The role of confidentiality in schools Protecting students is more important than protecting
confidentiality. Schools roles are to not share social security of students, grades, and personal
contributes to their lives.
FERPA The Family Educational Rights and Privacy Act. It protects the privacy of student
education records.
IDEA The Individuals with Disabilities Education Act. Focuses on students rights and
responsibilities of public school to children with disabilities.

IEP Individualized Education Program. It helps kids succeed in school.
FAPE Free Appropriate Public Education. It is an education right of children with disabilities in
the U.S. that is guaranteed by the Rehabilitation Act.
Due Process It prohibits the government from depriving a person of their right to liberty or
property with due process.
Who can request Educational Records If you are under the age of 18, only your parent or
guardian has the legal right under FERPA to inspect and review your education records. You
can ask someone else to view my education records for you.
Consequences of not obeying confidentiality - Department of Educational will notify the school
of the violations and then demand specific changes to bring the school into compliance. If a
school refuses to comply, only then will the Department of Education consider removing all or
part of the funding provided to the school. The school will usually comply with the demanded
changes to keep its financing in place.
o Government investigation, damage to reputation, loss of federal funding, law may be
changed to provide for monetary fines.

I thought Mr. Clay Fulghum coming in this morning to talk to us was very insightful. However, its almost
scary to think that we teachers and the district can get in so much trouble. Walking into this class I
thought it was normal for teachers to talk, which it is, but its exactly not right. Teachers still talk about
students even though they know about FERPA. FERPA stands for The Family Educational Rights and
Privacy Act. It protects the privacy of student education records. One thing that was definitely a no-
brainer was protecting students is more important than protecting confidentiality. Schools roles are to
not share social security of students, grades, and personal contributes to their lives. What kind of
surprised me was the fact that FERPA includes social security numbers when I dont even know my social
on the top of my head, let alone other students. Hearing Mr. Clay Fulghum give us scenarios, it started
to hit home. The fact that biological parents, even if you are legal with someone else, can request
education records is eerie. I guess it is their right but still... Continuing with FERPA, I learned that only
your parents or guardian has the legal right under FERPA to inspect and review your education records. I
didnt realize how big of a deal it was. With that, you can ask someone else to view my education
records for you. Consequences for breaking FERPA can include government investigation, damage to
reputation, loss of federal funding, and the law may be changed to provide for monetary fines. Usually,
Department of Education considers removing all or part of the funding provided to the school but then
the school will usually comply with the demanded changes to keep its financing in place. Overall, it was a
great, well-informed presentation.
