JUDICIAL AFFIDAVIT OF THE EXPERT WITNESS

Dr. Vladimir Villacorte Villaseor is being presented as an


expert witness and is answering the questions asked of him in his full
conscious state of mind and that he does so under oath and that he
may face criminal liability for false testimony or perjury.

The direct examination is conducted and Recorded by ATTY.


APRIL THEA D. VILLARUZ upon the person of Dr. Vladimir
Villacorte Villaseor, before Notary Public Ayeth V. Laruz on
August 15, 1998 at the A.T. and Associates Law Office, Room 5A,
Utak ng Baguio, Bldg., Session Road, Baguio City.

BACKGROUND OF THE CASE


Marcelo Andawi is a 23 year old single man residing at Atok
Trail, Baguio City, Benguet.

EXPERT WITNESS: DR. VLADIMIR VILLACORTE


VILLASEOR, MD

FACTS TO BE ESTABLISHED:
1. The fact of death of Marcelo Adawi Y. Tanacio.
2. The cause of death is hemorrhage as a result of the stab
wounds.
3. That MARCELO ADAWI Y. TANACIOs death is due to the
stab wounds obtained.

DIRECT EXAMINATION OF THE EXPERT WITNESS

ATTY: (Formal offer of Testimonial Evidence): Your Honor, I would


like to offer the testimony of DR. VLADIMIR VILLACORTE
VILLASEOR, the medico-legal officer who examined the body of
the victim, Marcelo Adawi Y. Tanacio. He will testify on the fact of
death of the victim Marcelo Adawi Y. Tanacio, the extent of the
injuries he incurred, the authenticity, validity and due execution of the
medico legal and autopsy report that DR. VLADIMIR VILLACORTE
VILLASEOR issued in connection with the victims death, and all
other related matters.

PRELIMINARY QUESTIONS

I, VLADIMIR VILLACORTE VILLASEOR, under oath, hereby


answer the following questions asked of me by ATTY. APRIL THEA
D. VILLARUZ, with office address at Rm. 5 Bldg. Nangato Street,
Baguio City. This examination is being held at the witness residence.

Q: Please state your name and profession for the benefit of the court.

A: My name is VLADIMIR VILLACORTE VILLASEOR, a


medical doctor.

Q: Kindly state your educational background leading to your


profession as of this date.

A: I obtained by Bachelor of Science in Biology Degree from the


University of the Philippines Baguio in the year 1971. Thereafter, I
went to medical school in Saint Louis Univerity, graduated in 1975
and passed the medical board exams in 1976. I further continued my
studies and obtained a Masters Degree in Criminal Justice with
specialization in Forensic Medicine from the University of the
Cordilleras in 1980.

Q: What is your current profession?

A: I am the current medico-legal officer of the PNPs Regional Crime


Laboratory Office at Camp Bado Dangwa, La Trinidad, Benguet.
Q: How long have you been practicing your profession as a medical
doctor?

A: For 22 years now starting the year I passed the medical board
examinations.

Q: How long have you been practicing your profession as a medico-


legal officer in the PNPs Regional Crime laboratory?

A: For 17 years now starting 1981.

Q: What do you do as a medico-legal officer in the Crime Laboratory?

A: I conduct external and internal physical examinations of


individuals and I also conduct autopsies on cadavers presented in the
Crime Laboratory.

Q: Can you recall how many cadavers have you examined so far?

A: More or less around 700 cadavers now.

Q: Is this your first time to testify in court?


A: No, this is not my first time.

Q: To the best of your knowledge how many times have you testified
as an expert witness?

A: I have made 123 testimonies as an expert witness as of this date.

Q: Having been stated these information about your years of


experience as a medical doctor and medico-legal officer, can you say
with absolute certainty that you are qualified to testify as an expert
witness to attest the cause of the death of Marcelo Tanacio?

A: Yes, I am.

DIRECT EXAMINATION PROPER

Q: Were you tasked to perform the autopsy on the body of the victim
Marcelo Adawi Y. Tanacio?
A: Yes, as the medico-legal officer, I was tasked to examine the
cadaver of Marcelo Adawi Y. Tanacio.
Q: Where did you examine the cadaver of Marcelo Adawi Y.
Tanacio?
A: I examined the victims body at the morgue of La Funenaria Paz
located at No.79 Naguillan Road, Baguio City.

Q: When did you examine the body? Kindly recall the exact date and
time of the examination.
A: I examined the body at 1:30 in the afternoon of August 10, 1998.

Q: Was that the first time for you to see the body of Mr. Marcelo
Adawi Y. Tanacio?
A: Yes.

Q: Can you please discuss the examination you conducted on the


body.
A: I conducted a post-mortem examination of the body to determine
the cause of death.

Q: What were your findings?


A: My findings are as follows:

-The body is that of a fairly developed, fairly nourished Filipino


male measuring 160 cm in height.
-There is a fully developed rigor mortis in the face, with post-
mortem lividity at the dependent portions of the body. Conjuctive, lips
and nails are pale.
-The body obtained six injuries; and
-There are about 2,000cc of blood and blood clots accumulated
in the thoracic cavity.

Q: Doctor, based on your findings, may you specify to us what those


injuries are Doctor?
A: I have noted 6 injuries.

The first, which is labeled as Injury no. 1 in the Autopsy


Report is a stab wound, in the left infra-mammary region, measuring
4.5x1.5cm, from the anterior midline, 11cm deep, directed
posteriorwards, slightly downwards and medialwards.
The second injury, which is labeled as injury no. 2 in the
Autopsy Report is a stab wound in the left infra-mammary region,
measuring 3.5x1.2cm from the anterior middle line, 11cm deep,
directed posteriorwards, slightly upwards and medialwards passing
thru the 6th left intercostal space.

The third injury, which is labeled as injury no. 3 in the


Autopsy Report is a stab wound on the left shoulder measuring
6.5x6cm, 13cm from the anterior midline, with 10 stitches applied.

The fourth injury, which is labeled as injury no. 4 in the


Autopsy Report is a stab wound in the middle 3rd of the left thigh,
measuring 4.5x2cm, 3cm from the anterior midline, 8cm deep,
directed posteriorwards, upwards and medialwards.

The fifth injury, which is labeled as injury no. 5 in the Autopsy


Report refers to linear abrasion, left lateral aspect of the neck,
measuring 1xo.4cm, 4cm from the anterior midline.

The sixth injury refers to linear abrasion, anterior aspect of the


neck, measuring 0.5x0.2cm, 3cm from the anterior midline.

Q: Doctor, Can you explain the effects of these stab wounds?


A: Yes, sir.

1. The first stab injury results in fracturing the left 6 th thoracic


vertebra, lacerating the left dome of the diaphragm and left
lobe of the liver, with 4 stitches applied;

2. The second results in lacerating the lower lobe of the left


lung, pericardial sac and the apex of the heart, with 2
stitches applied;

3. The third injury had to apply ten stitches due to the stabbing
incident; and

4. The fourth injury results lacerating the underlying soft


tissues and muscles.

These stab wounds have caused blood clots in the thoracic cavity and
about 2,000cc of bloods were accumulated.

Q: Based on your findings doctor, what is the cause of the death of


Marcelo Andawi?
A: The cause of death sir is hemorrhage as a result of stab wounds in
the body.
Q: Doctor, you said a while ago that there is an Autopsy Report.
A: Yes sir.

Q: And where is the Autopsy Report?


A: It is currently in my possession at this moment, sir.

Q: Is the signature affixed in the autopsy report your signature doctor?


A: Yes, the signature affixed in the autopsy report of Mr. Marcelo
Andawi is my signature.

Q: Are you the same Dr. Vladimir Villacorte Villaseor, the Medico-
Legal Officer who conducted the autopsy in this case?
A: Yes, sir.

Q: Am I permitted in marking this autopsy report as Exhibit A and


the bracketed signature above the name of Dr. Vladimir Villacorte
Villaseor as Exh. A-1?
A: Yes sir.

Q: I am attaching Exhibit A to your judicial affidavit to form part of


it. Do you confirm my action?
A: Yes, sir.

Q: I have no more questions to ask of you unless there is anything


youd like to add.
A: None, sir.
