AGREEMENT This Agreement is made this_2Q day of September, 2017, between and among City of Springfield Board of License Commissioners ("Board") and Raman, In. dba Club Pandora (Club Pandora”). .WITNESSETH THAT WHEREAS, on or about July 13,2017, Chib andor attended a pre-hearing conference in srontof the Hoard regarding he following alleged violations June 3, 2017: 1, 204 CMR 2.05 (2) No licensee for the sale of alcoholic beverages shall permit and disorder, disturbance, or illegality of any kind to take place in or on the licensed premise. The licensee shall be responsible whether present or not. THREE COUNTS: to wit; A. Allowing patrons to exit the licensed premise with alcohol; B. Manager of record not on scene; and . Violation of Security Plan- Patrons loitering in the parking lot almost one hour aftr the stated closing time of 1:30 am, 2. 204 CMR 2.03(2) No licensee shall use, or allow to be used, ‘any advertising matter which i false or untrue. ONE COUNT: This licensee continues to advertise, via exterior signs, a8 ‘Kickback Lounge although its liensed under Club Pandora June 4,2017: 1. 204 CMR 2.05 (2) No licensee for the sale of alcoholic beverages shall permit and disorder, disturbance, or illegality of any kind to take place in or on the licensed premise. The licensee shall be responsible Whether present or not. FIVE COUNTS: to wit; A. Failure to call police; B. Manager of record not on scene; C. Allowing patrons to exit the licensed premise with alcohol; D. Violation of Secusity Plan- Patrons Toitering in the parking lot almost one hour after the stated closing time of 1:30 a.m. and E, Violation of Security Plan- non-working video cameras WHEREAS, a said pre-hearing conference, Clu Pandora stipulated to the following alleged violations: 1 Violation of Security Plan- Patron oitesing in the parking lot almost one hour after the stated closing time of 1:30am; 2. Violation of Seeurity Plan- non-working video eameras; and3. The licensee continues to advertise, via exterior signs, as Kickback Lounge although its licensed under Club Pandora WHEREAS, the Board wishes to clarify the understanding of the Parties and responsibilities of CClub Pandora, in the event they wish to continue to operate as a nightclub; NOW THEREFORE, the Parties hereto covenant and agree as follows: 1, Asa result of said pre-hearing conference the Board will dismiss the following alleged violations ‘8 Failure to call police (lune 4, 2017); . Manager of record not on scene (June 3, 2017 and June 4, 2017); and «. Allowing patrons to exit the licensed premise with aleabol (June 3,2017 and Sune 4, 2017) 2, The Board will suspend the liquor license of Club Pandora until a new manager is proposed by the licensee, The license will remain suspended and Club Pandora will remain closed until the following conditions are satisfied: ‘Club Pandora mets with the neighborhood council and the new manager is approved by said council, ‘The new manager is approved by the Board; and «©. The new manager is approved by the Massachusetts Alcoholic Beverage Control Commission (“ABCC”) 3. Inaddition tothe approval ofa new manager, Club Pandora will amend its security plan; the amended security plan to be approved by the Springfield Police Department Said plan willbe detailed, stating the following: “The number of cameras being used ‘The location of all security cameras; How long recordings will be maintained, not to be less than thirty (30) days; How often recordings are viewed andlor monitored; ‘The number of security sta on duty; ‘The location of security staff inclnding details es to what duties they are to perfoem, whether inside the premise and/or outside inthe parking lot, Spovilie closing Gane; and Specific plan as to parking which must be approved by the Springfield Police Department, pete cic 4. Club Pandora will relinguish its late night entertainment license and will close promptly at 12:00 am.5, If Club Pandora obtain off premise parking for its patrons, the parking plan needs to be approved by the Springfield Police Department. Suid parking plan shall include, but is not necessarily limited tothe following: b 4 Off-site parking ‘Alternative parking for employees Private security patrols of surrounding neighborhoods ‘Towing illegally parked vehicles 66, Once Club Pandora re-opens, there willbe a requirement that they request four (4) police officers from 10:30 pan ‘am. every night they are open. Club Pandora ‘must hire additional private seourity personel if they are unable to seeue officers for this detail 7. Itis the understanding of the partes that in the event Club Pandora elects to cease ‘operation asa nightclub, the foregoing provisions shall no longer bein effect.
