Subject: La Reata Board Meeting Minutes

1. Call To Order:
The meeting was called to order at 6:10 pm. Present were David Sager, Nick
Collier and David Bell.

2. Old Business:
a. Spring Meeting. Committee sign-up sheets were collected and committee
memberships will be updated accordingly. The board received several
favorable comments regarding the information on animal control and the
recent repairs to the park and nature trail.
b. Repair of Front Gate. The board is in receipt of an estimate from Stephen
O’Donnell for permanent repair of the rust “bleed-thru” at the front entrance.
The estimate of $590 to repair the “bleed-thru” and refinish the sign metal
work was approve by the board.
c. No Alcohol Policy at Park. In response to several inquiries regarding this
policy the board is in agreement that this restriction should be lifted on a trial
policy for at least one year. If the use of alcohol at the park proves to be a
problem in the future, the restriction can be reinstated by the Board of
Directors.
d. CCR Vote Count: The final tally and vote count on the proposed CCR
revisions will be conducted following the next Board meeting on June 24,
2007.
e. Lot 113 (Split Lot) Discussion. The board is in receipt of a suggestion from
the finance company (GRP Financial Services Corp) that the POA purchase
the 1-acre parcel to bring it back under POA control. The board is in
unanimous agreement that this is not a satisfactory solution for the POA and
that this case should not be settle in this manner.
f. Loose Animal Control Policy. The suggested policy was approved by the
board. (A draft of this policy is attached as an enclosure to these minutes.)
The final policy will be posted on the website and included in the next
newsletter.
g. Revisions to the POA Welcome Document/Letter. These changes were
approved and will be incorporated in future welcome packets.

La Reata Ranch Domestic Animal Policy (DRAFT)

The Board of the La Reata Ranch Subdivision Property Owners Association has
developed this policy to address lose domestic animals within the La Reata Ranch
Subdivision in violation with the POA CCRs. While the POA does not want to restrict
any landowners from keeping domestic animals on their property in accordance with the
provisions in the CCRs, it must be recognized that the CCR restrictions were developed
to protect members from injury and damage resulting from lose domestic animals and to
be consistent with county ordinances. Both the CCRs and Bastrop County ordinances
require owners to keep their domestic animals on their own property.

It is important to remember that any POA member (not just Board members) can enforce
the CCRs for lose animals in the subdivision and the Board urges all members to work
with their neighbors to try to rectify any problems with lose domestic animals. Anyone in
the subdivision can file a complaint with the Bastrop County Animal Control Office about
lose domestic animals even if the Board has not yet taken action. The Board will follow
the general steps below to address lose domestic animal problems but may act more
aggressively should there be an immediate threat to safety and property from lose
domestic animals acting dangerously.

Step 1 - When a complaint concerning a lose domestic animal is lodged with the Board
the complaint must include a description of the animal and its owner or home address
(or similar detailed location information). If such information is not provided, the Board
will not be able to take action. Once the owner and animal in question are identified, the
Board will informally contact (verbal or email) the alleged owner to discuss the problem,
possible violation of the CCRs, and request that the owner restrict the animal inside their
land.

Step 2 - If further complaint(s) are received about the same domestic animal and owner,
the Board will send a formal letter to the alleged owner notifying them that they are in
violation of the CCRs, must restrict their animal to their property, and request a reply
with their plan to restrict the animal as required. The Board will try to follow up to
determine if the animal is lose and a problem.

Step 3 - If the owner ignores the written notification and the lose animal continues to be
a problem, the Board will notify the Bastrop County Animal Control Office concerning the
lose animal and ask them to enforce the county ordinances on this issue. County
ordinances require domestic animals to be restricted to the owner’s property and non-
compliance can result in confiscation of the animal and fines for Class C misdemeanors
(fines can range from $190 to $500).

Step 4 - If the owner and lose animals continue to be a problem through ignoring the
earlier actions or multiple violations of the CCRs and county ordinances, the Board will
initiate a lawsuit against the owner for the CCR violations seeking any and all remedies
under civil statutes including rectifying the problem under court order, related civil
penalties, and seeking court costs and reparations. If the court upholds the lawsuit the
Sheriff's Department will enforce the court order.
