Eligibility Criteria for perticipatiog Consultancy Firm:
(i) The applicant should be a frm or legal entity registered under Companies Act, Societies Act or any other law and
should have been in operations in lndia for at least 3 years with the prooF of incorporation / commencement of
business (please anach copy of rcgisu-dtion cenificate).
(ii) The Firm should have been working in the field of Consulrancy for Urban Planning or Regional Planning for
minimum J years ending on 3lst March 201? (please attach copy of *,ork orders and or completion cenillcate
received during last 3 years)
I The Applicant Firm(s) should possss a valid ISO 9001:2008 certification .
(iii
(iv) Avenge annual tumover of the Consuttancl Firm based on any three ofthe last five financial years ending on Date

(v) The Consulrancy Firm should have successfully prepared GIS Based Master Plan ofat least 3 Towns. Bidder should

(vi) 1he Bidder should not be under a declaration of incligibiliry for corrupt and fraudulent practices or any other reason.

I lntroduction
The Urban Development and Housing Departnent (UDHD), Govemment ofBihar wishes to appoint
Consulting Agencies for the preparation of GIS Based Master Plans for 14 Towns (that include 13
AMRLIT Towns) of the state. The towns are as follows -

2 Objective
The main objective of the assignment is to prcparc GIS Based Ma.*er Plan of the towns that will form
the basis of planned development of the town. The Consultant shall utilize existing land use and
provided GIS based Base-Maps of respective ULBs wilh Cadastml maps (Different thematic layer
details with indicative *tribute field mentioned in Annexurc-I) in GIS environmenl The Consultant
will procure required data as prescribed in Bihar Urban Planning and Development (BIIPD) Ac! 2012
read with BIJPD Rule 2014, data may be coltected from primary and socondary sourcs if required .
The details of town wise GIS Base Map availability and xtent of Planning Areas is given in
Annsure-Il. The selected Consultans will procure data from LID&HD and the UDHD and planning
Authority shall issue a necessary letter for ttre concemed department to ease Procurmert.
The Consultant will submit a meaningful Development Plan to promote regulate and guide urban
growth for each town. The Master Plan shall be prcpared for the period of20 years.
The major components ofthe assig nent are:
Formuletion of Mrstr Phni Bihar Urban Planning and Development (BUPD) Act,2012 empowers
the StateofBiharto prEpsre Development Plans for promotion ofplanned growth and development of
urban areas and such areas having potential of urbanization and regulation of land uses vithin the
notified areas. The Master Plan will include demand assessment, identification of issues, projested

rcquirements, development skateg/ and draff proposals on the GIS base map and sector-wise dala
analysis, to be done by the Consultant. Following activities are expctd from the consultant during the
incepion period:-
(i) Sp.tirl Attribute Collection & Vetting of Bas Mrps: The UDI{D will provide rhe GIS
Base Map of the lowns - these maps have bcen prepared using high rsolution satellite data
and detailed field survey of areas rmder jurisdistion of ULB . The Consullant will updare the
GIS Base Map and the spatial ataibutes as per AMRUT Design & Standards guidelines. The
updated final base maps will be used as an input for preparation ofthe Master Plan. The maps
with the departsnent arc available only for the IJLB limis of the towns. The consultant shall
prcpare the GIS based base maps fs1 remnining areas outside the ULB limit and within the
planning arca which are not available with the Depattneflt.
(ii) Urban Datsbrsc Creation: Sector-wise data collection and data analysis report of socio
economic and physical aspects is to be done by the ConsultanL The daails of differcnt
thcrnatic layen are pmvided in Annexure l. The Consultant will submit the pro-forma for data
collectioo to UDHD for necessary modificationVamendment as requircd. In addition, primary
surveys such as landuse survey, traftic &transport survey, household surveys, etc. are required
to be undertaken as required under the BLJPD act 20 I 2 and Rule 20 I 4
(iii)Seminar & Workshop: The Consultant will organize workshops and seminars involving
various stakeholderq local bodies, officials for taking feedback and views during the
preporation of $e Master Plan for a town and document ail proceedings. The cost of such
meetings will be bome by the Consultant. The workhops will be organized at the fime of
pmject initiation, after submission of data analysis report, beforc finalization of draft Foposals
and after submission of draft Master Plan. All the feedback and suggestions arc to b
incorporated in the draft Master Plan proposals as appropriate.
3 Scope of Work
The selected Consultam is expected to provide techdcal and management support for design and
implernentation of GIS Based Master Plan. The various stages ofthe assignment are as follows:

The selected consultant will first collect data fiom the concemed ULBs as well as UDHD and also
undertake sakeholder discussions on development issues. The highlights of the discussions will
be shared with the UDHD tkough a brief presentafion followed by submission of Town-wise
Inception Reports that discuss the development issues, strategies, methodolory and approach for
Master Plan preparation.
Following approval from the concerned ULB and the UDHD, the Consultant will geneftfie and or
updale the Base Map for Master Pla! preparation. All the relevant layers ofGIS Base Map shall be
updated by the Consultant through field survey and as per requiremant for deliverables.

bodies, ofEcials for taking feedback and views during the preparation of the Master Plan for a
\, torYn and document all proceedings. The cost of such metings will be bome by the Consultant.
The workshops will be organised at the time of project initiation, before finalisation of draft
proposals and submission of draft proposal. All the Hback and suggestions are to be
incorporated in the draft Maser Plan proposals as appropriate.
V. ContDts of Master Plan: The Master Plan shall contain the following as per the Biha Urban
Plarming and Development (BUPD) Rules, 2014:

social forestry), urban agriculture and wasteland

Note:
i. The consultancy charges for performance of the services under the conract shall be paid by
the client in terms of percentage of the total project cost (as quoted by the sucressful
Cotrsultant).
ii. The client shall pay the consultant, the Tax, on prevailing rates as applicable on the
consultancy charges on the date of submission of invoice.
iii. lt is expected that the Consultant has quoted price taking into consideration all requircments
for satisfactory performance of the sewices included in ToR If the consultant has not
considered any component for performance ofthe services, no exm payment shall be made on
this account.
iv. processing time is the time between submission ofthe stage report and issue of the minutes for
approvav modification of the same and would be about 30 days. The period between the
submission of stage report and its processing would not be includd in the period of
assignment.
v. The total period for completion for the above assignment shall not exceed 24 months. The
State Government may change the duration oftime allotted for various stages as per size ofthe
city.
The Consultant will be required to make a presentation befors the Consultancy Evrluetion & Review
committee (CERC) within a week of submission of each of the above repofis. Moreover, he will also
present the Draft Master Plan before the Authority,/Department and stakeholders wherever required.
The observationv suggestions of GERC will be incorporated in the next suge of subrnission. The
period baween the submission of Draft proposals and direction given to prepare Draft Master plan
would not be included in the period ofassignment for remuneration purposes.
The payment will become due on approval ofthe stage reports and on raising of bills/ invoice by the
consultant after the approval of the stage report. The processing time of the
layment will be 60 days
for final payment and 30 days for all other payments.
The consultant's work will be monilorcd and rcviewed by the concemed planning Authority and
consultancy Evaluation and Review commitree (CERC), which will be constiiured u/n" oepari-eni
under the AMRUT Mission guidelines.
The consultants shall submit each of the above-mentioned deliverables as per the schedule
mentioned
above to the Authority/Departnent- This will be followed by a presentation to the CERC within
a
week, wherein, the GERC members sha.ll give their and suggestions in the form of

feedback Subsequently, the consulta* will incorporate all such comments and suggestions in their
next stage rcport.
The Board may suggest some modifications on the draft plan as per the Rule 3l (sec-tion 25 of the Act)
of the BIIPD Rules, 2014 and accordingly the consultant shali make tiose changes. The Consgltani
then submit the Master/Development Plan to the concemed Authority(s)/ Departrrent.
After such modifications, the Draft Master/Development plan shall be submitted before the BLJPD
Board. Upon approval by the BUPD Board, it shall be submitted to the Stare Goverunent.
After approval ofthe Mastr Plan the consultant will provide support for one year from the date of
approval. workshops, discussions and prcsentations may also be made by the consultant to various
agancieV departnents within sush period. The perfomrance guarantee shall only be released after
complaion ofone year pnst approval consultation and support by the consultant.
Generel
i) The d*ails about the me{hodolos/ and data outputs in rcspect of consultancy should be worked out
in the bid offer by the consulting firm.
ii) All a,q collected by the consultant shall be made available to the client in propo organized
format and this data shall remain the property ofthe Client.
iii)The data collected and the research results of the consultanry shall not be divulged to other
agencies without the explicit approval ofthe Client
iv) Monthly Progress Repon will be submitted by the consultant to review the progress ofthe study.

Introduction
I.l UD & HD, Govemment of Bihar, henceforth refened as Client will select Consultants for
carrying out the assignment on Gls-based Master Plan Formulation for 14 Torvns ofBihar.
1.2 lnterested c.nsulting firmVJoint Venturc (JV) may submit proposals for any no. oftowns but
the selected consultants shall be given to prepare Master Plans for maximum 3 (three) towns.
1.3 Separate proposals are to be submitted for each town with seFrae technical and financial
bids.
1.4 Pmposals should be submitted in English.
2. Method of selection
2.1 Selection will be done on basis of 3-stage process. In the lr

information submitted by inrcrestod Consultants in prescribed format will be evatuated, Only
those who meet the. pre-qualification criteria will quali$ lu stage and will be considered for
2* stage. In the 2- stage, Technical Proposals will be opened and evaluared and Technical
scorcs will be given. In dre third stage, Financial Proposals of those Consultants who have
achieved technical score of 807o and above will be opened. The Consultant with the Ll bid
will b called for further discussions to sign a Contract Agement Based on the Financial
proposal, townwise Lt shall be decided,
2.2 Intercsted consulting firms arc requested to submit three-stage documents in sparde seald
covers:
a) Pr+Qualification
b) Technical Proposal
c) Financial Proposal
2-3 Consultants must submit an original and two additional copies of prc-qualificatiorq Technical
Proposal and Financial Proposal alongwith soft copy.
2.4 The proposals must be accompanied with a non-rcfundable p(rceslring fee of Rs, S(M/-
(Rupees Five Thousand- only) in lhe form of a burk draft drawn in favour of DIRECTOR-

2.8 Proposals must b submitted not later than the following dare and time: Dster 22.092017

2.9 Proposals must remain valid 90 days affer the submission date until validity erended by the
Consultant. During this penod the consultant is expected to keep available the key
professional staff proposed for the assignment. The client will make the best effort to complete
the tendering process within this period, If the client wishes to extetrd the validity period of
the pmposals, the Consultants may do so and those who do not agree have the right not to
extend the validity of their proposals.
3, Pre-Bid Conference
3.1 A prebid conference will be held on 14.09.20'17 at ll:00 AM al Room No. 126, in the
Confermce Hall, Urban Development and Housing Departsnenr, GoYemmnt of Bihar, Vikas
Bhawan- 800015. Consultants are encouraged to attend the conference before submitting their
proposals.
3.2 Consultants may request a clarification of any of the RFP documents up to ten (t0) days prior
to the Proposal submission date indicated in the RFP. Any queries made by the consultants for
clarification shall be entertained in the prc-bid meeting on the date as mentioned in the RFP. If
the Client feels necessary to amend the RFP as a result of a clarificatioq it shall do so
following the procedure under Sub-Clause 4.
4. At any time before the submission of Proposals, the Client may, whether at its own initiative,
or in respons to a clarification requested by a firm, amend the RFP by issuing an addendum.
The addendum shall be sent to all Consultants and will be binding on them. To give
Consultants reasonable time in which to take an amendment into account in their Proposals,
the Client may at its discretion, if the amendment is substantial, extend the deadline for the
RFP submission.
5. The costs of preparing the proposal, including visit to the Client, etc., are to be bome by the
Consultant.
6. Awarding the consultancy will be in accordance with policies of Govemment of Bihar State,
including policies on corrupt and fraudulent practices.

Interested Consultants shall submit information in the prescribed PreQualification provided in
Section 3(9.1) and Section 4 of this document. Only those Consultants whose responses are
found sarisfacory will be considercd for evaluation ofTechnical Proposal.
Technical Proposal
1' In preparing the Technical Proposal, consulting firms are expecled to examine the dosuments
comprising this RFP in detail. Material deficiencies in providing the information rqusted
may result in rejection ofa Proposal.
7.3 The Technical Proposal should provide information using the Standard Forms provided in
Section 5 ofthis document only, failing which the proposal may summarily be rejected.
7.4 The Technical Proposal shall not include any financial information.
Financial Proposrl
7.5 The Financial Proposal should be submitted in Standard Forms provided in Section 6 of this
document only.
7.6 The proposal should be complete, i.e., it should list all costs associaed with the Assignment.
7.7 The Financial Proposal should clearly identi$ for applicable taxes.
8.1 The original Proposal (including Prequalification, Technical Proposal and Financial Proposal)
shall be preparcd in indelible ink. Any correqtions must be initialed by the person or pesons
who sign(s) the Proposals.
Atr authorized represertdive ofthe consulting firm shall initial all pages ofthe Proposal. The
rcpresentative's authorization is confirmed by a wdtten power of atomey accompanying the
Proporul.
The original and all copies ofthe Pre-Qualification shall be placed in a sealed envelope clearly
marked "PreQualifi cation".
8.4 Technical Proposal, including original and all copies shall be placed a sealed avelope h
cleady marked -Technical Proposal," and the original and all copies ofthe Finmcial Pmposal
in a sealed envelope clearly marked "Financial Proposal" and waming: "Do Not Open with
the Technicrl PropcsaL" Technical and Financial envelopes shall be placed into an outer
envelope and sealed. This outer envlope shall bear the title *Technicsl and Financial
Proposal". This envelope along with Pr-QualiEcation envelope will be placed in anotho
envelopq sealed and cleady showing the name ofthe assignment, the submission addresg and
town for which the proposal is submitted-
Proqualification, Techaical Proposal & Financial Proposal should be separale for each towns.
AII the financial proposals meant for sepaftfe tovns should be placed in one envelope sealed
and marked Financial proposal.
The completed Pre-qualification, Technical and Financial Proposal must be delivered at the
submission address on or before the time and date specified. Any Proposal received after the
closing time for submission of pmposals shall be retumed unopened.
8.6 After the deadline for submission of proposals the Prequalificalion envelope shall be opened
immediately by a Committee constituted for this purpose. If the Committee desires, the short-
listed consultants may be called for power-point presentation. The information will be

evalualed. The Technical Proposal of only the qualiSing Consultstrts will be opened after
evaluation process. The Financial Proposal shall remain sealed until t chnical capability
statement of all submitted proposals is prepared urd consultants short-listed. The consultant's
reprcsentative rnay opt to be present during the financial bid opening. The date will be
conveyed by the consultant to the client in advance.
9. Proposel Evaluation
General
9.1 From the time the bids are opened to the time the contract is awarde4 if any consultant wishes
to contact the Client on any matter related to is proposal, it should do so in writing the *
address indicated. Any effort by the frnn to influence the Client in the Clienl's proposal
evaluation, proposal comparison or contract award decisions may result in the rejection of the
consultant's proposal.
Prc-Qualitrcetion Norms
The Committee as a whole will evaluate the Pre{ualification Forms on the basis of their
audited tumovo, experience, projects executd project experience, qualification and
experience ofkey personnel, applying the evaluation criteria specified.

lowest bids for those towns shall determine the allocation of towns to a particular consultant.

IL GENERAL CONDMONS OF CONTRACT
I. GENERAL PROVISIONS
l.l Definitions
Unless the context othrwise rcquirs, the following tf,rns whenBver used in this Contract have the
following meanings:
(a) 'Applicable Law' means the laws and any other instrunents having the force oflaw in lndia
(b) "Contracl" means the ract signed by the Parties, to which thse Gmeral Conditions of
Co
Contract (GC) arc attacheq together with all the documents listed in Clause I of such signed
Contract;
(c) 'tontract Pdoe" means the price to be paid for the performance ofthe Serviccs, in accordance
with Clause 6;
(d) "Member", in case the Consultants consist of a Joint ventun{Jy) of more than one entity,
means any of these entities, and 'Members' means all of these entitiesi "Member in Charge"
means the cntity specified in the SC to act oo their behalf in exercising all the ConsultanB'
right and obligations towards the Client under this Contnct;
(e) "Party" means the Client or the Consultants, as the case may be, and Parties means both of
them;
G) "SC" means the Special Conditions of Contract by which these General Conditions of
Con&act may be amnded or supplernented;
(D 'Subconsultant' means any entity to which the Consultants subcontract any pafi ofthe
Services in accordance with the provisions ofClauses 3.5 and 4.
This Contract, is meaning and interpretation, and the rclation betwecn the Parties shall be govemed
by the law of contract suppleme'med by general conditions and special conditions annexed to this
contract.

Any action required or permitted to be taken, and any document required or pemritted to be executed,
under this Contract by the Client or the Consultants may be taken or executed by the officials
specified in the SC.
Unless otherwise specified in the SC, the Consultans, Sub.consultants and their Personnel shall pay
such taxes, duties, fees and other impositions as may be levied under the Applicable Law, the amount
ofwhich is deerned to have been included in the Contrac Price.
2. COMMENCEMENT,COMPLETION,MODIFICATIONAND TERMINATION
OFCONTRACT
2.1 Efiectiven$sofcontract
This Contract shall come into effect on rhe date the Contract is signed by both Parties.
The Consultants shall begin carrying out the Servics after the date the Contract becomes e{fective.

Unless teminated earlier pu$uant to Clause 2.6, this Contract shall terminate with completion of the
consultancy in terms ofconditions ofthis agreernent to the full satisfaction ofthe Client
2.4 Modification
Modification of the terms and conditions ofthis Contract, including any modification ofthe scope of
the Services or of the Contract Pricg may only be made by written agreement Hween the Panis.
For the purpose of this contraa "Force Majeure" means any event or cilcumstance or combination of
events or chcumstances beyond the reasonable control ofeither Pafty including:
Aly period within which a Party shatl, pursuant to this contract, complete any action or task shall be
extended for a period equal to the time during which such Party was unable to perform such ac-tion as
a rsult of Force Majeure.
2.5.4 Payments
During the period oftheir inability to perform the Services as a result ofan event ofForce Majeure, no
additioral payment will be given however a time extension in the project may be gven.
2,6 Termination
The Client may terminate lhis Contract, by not less than thirty (30) days' written notice oftermination
to the consultants, to be given after the occurrence of any ofthe evens specified in paragraphs (a)

through (d) ofthis Clause 2.6.1 and sixty (60) days' in the case ofthe event referred to in (e):
e) ifthe Consultants do not perform their obligations under this Contrac! within thirty (30)
days ofreceipt after being notilied
(c) if, as the rsult of Force Majeue, the Consulams are unable to perform a material
portion ofthe Servics for a period ofnot less than sixty (60) days; or
(d) if the consultant, in the judgrnent of the client has engaged in corrupt or fraldulent
practices in competing for or in executing the Contract.
(e) ifthe clienq in its sole discretion and for any reason whatsoever, decides to terminate this
Contract.

(a) ifthe Client fails to pay any money due to the Consultants puNuant to this Contmct and
not subjct ro dispute pursuant to Clause 7 hereof within forty-five (45) days after leclYrng
vritten notice from the Consultants that such payment is overdue; or
(b) if, as the result of Force Majeure, the Consultants are unable to perform a material
portion ofthe Services for a period ofnot less than sixty (60) days.
upon termination of this contract pursuant to clauses 2.6.1 or 2.6.2, the clienr shall make the
following payments to the Consultants:
(a) remunerartion pursuant to clause 6 for Services satisfadorily performed prior to the
effective date of termination;
(b) except in the case of rermination pursuant to paragraphs (a) and (b) of Clause 2.6.1,
reimbunanent ofany reasonable cost incident to the prompt and orderly trmination of
the Contract.
ln case of delay in the conduct of consultancy servics within the time fixed or in the event of
rcpudiation of the contact, the Client reserves the right to recover damage for Breach of contract as
indicated below:
3.1 General
The Consultants shall perform the Services and carry out their obligations hereunder with all due
diligence, efficiency and economy, in accordance with generally accepted professional techniques and
practices' and shall observe sound management practices, and employ appropriate advanced
tchnolory and safe methods. The consultants shall always act, in respect of any matter rclating to
this contrast or to the Services, as faithful advisers to the client, and lhall at
safeguard the client's legitimate interests in any dealings with SuLconsultans or "[

3.2 Conflictoflntersts
The remuneration of the Consulants pursuant to Clalse 6 shall constitute the Consultants' sole
remuneration in connection with this Contract or the Services, and the Consultana shall not accept for
their own benefit any trade commission, discount or similar payment in connection with activities
pursuant to this Contact or to the Services or in the dissharge oftheir obligations rmder the Contract,

3.22 Consultants and Allilirtes not to be Otherrvise Interested in project

3.23 ProhibitionofconflictingActivities

(a) during the term of this Contract, any business or professional activities which would
conJlict with the activities assigned to thern under this Contract; or
(b) after the termination ofthis conaad, such other activities as may be specified in the sc.
33 Conlidentirlity
The consultants, their Sub-consultants, and the personnel ofeither ofthem shall not, either
during the
terl or within two (2) yea$ after the expiration of this contract, discrose any proprieta{ or
confidenfial informarion relating to the project, the Services, this contract, or the client,s |usineis
or
operations without the prior *ritten consenr ofthe Client.
The consultants (a) shall take out and maintain, and shall cause any sub-ronsuttants to
take out and
maintain, at their (or the sub-consultants', as the case may be) owncost but on terms and conditions
approved by the clien! insurance against the risks, and for the coveragg as shall be specified

The consultants shall obtain the client's prior appmval in writing before taking any of the following
actions:

(c) any other action that may be specified in the SC.
3.6 ReportingObligations
The comulans shall submit to the client the reports and documenB specified in Appendix B in the
form, in the numbers, and within the periods se{ f;rth in the said Appendix.

4. CONSULTANTS' PERSOIINEL
4.1 DescriptionofPersonnel
The tittes, agreed jot descriptions, minimum qualifications and estimared periods of engagement in
the carrying out of the Services of the consultants'Key personnel are described in Afr-dix c. The
Key Personnel ald sub.cotrsultants tisted by title as well as by name in eppendix c are hereby
approved by the Client.
(a) No chmges shall be made in the Key personnel. In case it becomes incumbent to change any
one of key penonnel,the Consultants shall forthwith provide as a replacement a person of equi-valent
or better qualificatiors with approval ofthe Client.
O) Ifhe Client finds that any ofthe Personnel have (i) committed serious misconduct or has been
charged with having committed a criminal action, or (ii) have reasonable cause to be dissatislied with
the performance of any of the Personnel, then the Consultants shall, at the Client's written request
speciffing the grounds thereof, forthwith provide as a replacement a person with qualifications and
experience acceptable to the Client.
(c) The Consultants shall have no claim for additional cosB arising out of or incidenral to any
removal and/or replacement of Personnel.
The Client shall use its best efforts to ensure that the Govsrnment shall pmvide the ConsultanB such
assistatrc and data as specified in the SC.
If, after the date ofthis contract, there is any change in the Applicable Law with respect to taxes and
duties which increases or decrqses the cost of services rendered by the consultants. then the
remuneration and reimbunable expenses otherwise payable to the Consultants under this Contact
shall be increased or decreased accordingly and corresponding adjustments shall be made to the
ceiling amormts refened to in Clause 6.2.
The Client shall make available to the Consultants the Services and Facilities listed under Appelrdix E.
The consultant's total rernuneration shall not exceed the conEact price and shall be a fixed lump sum
including all staffcosts, sub-consultants' costs, printing, communications, travel, accommodatioq and
the likg and all other costs incurred by the consultant in carrying out the services described in
Appendix A. Excspt as provided in crause 5.2, the contract pdce may only be increased above the
amounts stated in clause 6.2 if the parties have agreed to additional payments in accordance with
Clause 2-4.
