1. American OT Assoc. (AOTA) assure the health & safety of that state - Has greatest jurisdiction - Specific responsibility: protect the public form - Voluntary membership orgs potential harm that might be caused by - Has no direct authority over practitioners who are incompetent of unqualified practitioners NOT members - May be in form of licensure, registration or - No direct legal mechanism to preventingnon- certification members who are incompetent, unethical or - Legal guidance usually specify the scope of unqualitfied from practicing practice of the profession & qualifications that must - Commission of Standards & ethics (SEC) be met o Code of Ethics - Provides description of ethical behaviour o Standards for Accredited Educational Program - Limited jurisdiction for the OTist - Have authority to discipline members o Standards for Accredited Educational Program - Sanctions: for the OTA o Public Censure o Standards of Practice for OT o Temporary suspension of practice - Responsible for informing & educating members previlieges about: o Permanent prohibition from practice in o Ethical issues that state o Upholding the practice & education standards o Monetary fee of the profession monitoring the behaviour of members WHERE TO GO FIRST: o Reviewing allegations of unethical conduct - Can restrict or prohibit the individual’s ability to - Contact SRB 1st participate as a full member in the professional - If state has no SRB, find out if OT is AOTA assoc. member. - If complaint is filed, Ethics Officer acts preliminary o If so, contact AOTA & NBCOT o If not, contact NBCOT only investigator → SEC reviews info gathered as part of preliminary investigation → if there is sufficient The Disciplinary Action Information Exchange (DAIEN) evidence, complaint is forwarded to judicial - Communication network established by AOTA, council→ if guilty, there are several levels of NBCOT & SRBs sanction depending on severity of the infraction, - Notifies the other orgs when any axn is taken including: against OT practitioner The Info Exhange o Reprimand – a privately communicated - NBCOT’s quarterly newsletter expression of disapproval of conduct - Published DAIEN’s master list of names who have been reported by NBCOT, AOTA & SRBs o Public Censure – a formal expression of disapproval that is public WHO TO CALL: o Temporary suspension of membership 1.
