A.P. Labour Welfare Board

Constituted under A.P. Labour Welfare Fund Act, 1987 (Act No.34 of 1987) for the State of
Andhra Pradesh for administering the A.P. Labour Welfare Fund and carry out other functions
specified under the Act.
Corporate body having perpetual succession and a common seal with a power to acquire hold
and a common seal with a power to acquire hold and dispose of movable and immovable
property.

Objectives

The Andhra Pradesh labour Welfare Fund Act, 1987 was enacted for constitution of Labour
Welfare Fund for financing the activities to promote welfare of Labour in the state and
establishing of a Board for the purpose of administering the Fund and to carry on such other
functions as are assigned to the Labour welfare Board from time to time.

Functions of the Board:

Receiving contributions and other amounts and accounting for the Welfare Fund.
Implementation if various Welfare Schemes for the benefit of the Welfare Fund Contributors in
the State.

A.P. Labour Welfare Board - Members

Ex-officio Member: Principal Secretary to Government, Labour Employment, Factories and Training

Ex-officio Member: Secretary to Government, Finance and Planning (Fin. Wing)

Ex-officio Member: Secretary to Government, Industries and Commerce

Five members: Employees Representatives

Five members: Employers Representatives One Women Member to represent Women

Officers on deputation: Welfare Commissioner in the cadre of Joint Commissioner of Labour, one Asst.
commissioner of Labour and one Asst. labour Officer on deputation from Labour Dept., are working in
the Board. Welfare Commissioner shall be the Chief Executive Officer of the Board.

The Act is applicable to the following categories of establishments:

1. All factories as defined in Section 2(m) of the Factories Act, 1948


2. All Motor Transport workers Act 1961.
3. All establishments as defined in Section 2(10) of the A.P. Shops and Estt. Act, 1988
4. All Societies registered under any law in force in the State relating to registration of societies.
5. All charitable or other trusts whether registered or not which carries on any business or trade
or any work in connection with or ancillary thereto and which employees on any working day
during the preceding 12 months employed 20 or more persons but does not include an
establishment, not being a factory, belonging to or under the control of Central or any State
Government.

EMPLOYEES TO WHOM THE ACT IS APPLICABLE:

Any person who is employed for hire or reward to do any work, skilled or unskilled, manual,
supervisory, clerical or technical in an establishment for a period of 30 days during the period of 12
months, whether the terms of employment be expressed or implied but does not include any person:-

1. Who is employed mainly in a managerial capacity ; (or)


2. Who being employed in a supervisory capacity, draws wages exceeding Rs.1600/- per men sum
or exercises either by the nature of duties attached to the Office by reason of the powers vested
in him, functions mainly of a managerial nature; (or)
3. Who is employed as an apprentice or on part time basis

Items constituted in Welfare Fund:

1. Contribution collected under Section 10


2. Un-paid accumulations paid to the Board under Section 8
3. All fines including the amount realized under standing orders issued under the A.P. Industrial
Employment (Standing Orders) Rules, 1953 from the employees by the employer not with
standing in anything contained in any agreement between the employer and the employee
4. Deductions made under the provison to subsection (2) of Section 9 of the Payment of Wages
Act, 1936
5. Any interest by way of penalty paid under Section 9
6. Any voluntary donations
7. Any fund transferred under Section 12(5) the Act.
8. Grants of advances made by the Government
9. Any unclaimed money deposited under sub Sec (1) of Sec 8 of Workmen Compensation Act.,
1923.
10. Any amount raised by the Board from other sources to augment the resources of the Board.

ENFORCEMENT OF PROVISIONS OF THE A.P. LABOUR WELFARE FUND ACT:

The Officers of the Labour Department have been notified as inspectors under the A.P.
Labour Welfare Fund Act for enforcing the Act & Rules and are authorized to collect the
contributions from the employers and to remit the same to the Fund.
The contributions to the Welfare Fund are being collected through different methods viz.,
1. Through the officials of the Labour Department who are notifies as Inspectors
2. Directly from the employers by way of DDs, Cheques & Bank Challans and
3. Through e Seva centers at Hyderabad & Visakhapatnam.

The A.P. Labour Welfare Board established in 1990 has formulated welfare schemes have been
implemented by the labour department.
The Asst. Commissioners of Labour receive applications and settle claims under the schemes.
The Act covers 25 lakh workers in factories, Shops and Establishments, Motor Transport
Undertakings, Societies and Trusts.
The main source of fund is contributed @ Rs.7/- per worker per year, unclaimed wages, other
sources of income like building rent and grants made by the Government.

Main Schemes implemented by A.P. Labour Welfare Board are:

Vaidhya Sahaayam (Financial assistance for treatment of Chronic diseases) :


An amount of Rs.20,000/- is being provided to the contributor workers or his dependents
for treatment of Chronic diseases like Cancer, Brain tumor or Heart ailments, Paralysis
treatment, Hysterectomy, trauma treatment (serious wounds/injuries caused due to
accidents) and AIDS- Treatment.

Paramadamarana Aardhika Sahayam (Financial assistance for accidental death):


An amount of Rs.30,000/- is being granted to the legal heirs of the contributors who died in
accident while on duty.

Sahajamaran Aardhika Sahayam (Finance assistance for Natural death):


An amount of Rs.10,000/- is being granted to the legal heir of the deceased worker under
Natural death scheme to support the family members for the sudden loss of earning
member.

Anthyakriyalaku Aardhika Sahayam (Financial assistance for Funeral Expenses):


Financial assistance for an amount of Rs.5,000/- for funeral expenses

VivaahaKaanuka (Marriage Gift Scheme):

Fixed deposit worth Rs. 10000/- for a period of three years will be given to the daughter of
the worker contributor, at the time of her marriage. Similarly, women worker contributors
will be given with above Gift for their self-marriage.

Angavaikalyaniki Aardhika Sahayam (Financial Assistance for Loss of Limbs):


An amount of Rs.20,000/- OR actual medical expenses, whichever is less, is being paid to
the worker contributors who lose their limbs in accidents.
(Disability 25% 40% = Rs.10,000/, 41% to 49%= Rs.15,000/-, 50% abpove Rs.20,000/-)

Prasuthi Sahayam (Maternity Benefit Scheme):


A scheme to provide financial assistance towards maternity benefit to an extent of
Rs.5,000/- to the women workers working in the establishments not covered under E.S.I. or
any such assistance provided by the menagements.

Asdarsha Kutumba Prothsaahakam (Family Planning Incentive):


Financial assistance of Rs.2,000/- will be paid to the worker contribute for undergoing
family planning operation for those who are not working the public Sector Establishments
and whose monthly salary/wage does not exceed Rs.10,000/-

Vidhya Prothsaahakam (Merit Scholarships to the workers and their children):


Every year scholarships are being provided to the workers and their children @Rs.1000/- for
prosecuting 10th class, Rs,1500/- Polytechnic, Rs. 2,000/- for Engineering, Medicine, Law,
B.S.C. (Ag), B.S.C.(Vet), B.C.A., B. Pharmacy, M.B.A. & M.C.A., BSC (Horit), BSC (Nursing),
BAMS, BDS, DHMS, DMLT, MLT Courses.

Pratyeka Vidhya Prothsaahakam (Scholorship to the Physically handicapped Children):


Scholorships are also being provided to the Physically handicapped children of the
contributor workers @Rs.4,000/- irrespective of the class and courage

Sports, Games & Cultural Competitions:


Every year Sports, Games & Cultural Competitions are being conducted at Zonal and State
Level among the workers of various Factories & Establishments and the winners are being
awarded with Prizes.

Financial assistance for accidental death: Rs.30,000/-


Financial assistance for natural death: Rs.10,000/-
Financial assistance for treatment of chronic diseases: Rs20,000/-
Reimbursement of funeral expenses: Rs.5,000/-
Financial assistance for loss of limbs: Rs.20,000/-

Maternity benefit: Rs 5,000/-


Merit scholarships to the physically challenged children: Rs.1,000/- to 2,000/-
Scholarship to the physically challenged children: Rs.4,000/-
Family Planning incentive: Rs.2,000/-
Marriage gift: Rs.10,000/-

An amount of Rs.6.89 crore was distributed to 26,353 workers under the schemes during the
last 5 years.

STATUS OF WELFARE FUND

As on 02.06.2014, an amount in Fixed Deposits Rs.21.77 crore and amount is SB Account is


Rs.36.82 lakh.
Governments have constituted the A.P. Labour Welfare Board under Section 4 of the A.P.
Labour Welfare Fund Act, 1987 during the year 1990 for the first time.
The Minister for Labour is the Chairman of the Board and the Board consist of representatives of
employers and employees in equal proportion and independent members viz., Secretary to
Government, LETE & F, Finance, Industries as ex-officio members an a woman member to
represent women to be nominated by the Government.
The Board has formulated welfare schemes for the contributor workers and the schemes have
been implemented by the labour department.
All officers of the Labour Department from Assistant Labour officer to the Commissioner of
labour have been notified as inspector under the Act (sec 18& rule 22).
The Asst. Commissioners of Labour receive applications and settle claims under the schemes.

CHANDRANNA BIMA

Chandranna Bima, the accidental insurance scheme launched by Chief Minister N Chandra
babu Naidu in Tirupati on October 2, 2016 will benefit two crore persons aged between 17
and 70, especially the unorganized workers and small traders.
The main objective of the scheme is to provide relief to the families of unorganized workers
in case of death or disability of the unorganized worker leaving the families in great distress.
There were an estimated two crore labourers in the unorganized sector in the State and
about 1.04 crore workers have been enrolled in a survey conducted by the State government.
Under Chandranna Bima scheme (CBS), the family of the deceased will get an insurance
amount of Rs 5 lakh for accidental death. Rs 5 lakh for permanent disability, Rs 3.62 lakh for
partial disability and Rs 30,000 for natural death, will be given under the scheme.

The children of labourers studying in classes 9, 10 and Intermediate will get a scholarship of
Rs1,200 per annum. Workers involved in mud work, brick making, sand quarry, road
construction works, bore wells and mason will be termed as building construction workers
along with workers who have worked for 50 days in NREGS scheme.
Premium to the tune of Rs 134 crore will be borne by the State government on behalf of the
workers and the workers will have to bear only Rs 15 towards service charges. A centralized
online system has been introduced in the labour department in the State which is
unprecedented in the nation.

Salient features of the scheme:

All unorganized workers in the State in the age group of 18 to 70 years are eligible to be
registered as unorganized workers and enrolled as beneficiaries of the Chandranna Bima
Scheme.
All unorganized workers will be registered under the unorganized workers social security Act,
2008 and enrolled as beneficiaries under Chandranna Bima Scheme.
SERP shall facilitate registration of unorganized workers and their enrollment in the Chandranna
Bima Scheme, data entry, maintenance of data base, hard copies of signed supplications and
other connected matters.
Assistant labour officer of the Labour Department shall be the registering Authority.
The registered unorganized workers will be enrolled as members under State Accident Death
and Disability Scheme and under Aam Admi Bima Yojana (AABY) and will also be covered
under the Pradhan mantra Surak-sha Bima Yojana (PMSBY).

The benefits under the Chandranna Bima Scheme are as follows:

Rs. 5 lakh for Accident Death and Total Disability: Rs. 2,25,000/- (Rupees two lakh twenty five
thousand) from State Accident Death and Disability Scheme, Rs.75,000/- (Rupees seventy five
thousand) under Aam Admi Bima Yojana (AABY) and Rs. 2,00,000/- (Rupees two lakh) from
Pradhan Mantri Suraksha Bima Yojana (PMSBY).
Up to Rs.3,62,500 /- for Partial Disability: Up to Rs.2,25,000/- (Rupees two lakh twenty five
thousand) from State Accident Death and Disability Scheme, Rs. 1,00,000/- (Rupees one lakh)
from PMSBY and Rs.37,500 from AABY.
Rs.30,000 /- for Natural Death under Aam Admi Bima Yojana (AABY).
Rs. 1200/- p.a. towards scholarship per child up to two children of the beneficiary studying 9th,
10th, Intermediate or ITI.

In exercise of the powers conferred under section (4) of Section 3 of the Unorganized Workers
Social Security Act, 2008 (central Act 33 of 2008), the Government, formulate hereby the
following insurance scheme for the Unorganized Workers employed scheme for the
Unorganized Workers employed in the State:
I. Objective of the Scheme:
1. The main objective of the Scheme is to provide relief to the poor families of
Workers in the Un-organized sector in the cases of accident death.
2. As per the All India statistics on Accident Deaths in 2012, the State of Andhra
Pradesh (7.6%) occupied fourth position along with Uttarapradesh with
Maharashtra (15.7%), Madhya Pradesh (9.1%) and Tamilnadu (8.3%) in top 3
positions.
3. The Accident Death of the Worker results in misery to his poor family casting heavy
financial burden due to medical and other expenditure relating to the accident and
financial loss due to death of the bread earner. The Central Government have also
announced Pradhanmanthri Bhima Suraksha Yojana Scheme for Rs.2.00 lakhs
Accident Death Insurance Scheme for the holders of jan Dhan Yojana Accounts,
who are mostly unorganized sector workers. There is every need for
implementation of Accident insurance Scheme for Unorganized Workers and the
Insurance amount should be Rs.5.00 lakhs keeping in view the present day financial
needs on medical and other expenditure at the time of accident and education and
other needs of the dependent family members.
II. Salient features of the Scheme:
1. All unorganized workers who are registered with the Andhra Pradesh Unorganized
Workers Social Security Board are eligible to become beneficiaries of the Scheme.
2. The Unorganized Workers will be registered as beneficiaries under the scheme On-
line through Workers Facilitation Centers or such other means as many be specified
by the Commissioner of Labour and the Assistant Labour Officer is the Registering
Authority. The registration of the workers shall commence from 1st May 2015.
3. The Unorganized Workers shall open Jan Dhan Yojana Saving Account in any of the
nationalized banks. He should ensure compliance with the conditions for eligibility
for Rs.2.00 Lakh Accident Insurance scheme under Pradhanmanthri Bhima
Suraksha Yojana scheme of Government of India.
4. The beneficiary will be eligible for Rs.5.00 Lakh Accident Death Insurance, out of
which Rs.2.00 Lakh shall be from Central Government Accident Death Insurance
Scheme. The balance Rs.3.00 Lakh will be paid from the Group Insurance Scheme by
the State Government.
5. For the first year, the Government will pay the premium for Group Insurance
Scheme as an incentive and from the second year onwards, the expenditure will be
met from Government of India/State Government/Board Funds with or without
contribution from the insured.

Short title, extent, application and commencement:


1. The scheme may be called the Andhra Pradesh Unorganized Workers Social Security
Scheme, 2015.
2. It extends to the whole of the State of Andhra Pradesh.
3. It shall apply to all Unorganized Sector Workers in the State.
4. It shall come into force from the date specified by the Government.

1. Definitions: In this scheme, unless the context otherwise requires,


(a) Act means the Unorganized Workers Social Security Act, 2008.
(b) Beneficiary means an Unorganized Worker registered under the scheme.
(c) Family relating to a beneficiary shall be deemed to consist of the beneficiary, his/her
spouse, unemployed son, unmarried daughter, widowed daughter if residing with the
beneficiary, dependent parents and the widow and children of a deceased son, if any;
(d) From means from annexed to this Scheme.
(e) Fund means Andhra Pradesh Unorganized Workers Welfare Fund constituted under
Clause 3 of this Scheme.
(f) Registering Authority means the Assistant Labour Officer of the area.
(g) Rule means the Andhra Pradesh Unorganized Workers Social Security Rules, 2012.

Note: Words and expressions used in this scheme and not defined shall have the same meaning
assigned to them in the Unorganized Workers Social Security Act, 2008 and the Rules made there under.

2. Fund:
1. A Fund shall be constituted in the name of the Andhra Pradesh Unorganized Workers
Welfare Fund by opening an Account in any Public Sector Bank Branches.
2. The Fund shall consists of
a. A contribution from the insured workers as per the notification by the Government.
b. Contribution by the Employers as may be notified by the Government.
c. Grants or Loans from the State Government
d. Financial Assistance by the Central Government
e. Interest on investment in securities, deposits and rent,
f. Donations etc received from an individual or an establishment
g. Any other sum as may be approved by the State Government.

3. The Fund shall be applied for the purpose of this scheme. Without prejudice to the
generality of powers in this respect, the Fund may be applied in connection with the
following activities
a. Cost of administering the scheme.
b. Providing Accident Insurance Scheme and such other benefits as may be notified by the
Government from time to time.
c. Such other activities incidental to the objectives of the Scheme.

4. Administrative and Financial Powers of the Commissioner of labour:


1. The Commissioner of Labour shall operate the Fund Account and release the Premium
of Insurance Scheme and all expenditure on contingencies, services and purchase of
articles as per the Rules/instructions of the Government in force.
2. The Commissioner of labour shall also exercise such other administrative and financial
powers as may be required for implementation of the Scheme.

5. Registration of Beneficiaries:
1. Beneficiaries shall be registered by the Registering Authority under the Unorganized
Workers Social Security Act, 2008 On line through Workers Facilitation Centres or in
such other manner as may be specified by the Commissioner of labour. They shall
submit Applications in Form annexed to this scheme and also furnished other particulars
like Aadhar Number, Telephone Number, Bank Account Details as specified by the
Commissioner of Labour. The application form may be changed as specified by the
Commissioner of labour, depending on the requirements and will be issued an Identity
Card under the Act. He will be provided Smart Card based on the particulars furnished
by him in due course.

6. Benefits: A beneficiary registered under the Scheme shall be entitled to Rs.3.00 Lakh
Accident Death Insurance and Rs.2.00 lakh Accident Insurance under the Central
Government Accidental Death Insurance Scheme Subject to his satisfying the conditions of
eligibility. The insurance policy is valid for one year and may be renewed thereafter, as
specified by the Commissioner of Labour.

7. Disentitlement for benefits and Redress of Grievances:


1. A registered unorganized worker who fails to renew his registration within the time
specified by the Commissioner of Labour or has attained the age of sixty years, shall
cease to be a beneficiary.
2. Any grievance may be addressed to the registering Authority who shall dispose of within
(30) thirty days by way of a speaking order.
3. An appeal may lie before the Commissioner of Labour within (30) thirty days of
communication of the decision of the Registering Authority and the decision of the
Commissioner of Labour shall be final.

8. Settlement of Claims:
1. The Registering Authority shall process the Claims under the scheme in the manner
specified by the Commissioner of Labour.
2. All payments to the Beneficiaries shall be made through registering Authority only in the
manner specified by the Commissioner of Labour.

9. Power to remove difficulties: If any difficulty or doubt arises as to the interpretation of any
of the provisions of the Scheme, the decision of the Government shall be final and binding.

10. Power to amend scheme: the State Government, may by notification in the official Gazette,
modify or amend the Scheme for its proper implementations and in the interest of
Unorganized Workers.

TRANSPORT DRIVERS SOCIAL SECURITY SCHEME

The Unorganized Workers Social Security Act, 2008 Andhra Pradesh Transport Drivers
Social Security Scheme of Providing Rs.5.00 lakhs (Rupees Five Lakhs only) accidental death
insurance for transport drivers employed as Auto, Car, Zeep, Lorry, Bus, Truck Drivers in
Unorganized Sector including Aam Admi Bima Yojana (AABY) Scheme.
In exercise of the powers conferred under section 3(4) of the Unorganized Workers Social
Security Act, 2008 (Central Act No.33 of 2008), the Government formulate hereby the
Andhra Pradesh Transport Drivers Social Security Scheme to provide of Rs.5.00 Lakhs
(Rupees Five lakhs only) Accidental Insurance i.e., Rs.4,25,000/- (Rupees Four Lakhs Twenty
Five Thousand only) from the Aam Admi Bima Yojana (AABY) for the Transport Drivers, who
are employed as drivers in all transport vehicles (including Auto, Lorry, Bus, Zeep, Taxi and
such other vehicles engaged in goods transport and passenger transport) in Unorganized
Sector.

Objective of the Scheme:

The main objective of the Scheme is to provide relief to the poor families of transport drivers
who die in accidents leaving the families in great distress.
As per the All India statistics on Accident Deaths, Transport Sector accounts for highest number
of Accidents Deaths (35.2%) in the Country. As per the Government of India statistics on Road
Accidents, Andhra Pradesh occupies 3rd position.
The accidental death of the driver results in misery to his poor family casting heavy financial
burden due to medical and other expenditure relating to the accident and financial loss due to
death of the bread earner. Hence, there is every need for implementation of Accident Insurance
Scheme for Drivers. The Insurance amount is kept Rs.5,00,000/- (Rupees Five lakhs only) keeping
in view the current day financial needs on medical and other expenditure at the time of accident
and education and other needs of the dependent family members.

Salient features of the Scheme:

1. All unorganized workers who are having valid transport driving license from the State of Andhra
Pradesh and employed as transport drivers of Auto, Taxi, Lorry, Jeep, Truck, Bus etc., are eligible
to become beneficiaries of the Scheme;
2. The Transport Drivers will be registered as beneficiaries under the scheme through Mee Seva or
such other means as may be specified by the Commissioner of Labour and the Assistant

Commissioner of Labour (Social Security Scheme) at the District Head Quarters is the Registering
Authority;
3. The beneficiary will be registered as member under Aam Admi Bima Yojana (AABY) Scheme
and also Group Accident Insurance Scheme so that they will be eligible for the following
benefits;
1. Rs.5,00,000/- Lakhs (Rupees Five Lakhs only) Accident Death Insurance 4.25 Lakhs from the
insurance scheme and Rs.75,000/- from the Aam Admi Bima Yojana (AABY) Scheme;
2. Other benefits under Aam Admi Bima Yojana (AABY) Scheme
i. Rs.75,000 for Total permanent Disability.
ii. Rs.37,500 for Partial permanent Disability.
iii. Rs.30,000 for Natural Death.
iv. Scholarship of Rs.1,200 p.a., per head for 2 Children of the Beneficiary studying in
9th, 10th, Intermediate or ITI;
4. For the first year, the Government will pay the expenditure of the premium as an incentive and
from the second year onwards expenditure shall be met by leaving 10% Cess on Annual Vehicle
Tax subject to the maximum of Rs.1,500/- as employer contribution.
5. The beneficiary has to renew his membership every year by paying the beneficiary contribution
under Aam Admi Bima Yojana (AABY) as may be specified by the Commissioner of Labour.
