiner will fix a date for hearing the matter
wherein additional documents may be sort from the applicant for removing the
discrepancies. After all the objection has been satisfied the copyright is
registered and a certificate is issued.
