Covers all agricultural lands granted by the State in favor
of the grantee by virtue of a Law or a Proclamation by the President of the Philippines for purposes authorized PURPOSE OF ISSUANCE OF SPECIAL PATENT Limited to public uses/purposes and those stated in the law such as: Charitable or other similar purposes run or administered by the government or any of its branches and instrumentalities
Public cemetery, municipal halls, public plazas or parks and
other government institutions for public use or public purpose TO WHOM SPECIAL PATENT IS ISSUED
Shall be issued in favor of:
Republic of the Philippines, its agencies, branches and instrumentalities; and Local government units (LGUs) such as provinces, cities and municipalities PROCEDURE Appendix D. All request for issuance of Special Patent over lands actually occupied and used for municipal hall, public plazas or parks and other government institutions for public use or purpose under Section 4 of RA 10023 should be filed within the CENR Office 1. Posting of Notice within 15 days upon receipt of request 2. For investigation, ocular inspection 3. Conduct of survey and prepare plan and technical description 4. In case the government site has no approved survey, the CENR Office shall issue a Survey Authority / order to requesting party or DENR Survey Unit for the survey of parcel 5. In case of oppositions arising from the SP request, the CENR Office shall fast track the resolution using the Alternative Dispute Resolution (ADR) mechanism 6. The CENR Officer shall receive the opposition or make a recommendation within 30 days from the filling of such opposition REQUIREMENTS: There is no need to proclaim the land and a Special Patent shall be issued directly For the APPLICANT: Local Government Unit For the Department of Environment and Written request by Requesting Party Natural Resources (DENR):
