ACTIVITY PROPOSAL

PROJECT : LUC STAKEHOLDERS FORUM

PROPONENT : BUREAU OF AGRARIAN LEGAL ASSISTANCE (BALA)

DURATION : OCTOBER 18-20, 2017

VENUE : H2O HOTEL, ROXAS BOULEVARD, MANILA

BUDGET : Php 721,050.00

I. BACKGROUND/RATIONALE

Under the approved Rationalization Plan (Rat-Plan) of the Department of Agrarian


Reform (DAR), the functions of the defunct Center for Land Use Policy, Planning &
Implementation (CLUPPI) were transferred to the Land Use Cases Division (LUCD)
under the Bureau of Agrarian Legal Assistance (BALA). The LUCD is tasked to
process and resolve Applications for Land Use Conversion, Exemption and Exclusion
involving landholdings with an area of more than 5 hectares, Requests for Extension
of the Development Period, Petition for Revocation of Exemption/Conversion Orders,
Motions for Reconsideration (MRs), and/or Appeals relative thereto.

Moreover, the LUCD under the Bureau of Agrarian Legal Assistance is mandated to
update the public, stakeholders, and related government agencies of its latest
issuances, rules and regulations.

With the new issuances and updates on the processing of Applications for Land Use
Conversion and Exemption, including the latest updates from the connected
agencies in the implementation of Land Use Conversion and Exemption, it is
indispensable that a National Conference/Forum should be conducted. The need for
a National Convention or Conference on the Land Use Conversion and Exemption is
timely, considering that one of the Governments public policy is the massive
industrialization and development in the countryside, expecting an issues and
confusion on the processes on the change of land use.

The conduct of LUC Stakeholders Forum is imperative for it will lead the way to more
coordinative linkages with other line implementing agencies/partners/stakeholders on
LUC process. The activity shall try to harmonize varying stands on various LUC
issues and policies, including pending bills involving LUC processes, thus, come-up
with common, uniform and seamless LUC process.
The said activity shall also serve as a venue for interaction between and among the
Department and LUC Stakeholders. A discussion of the LUC process and
consultation with the LUC stakeholders on the proposed Conversion moratorium and
other proposed amendments in the LUC process.

II. OBJECTIVES:
1. To come-up with common interpretation on the latest issuances and processes
of different agencies involving LUC;

2. To avoid duplication and overlapping of functions among the concerned


agencies in LUC;

3. To come up with an appropriate actions and measures to ensure smooth


operations and come up with seamless and effective LUC process;

4. To establish coordinative among the line implementing agencies and


stakeholders of LUC;

5. To harmonize varying positions in LUC;

6. To inform the LUC Stakeholders and related government agencies of DARs


latest pronouncements and issuances on the processes of Land Use Process
Application;

7. To invite related government agencies to update the DAR and LUC


stakeholders on their latest pronounces and issuances on the documents
necessary in the Application for Land Use Conversion and Exemption;

8. To hear the comments and suggestions of the LUC stakeholders, in relation to


LUC applications and identify policy gaps, issues, problems and concerns that
hamper the processing of applications for land use conversion, exemption and
exclusion;

9. To update the participants on the latest rules and regulations, and latest
jurisprudence involving LUC cases/applications; and

10. To foster closer working relationship between and among the participants.

III. EXPECTED OUTPUTS:

1. Uniform/common interpretation of policy issuances on LUC;

2. A consolidated, validated and updated LUC Processes Database, and the


processes of other related agencies;

3. Identified policy gaps, issues, problems and concerns that hamper the
processing of applications for land use conversion, exemption and exclusion
and affect the LUC processes;

4. Solution to identified the problems and constraints on the present LUC


processes;

5. Updated the participants on the latest rules and regulations, and latest
jurisprudence involving LUC cases/applications; and

6. A closer working relationship between and among the LUC stakeholders.

IV. METHODOLOGY/CONTENTS:
The 3-day activity shall be a series of lectures and an open forum discussion at the
end of the lecture. The consolidated LUC processes database shall be presented to
the body at the end of the program.

VI. BUDGETARY REQUIREMENTS

To defray the expenses for this activity, a total of SEVEN HUNDRED TWENTY-ONE
THOUSAND AND FIFTY PESOS (Php 721,050.00) is needed chargeable against
the BALA Funds, broken down as follows:

Board and Lodging (P1,800 x 115 pax x 3 days) 621,000.00


Supplies and Materials (P300 X 115 pax) 34,500.00
Contingency (10%) 65,550.00
