DEED OF SELF ADJUDICATION WITH PARTITION OF A PARCEL OF

LAND AND ABSOLUTE SALE OF A PORTION

PRESENTS:

We, CRESENCIO ABULUYAN BASILIO, married to Thelma Asuncion-


Basilio, of legal age, Filipino citizen and a resident of Brgy. No. 11 San Nicolas, Ilocos
Norte, and Heirs of FRANCSICO U. ABULUYAN, represented by THELMA A.
BASILIO, by virtue of a Special Power of Attorney executed by Victorina Abuluyan
with Doc No. 463, Page No. 93, Book No. XI Series of 2006, notarized by Atty. Luciano
R. Caraang, resident of Brgy. 5, San Nicolas, Ilocos Norte, hereinafter called the
ADJUDICATEES;

WITNESSETH

That MARIA U. ABULUYAN, FRANCISCO U. ABULUYAN and


GENEROSA ABULUYAN-BASILIO were siblings and all died intestate o n A p r i l
1 0 , 2 0 0 7 , A p r i l 7 , 2 0 0 5 a n d J u n e 0 1 , 2 0 1 5 at S a n N i c o l a s , I l o c o s
N o r t e , Wa i p i o , H a w a i i a n d L a o a g C i t y ,respectively, leaving a certain
property more particularly described and bounded as follows:

A parcel of land bearing Lot No. 20609, CAD 307-D, VLT, situated at Brgy.
21, San Agustin, San Nicolas, Ilocos Norte, Philippines. Bounded on the NE, points
10-11-12 by Lot 20615 and points 12-13 by Lot 20543; on the SW points 13-14 by
Lot 20563; points 14-15 by Lot 20606 and points 15-16-17-18-1 by Lot 20608; on
the SW, points 1-2-3-4 by Lot 20610; and on the NW points 4-5 by Lot 20612; points
5-6 by Lot 20614; points 6-7 by Lot 20950; points 7-8-9 by Lot 20614 and points 9-
10 by Lot 20617, all of CAD 307-D.

1962.
That the above-named parties are the surviving heirs of the late MARIA
U. ABULUYAN, GENEROSA ABULUYAN-BASILIO and FRANCISCO U.
ABULUYAN;

That there are no known debts or obligation due against the estate of said
decedent and the above-described property is free from liens and encumbrances; and

That it is to be the best interests of the parties hereto to divide and partition and
adjudicate among themselves the entire estate extra judicially, pursuant to the
provisions of Section 1, Rule 74 of the Rules of Court;

That the Heirs of Francisco U. Abuluyan waive their rights to the property of
Maria U. Abuluyan in favor to the Heir of Generosa A. Basilio thus said property is to
be divided to the remaining heirs;

WITNESSETH FURTHER

That the said Parties have caused the subdivision of the aforesaid parcel of land
into Two (2) lots, more particularly described as Lot A, and Lot B, containing an area
of Seven Thousand Eight Hundred Eigthy Three (7,883.00) square meters and
Three Thousand Nine Hundred Forty (3,940.00) square meter, respectively, in the
subdivision plan ____________________________________ which was duly
approved by _________________________________________

That the above Parties have agreed and covenanted, as by these Presents, do
hereby agree and covenant, that Lot A as above described shall appertain and belong to
CRESENCIO A. BASILIO, his heirs and assigns, and that Lot B as likewise above
described, shall appertain and belong to the Heirs of FRANCISCO U. ABULUYAN,
his heirs and assigns.

That in view of the foregoing premises, CRESENCIO A. BASILIO, hereby by


these presents adjudicate unto himself the above-described real estate property,
designated as Lot No. A, containing an area of Seven Thousand Eight Hundred
Eigthy Three (7,883.00) square meters, subject to Sections 1 and 4, Rule 74 of the
Rules of Court in and such other pertinent provisions applied by law;

WITNESS FURTHER, that I, CRESENCIO A. BASILIO, for and in


consideration of the sum of ________________________________________________,
(Php ________________) Philippine Currency, to me in hand paid to my entire
satisfaction by Venvi Agro Industrial Ventures Corporation, a Corporation duly
organized and existing under the Laws of the Republic of the Philippines with postal
address at Suite 806 8th Floor Globe Telecom Plaza, Pioneer Highlands Bldg., Pioneer St.,
Cor. Madison St., Mandaluyong City, represented herein by its Chairman, ATTY.
HILARIO P. VALDEZ, of legal age, Filipino citizen, married to Ma. Catalina Charity V.
Valdez, and with postal address at Brgy. No. 21 San Agustin, San Nicolas, Ilocos Norte,
the herein VENDEE;

Do hereby SELL, CEDE, TRANSFER and CONVEY the said parcel of land
designated as Lot No. A, of PSD No. __________________________ containing an area
of Seven Thousand Eight Hundred Eigthy Three (7,883.00) square meters in a
manner absolute and irrevocable unto the said VENDEE, its heirs and assigns, executors
or administrators the above-described parcels of land under the following terms and
conditions:

That I have therefore the right to dispose the same, free from all liens, charges and
encumbrances whatsoever and that I shall warrant and forever defend the rights and title
so conveyed unto the said VENDEE;
That the provisions of the New Civil Code and the Agrarian Reform Law
regarding the notification of adjacent owners and possible redemptioners and pre-
emptioners have been duly complied with and that the properties are not TENANTED;
That this instrument shall be registered with the Office of the Provincial Register
of Deeds of Ilocos Norte District I, Laoag City, in accordance with the provisions of Land
Registration Act 3344 and Registration Act 496 as amended.
IN WITNESS WHEREOF, we have hereunto sign this instrument

20609 situated at Brgy. No. 21, San Agustin, San Nicolas Ilocos Norte signed by the
herein VENDOR-ADJUDICATEE together with their instrumental witnesses in favor
of Venvi Agro Industrial Ventures Corporation. That the VENDOR-
ADJUDICATEES hereto are Filipino citizens and the Corporation is fully owned by
Filipino citizen.
