That the affiant, Detective Matthew Geddes #574, is a swom member of the Connecticut State Police Department and has been a member of said department since June 2013. That the affiant is presently assigned to the Central District Major Crime Squad (CDMCS) and that at all relevant times mentioned herein was acting in his capacity as a member of said department. Prior to being a sworn member of the Connecticut State Police Department, the affiant was a sworn Police Officer for the Town of Glastonbury ice Department from August 2008 to June 2013. The affiant has had training and experience in investigating crimes, compiling reports and drafting arrest warrants. That the information detailed herein is the direct result of the affiant's investigative efforts and/or that which has been related to him by fellow law enforcement officials. 2. That on Match 21, 2017, at approximately 1150 hours, Renata Kozak, Director of Nursing for the Whiting Forensics Division of CVH, contacted Sgt. Ruggiero of the DHMAS police department and informed him that she received a report from a DHMAS employee alleging abuse against a Whiting Forensics patient. ‘The patient's name is being withheld from this warrant and will be referred to as “the patient” throughout the body of this warrant. Sgt. Ruggiero stated Nursing Director Kozak advised him that the abuse was alleged to have just occurred and she was requesting that the video recording from the patient's room on Unit 6 at Whiting Forensics and the adjacent hallway be downloaded and saved onto DVD dise for viewing, 3. ‘That on March 31, 2017, the Commissioner of DMHAS Miriam Delphin-Rittmon requested the ‘Connecticut State Police assume responsibility for this investigation regarding any possible criminal acts and on April 3, 2017 Connecticut State Police Sergeant Budwitz and Detective Dunham met with Chief Bozzi, Sgt. Ruggiero, and Lt. Michael Edelwich of DMHAS PD. All information developed to date was turned over to the CSP Central District Major Crimes Squad (CDMCS) by DMHAS PD personnel. 4. ‘That Sgt. Ruggiero provided that the patient is a long-term patient of Whiting Forensics and that the patient resides in room 631 on Unit 6 of the building. The patient is under the jurisdiction of the Psychiatric Security Review Board (PSRB) as defined in CGS 172-581, Whiting Forensics is a maximum security psychiatric facility that is operated by DMHAS. The patient's current treatment orders and the orders at the time of this and other incidents described is a two to one staff to patient ratio of supervision twenty-four hours a day. The patient is considered a high maintenance patient and therefore there is a video camera located inside of the room in which the patient resides (room 631). That Chief Bozzi explained that the Chief Executive Officer (CEO) of CVH, Helene Vertelas, contacted him and advised him of the allegations of abuse of the patient and requested the police department's assistance in determining if these allegations were criminal in nature. ‘That Sgt. Ruggiero continued that DMHAS Human Resources (HR) Director David Krayeski informed him that Human Resources opened an internal investigation into the allegations of abuse and requested video footage from the DMHAS Police Department for Unit 6 and the patient's room, That Sgt. Ruggiero stated that on the evening on March 21, 2017, Director of DMHAS Information and Technology (IT) Kathryn Connelly and IT staff Ruben Figueroa and Walter Gantley, in the presence of Chief Bozzi, began the process of downloading the DVR's onto two external hard drives and also onto a secure shared drive on the DMHAS computer system to allow HR and investigating DMHAS Police personnel to view the footage as a working copy while the original hard drives were secured as evidence. The downloaded footage provided captures the dates from February 27, 2017 to March 22, 2017 due to a recorded retention limit on the video recording system. Anything prior to February 27, 2017 has not been retained by DHMAS. That the DMHAS HR Department staff reviewed the footage in its entirety and differentiated in a thirty-six (36) page document between possible criminal acts to be referred to the police investigation and administrative policy and procedure violations, The administrative policy and procedure violations are being investigated by the State of Connecticut Department of Health, the United States Department of Health and Human Services, and the State of Connecticut Office of Advocacy and Protection. Based on DHMAS management viewing the aforementioned video footage, thirty-one (31) DHMAS employees are on paid suspension leave for DMHAS policy violations or potential criminal acts. ‘That based on the recommendation of Doctor James Gusfa, the patient's doctor at the time of the incidents, the patient was not interviewed based on the patient's medical diagnoses, which include but are not limited to, psychosis and delusion thinking, and disabilities that make the patient oftentimes non- communicative and unable to correctly process facts and information and/or accurately relate past ‘experiences when questioned. ‘That upon the affiant being assigned this investigation, the affiant along with Connecticut State Police Major Crime Squad Detective James McGlynn and Sergeant Ruggiero reviewed the video footage from Whiting Unit 6 room 631 that DMHAS HR deemed potentially as criminal acts in the aforementioned thirty-six (36) page document, 10. That upon viewing the below mentioned video footage, at no time did the affiant observe behavior on bbchalf of the patient that would give cause to believe that he was the primary aggressor in those incidents. 12, That the suspect; Lance Camby DOB 08/12/69, has been a DHMAS employee since July of 2001, Camby currently holds the position of Forensic ‘Treatment Specialist (FTS). The duties of a Forensic Treatment Specialist according to the State of Connecticut Department of Administrative Services Job webs include but are not limited to, therapeutic interventions to facilitate achievement of the highest level of functioning of activities of daily living, participates as an active member of the clinical treatment team, ‘welcomes and orients new staff members to the unit by reinforcing skills leaned in orientation, assists other staff in direct patient care, accurately records patient census, monitors patients for contraband and personal items which could be used to compromise unit security and/or inflict self-harm, conducts ‘searches as needed, reports patterns and changes or conditions in patient behavior and affect to charge staff, consistently and actively supports patients' rights and patient empowerment, respects and acknowledges patients’ cultural identity and needs (i.e, dress, food, language and values) and attends in- service education/training along with performing other related duties as assigned. 13, That investigators reviewed the patient's medical records and treatment plan. In the patient's medical records there were no orders for the kind of contact that Camby makes with the patient in the below mentioned video footage. Investigators reviewed the policies and procedures for training with regards to Whiting Forensic employees and there is no indication that employees are trained to use the kind of physical contact viewed in the below mentioned video footage when caring for the patient. Investigators interviewed Dr. Gusfa and he stated that the kind of contact mentioned herein is not approved or a part of the patient's medical treatment plan, 14, That on March 8, 2017 at approximately 09:06:43 the patient is seen on video sitting on his bed. Camby is seen sitting in a chair and then kicks the patient. The patient reacts by putting his legs on the bed and underneath his body to move away from Camby's contact. FTS Robert Larned DOB 11/12/71 was a present during this incident. 15, That on March 10, 2017 at approximately 08:14:50 the patient is seen on video sitting on the bed. Camby is sitting in a chair and throws liquid on the patient from a container. The patient reacts by moving and turning away from the liquid. The liquid is seen in the air moving towards and landing on the patient. FTS Christian Todzia DOB 08/05/83 and FTS Michael Kirdzik DOB 05/18/76 were present during this incident. 16, That on March 11, 2017 at approximately 08:14:46 the patient is seen on video sitting up in bed. Camby is seen putting his hand on the patient. The patient is seen moving away from Camby's touch. Camby along with ETS Robert can be seen kicking the patient while they are both seated in chairs. ARREST WARRANT APPLICATION STATE OF CONNECTICUT SUPERIOR COURT ‘wud t.go¥ Tats om aaa — COTO RT New Britain | Middletown Affidavit - Continued 2017 at approximately 08:19:04 the patient is seen on video sitting on his bed, Camby is seen throwing an object at the patient which ultimately hits the patient and falls on the floor. FTS Larned was a witness to this incident. 17. That on March 20, 2017 at approximately 07:20:17 Camby is seen walking on a hallway camera outside of the patient's room. As Camby walks by the open door of the patient's room he is seen throwing an object at the patient which Jands on the patient's shoulder. The patient who was laying in bed when the “object landed on him took the object and put it in his mouth. FTS Benjamin Rosado DOB 09/04/72 was present during this incident. 18. That on March 21, 2017 at approximately 11:37:18 Camby and FTS Larned can be seen on video restraining the patient on his bed by holding his arms down while Forensic Nurse (FN) Michael Presnick DOB 06/05/90 attempts to put what appears to be a diaper or underwear over the patient's pants. The patient was fully clothed at this time. FN Presnick successfully gets the diaper or underwear over the patient's pants. Camby and Larned restrained the patient until 11:38:21 at which time Camby, Lamed and Presnick release the patient. The patient then removes the diaper or underwear and places it on the ground next to his bed. Presnick picks up the diaper or underwear and hangs it on the door knob of the patient's room door. Camby then picks up a small dark colored object off of the floor and tosses in onto the patient's bed while the patient is sitting on the bed. Camby then removed the diaper or underwear from the doorknob and placed it over the patient's head covering his entire head with it until the patient removed it himself. The patient could be seen struggling while being restrained by Camby and Larned. After he, FTS Larned and FN Larned attempt to hold the patient down and place the diaper over his pants, Camby, FTS Lamed and FN Presnick appear to be smiling as they stand outside in the hallway after the incident. A review of the patient's medical log for this date and time did not mention anything about the restraint or the diaper or underwear attempting to be placed on him. 19. That on May 3, 2017 at approximately 1730 hours Detectives made contact with Camby via telephone. Camby declined to be interviewed. 20, That a criminal history check for Camby shows prior arrests and convictions for Assault in the Third Degree, Failure to Appear in the Second Degree and Possession of Marijuana, 21.
