SUBJECT: DELAY IN RELEASE OF RS. 2,88,000/- TOWARDS SUBSIDY FOR THE


PERIOD JANUARY 2016 TO MARCH 2016.

Respected Sir,

As per your instructions vide your kind honours good office letter No. POS/RL-
108(LKA)2017//3010 dated 07.09.2017, I am providing here with answers to the allegations leveled
against me by the Sindh Education Foundation (SEF). My response to these allegations is as follows:

1. In response to the first allegation, I would like to say that I have not breached any clause
of my contract. I had written the said application after being misguided by the then
Larkana Regional Officer, Mr. Mehboob Ali Magsi, and Junior Officer, Javed Ali
Kalhoro. I wanted to shift my school from the rural area to the urban, the same way as
some other schools have already been shifted to the city. Regarding this matter, I had
asked them to guide me about the correct procedure for this process, and they had told
me to write an application for closing the school on the basis of insufficient enrolment
and a lack of qualified teachers. They had told me that the SEF would then issue me a
show-cause notice (but they had not issued any notice) and that the SEF would refuse to
close the school before the annual examinations. They told me that once I get this notice
from the SEF, I should then issue a request for the relocation of the school from the
village to the vicinity of Larkana city, where we can get more enrolments. I was told
that, on the basis of this procedure, the SEF would allow me to search for a suitable
nearby location to where I can then move my school.

Taking their advice, I subsequently wrote an application to the Managing Director of the
Sindh Education Foundation on 07.12.2015. After a few days, Mr. Magsi contacted me
via mobile phone and asked me to come to the regional office. There, he told me that the
application had been received by the relevant authorities and that the request to close the
school had been denied as expected. He told me that he was verbally ordered to hold
onto my application till the end of the academic year and he advised me to start
searching for a suitable new place for the school. It is on this basis that the application
was written by me on the instigation by both officers, and I had not received any written
proof of receipt of the application or not any written reply received from them that is
why I respond by saying that I have not breached any clause of my contract.

2. In response to the second allegation, I would like to report that on 11.12.2015, a death
had occurred among the people of the village. Because of that, I had informed Mr.
Magsi that I will close the school for a day since people would be coming to console and
condole with the villagers. At that time, Mr. Magsi had told me that this would be the
best time to measure the GPS from my school to any other location where I would now
like to move to. Therefore, he, along with Junior Officer Javed Ali Kalhoro,
accompanied me with a GPS device to my school, where the people who had come to
visit the villagers were staying and thus, beds had temporarily been laid out for them in
the school building on beds. For this purpose, the school furniture had temporarily been
moved to the mens apartment (Autaq) that was adjacent to the school and where some
agricultural items such as fertilizer, some other equipment and furniture was also being
kept.

Over there, Javed Ali Kalhoro had taken some pictures, which worried me a bit, but he
said that he was doing that for Mr. Magsi as proof of the death event. I was unaware of
his mal-intentions back then, for I did not know he would use them to claim my school
was closed. Any allegation leveled by the persons concerned is baseless; whoever
accused me and my school did it wrongly. If my school had not been closed temporarily
because of the death, the Junior Officer would not have any photos, because my school
was established in a house and people are living there. Also, even if the Junior Officer
had come on a normal day and asked to take pictures, it was impossible for the school
equipment and the class white-board to not be there. Furthermore, the people of the
village wake up very early, so it is very difficult to believe the Junior Officers story. It
is impossible to find bed-sheets or heavy quilts in mid-day when the village people all
wake up very early. Also, it is impossible for the Junior Officer to only find beds and no
other household items. Thus, the second allegation leveled against my school is baseless
and false.

3. In response to the third allegation, I would like to mention that even though the previous
two or three assessments were not that satisfactory, in the first assessment my school
had gotten third position in the whole district. The SEF had even issued me some letters
of appreciation for that good performance. However, the clashes of two Jatoi groups
have seriously affected my school and its education. This is also a reason for why I want
to move my school to another place. Unfortunately, both Mr. Magsi and Junior Officer
Javed Ali Kalhoro have misguided me and destroyed me. They have taken my school
from my hands and left me bankrupt and indebted.

On the other hand, some other school operators who also failed three consecutive
assessments were rewarded subsidy till March 2016, and I can produce at least one
school operator whose school has been closed for the same issues but who got complete
subsidy from January 2016 to March 2016 and who is also willing to give his statement
before your honour along with bank statements of the subsidies that he received. How
come he and some other school operators whose schools have been closed can still get
subsidy from January 2016 to March 2016 but not me?
In response to the allegations leveled during the observation, I would like to bring to
your notice that:

The signboard was never pulled off from its installed place. I had visited the village
myself in June 2017 and found it to be intact. I cannot speak for right now, since my
school has been closed due to the non-availability of funds.

The condition of the school building is perfectly fine since a family is currently living
there. They are living in the same conditions as at the time of the visit of the junior
officer, which proves that the conditions there are fine.

All of the basic needs of a school are available at the vicinity (e.g. water plant,
electricity, extensive and windy classrooms etc).

There are two toilets in the school building, one for boys and one for girls, and they are
probably still in working condition.

There was some scattered furniture lying in the mens apartment (Autaq) that is adjacent
to the building, because the people living there use it for the fire. There is no scattered
furniture in the classrooms.

All of the registers are available in the school and would have been presented if the
junior officer had asked for them.

FACTS:

After responding to these allegations, I would now like to present the real facts
regarding this situation. With due respect, sir, I would like to bring the following to your attention:

1. I have been trying to contact the SEF for the past 18 months. I have tried to contact them
through mobile phone, email, and courier service; and I have also gone many times to
the SEF Regional Office in Larkana and twice to the Head Office in Karachi. However,
they have neither given me my subsidy nor have they given me a reason in written for
withholding it only they wanted to bother me. If they have closed my school and stopped
my subsidy because of my application, then they should at least have informed me or
given me a notice or a written order so that I would not have to carry the expenses of the
examinations held in March 2016, the staff salaries, and the school-building rent and
security dues. Had they told me, I would have been saved from the many debts and loans
which I have accumulated in trying to fulfill these expenses. The SEF did not inform me
of anything and they left me like an orphan child. Had they told me, I would at least not
have been indebted and burdened by all these loans. In addition to this, I am raising the
question here, could they produce any order or intimation letter in written, for close my
school with my receiving letter? How could they do, because they only want to rag me
ever.

2. By deluding me with false hopes, Mr. Magsi and Junior Officer Javed Ali Kalhoro
deceived me about the procedure for shifting my school from this controversial and
risky place to a safer and clean area where I could run the school smoothly. Some other
schools have been shifted from their real locations and their operators have not been
dealt with so strictly. I can provide you with examples of such schools.

3. Junior Officer Javed Ali Kalhoro conducted unofficial visits, in which he would catch
minor faults on camera in order to threaten and coerce school operators. In my own case,
he visited the location, pretending to help me in moving my school, and then took some
photos out of context in order to demand one-third of the quarterly base as his share for
shifting the school. However, I did not accept his demand and I chose to shift my school
solely on the basis of merit and need. At this, he got furious and then misrepresented the
condition of my school before the higher-ups. Sometimes, he favours the applicants of
new schools by hiding nearby school locations, even though this is against the required
criteria of the Sindh Education Foundation. In order to do this, he makes sure to take
GPS locations of only areas far away from that school, ignoring near locations that could
be schools of government, SEF and other NGO. If required, I can even produce
examples of locations where new schools were issued against the required criteria or
without following the rules.

Afterwards, Mr. Magsi, who had probably conspired with the Junior Officer in this
matter, misguided me regarding the procedure for changing the school location. He told
me the wrong method, and as a result, my school has not been shifted to a better and
more populated location and I have been drowned in debt and left utterly wrecked.

There are also some other irregularities and illegal appointments being observed, some
of which can be found in some SEF staff or in regional offices. I am continuing my
efforts to find solid proof for my claim, which I will present before your honour, the
NAB and Anti-Corruption and also some real facts and irregularities related to the
project of the World Bank, which I already been contacted them and they asked to send
such facts, so they will be get soon the reports.

CONCLUSION:

In view of the above facts, it can be seen that the then Regional Officer, Mr. Mahboob
Ali Magsi, and the Junior Officer, Javed Ali Kalhoro, because I refused to give them a share from my
school subsidy or to give them a certain amount of gratification, have conspired against me and have
misguided me regarding the procedure from shifting my schools location. They have also made false
reports regarding my school to the Head Office in order to falsely accuse me and strengthen their own
power. This would be my response to the said allegations and my elaboration on what really took place.
