WHY IS LAW NECESSARY IN A SOCIETY??

INTRODUCTION
A society can thrive only if its constituents co-exist peacefully.
Our society comprises distinct entities having different ambitions.
Differences and disputes arise when such pursuits clash. This is where law comes into the
picture.

Law at a very minimalistic level is nothing but a facilitator. It helps facilitate smooth
functioning of our civilization with an aim of ensuring social harmony.

NO LAW ??
In the absence of law there would be an incessant struggle for power, authority and
supremacy

Our inherently selfish nature would force us into a situation of absolute anarchy where only
greed would dictate action and chaos would rule supreme

Intrinsically laws are anti-dotes for a disease called conflict which is an inevitable occurrence
in our society.

Conflicts can occur between individuals, between an individual and an ideology or between
two ideologies.

THE ESSENCE OF LAW

Law questions the very nature of the human spirit. It demarcates the boundaries within which
we must limit our activities.

But law should not be seen as a system that constricts but a system that conducts and co-
ordinates activity so that people achieve their goals without encroaching upon the rights of
others.

It acts as a touchstone for us so that we can form a perception about what is right and what is
wrong

WHAT DO WE WANT??
While social harmony is what law strives for, it can only be ensured when laws are in
consonance with the societal trends.

What is acceptable in a society is not determined by what the law says but by what the
constituents concur with.
For example: With the advent of computers, there arose a need for a new branch of law to
govern the usage of information technology. This need was catered to by Cyber Laws.
LAW IS DYNAMIC IN NATURE
It changes and adapts to serve the people in the best possible manner.
For instance, Uruguay legalized same sex marriage in 2013, keeping up with the rise in
numbers of the LGBT community.
This goes to show that law isnt static. Its transformation is directly proportional to the
developments in a society.
SCOPE OF LAW
Law knows no boundaries.

It may be formulated to deal with something as rudimentary as a contract of bailment or to

act as an invisible bridge between nations, reflecting the complex inter-relationships that exist
within a globalized world.

Today, everything that has value, whether physical or social, comes under the purview of
law.
The human mind is extremely capricious.

It wouldnt be wrong to say that it isnt man who proposed law; it was the complexity of
mankind which necessitated its birth.

And so it might seem like a distinct possibility, complete harmony would be achieved only
when the society becomes lawful in its truest sense.
With law we realize the periphery within which we must act.
It gives direction to our thought processes
