Sangguniang Bayan Office

INTRODUCTION

The Republic Act No. 7160 otherwise known as The Local Government Code of 1991
states among others the duties, functions and responsibilities of the Sangguniang Bayan to wit:

The Sangguniang Bayan, as the legislative body of the municipality, shall enact
ordinances, approve resolutions and appropriate funds for the general welfare of the
municipality and its inhabitants pursuant to section 16 of this Code and in the proper
exercise of the corporate powers of the municipality as provided for under section 22 of
this Code (Art. 3, Sec. 447)

It is in this premise that the Sangguniang Bayan of Narra owes its existence and from the
delegated legislative powers conferred by the Congress of the Philippines to wit:

Local legislative bodies exercise only delegated legislative powers conferred on them by
Congress. As mere agents, local governments are vested with the power of subordinate
legislation. (MAGTAJAS VS. PRYCE PROPERTIES AND PAGCOR, (en banc July 20,
1994)

In this paper, we will analyze the organization, structure and personnel that compose the
Sangguniang Bayan of Narra in the attainment of its mandates as prescribed in the Local
Government Code of 1991.

VISION, MISSION, OBJECTIVES

VISION OF THE MUNICIPALITY OF NARRA:

For the Municipality of Narra to be the Agri-Business and Eco-Tourism Center in Palawan with
Disaster-resilient, Safe and Drug-free community, Empowered People, Effective and Transparent
Governance and Progressive Economy supported by Well-Developed Infrastructure Facilities and
Utilities in an Ecologically-Balanced Environment.

MISSION OF THE SANGGUNIANG BAYAN:

Our mission is to enact ordinances approved resolution and appropriate funds for the general
welfare and to support the attainment of the Executive Agenda, to generate and maximize the
use of resources and revenues for the development plans, programs, objectives and priorities
and ensure the efficient and effective delivery of the basic services and facilities in pursuit of the
visions and missions of the different departments in the attainment of a self-reliant community.

OBJECTIVE OF THE SANGGUNIANG BAYAN:

To enact/ adopt legislative measures for the general welfare of its constituents with DARE (Desire
to Act Responsibly with Excellence) thru the use of innovation, appropriate strategies, research
and human resource development in the performance of its mandates guided by the CRIS
(Credibility, Respect, Integrity and Sincerity) Advocacy.

SECTORAL/SUB-SECTORAL OBJECTIVES:
To enact/ adopt legislative measures which will support revenue generation, and the
realization of the envisioned Municipality of Narra as Agri-Business and Eco-Tourism
Center of Southern Palawan;
To enact/ adopt legislative measures which will support our IPs, maintenance of peace
and order and safety of our constituents, health and nutrition, environmental protection,
and construction of necessary infrastructure projects, public utilities and facilities;
To increase the level of accomplishment in adopting and enacting legislative measures in
support of the Executive Legislative Agenda (ELA) from 70% to 80%;
To increase the participation of stakeholders in legislation; and
To strengthen its Oversight Functions.

SANGGUNIANG BAYAN ORGANIZATIONAL STRUCTURE

The Sangguniang Bayan Office is composed of three (3) different offices with
corresponding functions, duties and responsibilities as prescribed by the Local Government Code
of 1991 and its primary functions as to LEGISLATION, REPRESENTATION and OVERSIGHT.
The following are the different offices which respond to such functions.

VICE MAYORS OFFICE:


The Vice Mayor is the head of the Legislative Department or the Sangguniang Bayan. He
has the following functions as provided for by the Local Government Code (Art. 2, Sec. 445) to
wit:

(1) Be the presiding officer of the Sangguniang Bayan and sign all warrants drawn on the
municipal treasury for all expenditures appropriated for the operation of the
Sangguniang Bayan;
(2) Subject to civil service law, rules and regulations, appoint all officials and employees
of the Sangguniang Bayan, except those whose manner of appointment is specifically
provided in this Code;
(3) Assume the office of the municipal mayor for the unexpired term of the latter in the
event of permanent vacancy as provided for in section 44, Book I of this Code;
(4) Exercise the powers and perform the duties and functions of the municipal mayor in
cases of temporary vacancy as provided for in section 46, Book I of this Code; and,
(5) Exercise such other powers and perform such other duties and functions as may be
prescribed by law or ordinance.

SANGGUNIANG BAYAN OFFICE:


As provided for by the Local Government Code (Art. 3, Sec. 446) The Sangguniang
Bayan, the legislative body of the municipality, shall be composed of the municipal vice-mayor as
the presiding officer, the regular sanggunian members, the president of the municipal chapter of
the liga ng mga Barangay, the president of the pambayang pederasyon ng mga Sangguniang
Kabataan, and the sectoral representatives, as members.

In addition thereto, there shall be three (3) sectoral representatives: one (1) from the
women; and, as shall be determined by the sanggunian concerned within ninety (90) days prior
to the holding of local elections, one (1) from the agricultural or industrial workers; and one (1)
from the other sectors, including the urban poor, indigenous cultural communities, or disabled
persons. (Art. 3, Sec. 446 (b))

SANGGUNIANG BAYAN SECRETARY:


In the same manner, the Local Government Code (Title 5, Art. 1, Sec. 469) provides that:

(a) There shall be a Secretary to the sanggunian who shall be a career official with the
rank and salary equal to a head of department or office.

(b) The Secretary to the sanggunian shall take charge of the office of the Secretary to
the sanggunian.

SANGGUNIANG BAYAN UNITS:


The Sangguniang Bayan in response to its primary functions of LEGISLATION,
REPRESENTATION and OVERSIGHT, designed different sections or units to respond to such
functions they are as follows:

LEGISLATIVE UNIT
The Legislative Unit deals with the legislative function of the Sangguniang Bayan. It
focuses on matters needed for Regular/ Special Session which includes but not limited to:
preparation of Order of Business, Transcribing Minutes and Journal of Proceedings, Preparation
of Resolutions and Ordinances, and other matters to be included in the conduct of the session.

COMMITTEE MATTERS UNIT


Committee Matters Unit focuses on activities being done by the Standing Committees of
the Sangguniang Bayan. Its serve as the main support staff during Committee Meetings and
Public Hearings. Involves in the preparation of Committee Agenda, Notices of Invitation for
Committee Meetings and Hearings, Minutes of Committee Meetings/ Public Hearings and
Committee Reports, and other activities being done by the Standing Committees of the
Sangguniang Bayan.

RECORDS MANAGEMENT AND ARCHIVES UNIT


Records and Archival Unit focuses on records management and development of the
Sangguniang Bayan Office. It is a centralize system which manages all the records of the
Sangguniang Bayan both printed documents and electronically generated data. It is also task to
develop the archival system of the Sangguniang Bayan.

ADMINISTRATIVE UNIT
Administrative Unit deals with its administrative function including: financial management
of the office, individual official business transactions of the Sangguniang Bayan Members, the
Vice-Mayor and SB Secretariat, processing of financial assistance, vouchers, liquidations, cash
advances and travel orders, office supplies and materials, maintenance of office equipment and
vehicles, maintaining personal records of the Sangguniang Bayan.

TRICYCLE FRANCHISE UNIT


Tricycle Franchise Unit deals with the issuance of Tricycle Franchise from applications,
processing and issuance. Subject to the guidelines prescribed by the Department of
Transportation and Communications, the Sangguniang Bayan is given the power to regulate the
operation of tricycles and grant franchises for the operation thereof within the territorial jurisdiction
of the municipality.

AD-HOC UNITS
The Sangguniang Bayan in upholding its Oversight Function, created ad-hoc units that will
respond to its power to oversee and enact research-based ordinances vital to the delivery of basic
services to its constituents to wit:

Backstopping Secretariat
The power of legislative oversight of the Sanggunian is correlated with the power of the
sanggunian to enact ordinance. It is well-settled that the power to enact an ordinance includes
the power to amend or repeal the same. The oversight function of the sanggunian refers to the
power of the sanggunian to oversee that the ordinances it enacted are effectively, adequately and
efficiently implemented.

Research and Development Unit


In realizing its primary function of enacting and adopting legislative measures and its
objective of enacting/ adopting legislative measures for the general welfare of its constituents
with DARE (Desire to Act Responsibly with Excellence) The Sanggunian created its Research
and Development Unit in producing research-based legislative measures. This is done through
surveys, research and linkages with community college in the realization of its objective.
