15-0143 / March 4, 2015

The SSS issued a death benefit check to Tere who was then in Europe and could
not personally encash the same, thus, she requested Tobi, a long time friend, to help
her.

Tobi acceded to the request and immediately advised Tere to look for someone
who can imitate her signature so the check can be signed at the back and eventually
encashed.

The sister of Tere was the one who signed and caused the encashment of the
check, however, it was discovered by SSS which caused Tere to return the money.

The money was restituted and SSS did not suffer any loss but Tobi who happens
to be an employee of SSS was charged with serious dishonesty.

Norbert was charged with Disgraceful and Immoral Conduct based on the complaint
filed by his wife alleging that he abandoned her and their children, stopped giving them
financial support and has illicit sexual relations with another woman.

After the proceedings the evidence presented established the alleged abandonment and
withholding of financial support but not the illicit sexual relations with another woman,

A motion to dismiss was filed by Noberts counsel arguing that since there was no
evidence of illicit sexual relation with another woman, there is no Disgraceful and Immoral
Conduct to speak of.

Decision No. 15-0060 / January 20, 2015

Mon Mendi a Staff Officer II from GSIS was tasked to pay a visit to a handicapped
pensioner for the purpose of enrolling the latter in mobile UMID.

Upon reaching the house, Mon Mandi was met by the Children of the pensioner who
cautioned her against asking their mother to do any physical act as it might cause her stress and
worsen her condition.

Mon Mendi told the children that she will just ask their mother to sign a document but
the children resisted because their mother could not even move her right hand. Mon Mendi
insisted it was needed and further said that if the right hand is immobile then the left can be
used. She also added that other people even learned to use their feet to affix their signature.

The children did not like her statement and filed a complaint against Mon Mendi.

Santi, Clerk II, LTFRB, was formally charged with Gross Neglect of Duty for
his act of receiving applications for franchise at the time when the DOTC Secretary
had declared a moratorium in the issuance or grant of franchise.
The only defense interposed by Senti is that he merely received the
application.

Decision No. 14- 0928 / December 5, 2014
Ellen, an Associate Prosecutor in a locally created university collected tuition fees from
first time enrollees allegedly upon instruction of their Dean.
It was found out that the collection was not authorized by the Board of Regents of the
University making the same illegal and constitutes the administrative offenses of Grave
Misconduct and Dishonesty.
When asked to explain, Ellen averred that she merely followed the order of the Dean
and all the collected funds were utilized for the improvement of their institute.
The Board was not satisfied with the explanation, hence, being the disciplining
authority they formally charged Ellen and after due proceedings a Decision was rendered by
the City Mayor, a member of the board, finding Ellen guilty and dismissing her from the
service.
Ellen appealed. Decide the appeal.

In one birthday party, Beth C. Attorney III, was suddenly fed a slice of cake by Roger
R., Director III, same agency, in the presence of all their officemates. While no word was
uttered by Roger while doing the act, Beth however, felt very uncomfortable and ashamed
that she filed a complaint for sexual harassment against Roger.
