ABSTRACT

HAJI ALI, SHANI SHINGNAPUR AND SABARIMALA

(Restriction of women vis--vis Feminist Jurisprudence)

SYNOPSIS
Temple or Dargah restrictions on women are nothing but ways of imposing patriarchy. This
project seeks to bring out the restrictions that women face in their entries to temples and
dargahs which is explained by drawing comparison on Gender equality vs Religious freedom.
The project has been made as a comparative analysis between The Haji Ali Dargah and
The Shani Shingnapur and The Sabarimala Temples which prohibits women on the basis of
customs and traditions relating to impurity and sexuality. The analysis has been made with a
Feminist view of Jurisprudence stating that A tradition that prevents women into temples
and dargahs needs to be changed. This project also brings out the ideas of various Feminist
jurists and their ideologies of rethinking the manmade law embedded in our legal system and
also how Feminist theory is an integral part of Jurisprudence. Further the project also
discusses the present day situations of the above said temples and dargahs and also how the
Indian legal system or the judiciary has looked into this issue.
