PERMANENTALIENATIONOFLAND

3. Sanction of [Collector] required to certain permanent alienations. (1) [Save as hereinafter
provided a] person who desires to make a permanent alienation of his land shall be at liberty to make such
alienationwhere
(a)thealienorisnotamemberofanagriculturaltribeor

(c)thealienorisamemberofanagriculturaltribeandthealieneeisamemberofthesametribeorofa
tribeinthesamegroup.

(1)sanctionmaybegivenaftertheactofalienationisotherwisecompleted,and
(2)sanctionshallnotbenecessaryinthecaseof
(a)asaleofarightofoccupancybyatenanttohislandlord,or
(b)agiftmadeingoodfaithforareligiousorcharitablepurpose,whetherintervivosorbywill].

(3)The [Collector]shallinquireintothecircumstancesofthealienationandshallhavediscretionto
grantorrefusethesanctionrequiredbysubsection(2).

[3A.Sanctionof [Collector]requiredforanalienationtoanagriculturistcreditorincertaincases.
[36]
Exceptwiththesanctionofthe [Collector]asprovidedforinthisAct,nomemberofanagriculturaltribeshall
[37]
make [analienation]ofhislandtoamemberofthesametribeorofatribeinthesamegroupwhobeinga
creditorhasadvancedtosuchpersonanyloan,untilsuchloanhasbeenrepaidorsettledinfullbythedebtoranda
[38]
periodofthreeyearshaselapsedsincerepaymentofsettlementprovidedthatifthe [Collector]aftermaking
[39]
suchenquiriesfromthepartiesconcernedasmaybeprescribedinthisbehalfbythe [BoardofRevenue]finds
thatanalienationhasbeenmadebyadebtortoapersonotherthanhiscreditortheeffectofwhichistopassthe
beneficialinteresttosuchcreditorinevasionoftheprovisionsofthissection,heshall,afterrecordinghisreasons
byorderinwritingdeclarethealienationvoidandshallejectanypersoninoccupationofthelandbyvirtueof
suchalienationandshallplacethealienorinpossessionthereof.
ExplanationInthissection
[40]
[(1) An alienation means a permanent alienation or an alienation in any form other than those
permittedbysection6ofthisAct].
(2)Thetermcreditormeansapersonorafirmcarryingonthebusinessofadvancingloansandshall
includethelegalrepresentativeandthesuccessorininterestwhetherbyinheritance,assignmentor
otherwise,ofsuchpersonorfirm.
(3)Thetermscreditoranddebtorshallbedeemedtoincludetheirhusbandsorwivesasthecasemaybe
and all persons (including their husbands or wives as the case may be) who are descended from the
grandfatherofsuchcreditorordebtorasthecasemaybe.
(4)Thetermloanmeansanadvancewhethersecuredorunsecuredofmoneyorinkindatinterest[as
defined in section 2(6) of the Punjab Regulation of Accounts Act, 1930 (I of 1930)] and shall

includeanytransactionwhich [thecourtorthe [Collector],asthecasemaybe]findstobein
substancealoan,butitshallnotinclude
(i)anadvanceinkindmadebyalandlordtohistenantforthepurposesofhusbandryprovided
the market value of the return in kind does not exceed the market value of the advance as
estimatedatthetimeoftheadvance
(ii)adepositofmoneyorotherpropertyinaGovernmentPostOfficeBank,oranyotherBank,
orwithaCompany,orwithaCooperativeSocietyorwithanyemployerassecurityfromhis
employees
(iii)aloanto,orby,oradepositwithanysocietyorassociationregisteredundertheSocieties

RegistrationAct,1860 ,orunderanyotherenactment

(iv)aloanadvancedbyortothe CentraloranyProvincialGovernmentorbyortoanylocal

bodyundertheauthorityofthe CentraloranyProvincialGovernment

(vii)an advance made on the basis of a negotiable instrument as defined in the Negotiable

InstrumentsAct,1881 ,otherthanapromissorynote.
(5)ThetermsBank,Company,CooperativeSocietiesandTradersshallhavethesamemeaningsas
[48]
areassignedtotheminsection2ofthePunjabRegulationofAccountsAct,1930 ].

[3B.Ejectmentofalienee.Incaseofanyresistancetoanorderofejectmentpassedundertheprovisions
[50]
ofsection3A,the [Collector]mayexerciseallthepowersconferredonaCivilCourtbyrules97and98of
OrderXXIoftheCodeofCivilProcedure.

3C.Appeal.Anypersonaggrievedbyanorderofthe [Collector]undersection3Aorsection3Bmay
[52]
appealtothe [Commissioner],providedthatnoappealshalllieunlesstheappealisinstitutedwithinthirty
daysoftheorderappealedagainst,excludingdaysrequiredforobtainingcopiesoftheorder].

4.Agriculturaltribes.(1)The [BoardofRevenue]shall,bynotificationinthe [OfficialGazette], [**
*]determinewhatbodiesofpersonsinanydistrictorgroupofdistrictsaretobedeemedtobeagriculturaltribesor
groupsofagriculturaltribesforthepurposesofthisAct.

[(2)Ifanyquestionordoubtshouldariseastowhetherapersonisorisnotamemberofanotified
[57]
agricultural tribe, the [Collector] shall, after such enquiry as may be prescribed, determine whether that
personistobedeemedtobeamemberofthesaidagriculturaltribeforthepurposesofthisAct.
[58]
(3)Inpassinganorderundertheabovesubsectionthe [Collector]shallnotbeboundbyanydecreeof
aCivilCourt,andmayreviewanyorderpreviouslypassedunderthatsubsection:
Providedthatnothinginthissectionshallaffectadecreepassedinasuitinstitutedbeforethe15thJune,
1938].

5.Savingforrightsinlandalienated.Whena [Collector]sanctionsapermanentalienationofland,his
ordershallnotbetakentodecideoraffectanyquestionoftitle,oranyquestionrelatingtoanyreversionary
rightorrightofpreemption.

TEMPORARYALIENATIONOFLAND
6.Formsofmortgagepermittedincertaincases.(1)Ifamemberofanagriculturaltribemortgageshis
landandthemortgageeisnotamemberofthesametribe,orofatribeinthesamegroup,themortgageshallbe
madeinoneofthefollowingforms:
(a)intheformofausufructuarymortgage,bywhichthemortgagordeliverspossessionofthelandto
themortgageeandauthoriseshimtoretainsuchpossessionandtoreceivetherentsandprofitsofthe
landinlieuofinterestandtowardspaymentoftheprincipal,onconditionthataftertheexpiryofthe
termagreedon,or(ifnotermisagreedon,orifthetermagreedonexceedstwentyyears)afterthe
expiryoftwentyyears,thelandshallberedeliveredtothemortgagoror
(b)intheformofamortgagewithoutpossession,subjecttotheconditionthat,ifthemortgagorfailsto

payprincipalandinterestaccordingtohiscontract,themortgageemayapplytothe [Collector]to
[61]
place him in possession for such term, not exceeding twenty years, as the [Collector] may
considertobeequitable,themortgagetobetreatedasausufructuarymortgageforthetermofthe
mortgageespossessionandforsuchsumasmaybeduetothemortgageeonaccountofthebalance
ofprincipaldueandofinterestduenotexceedingtheamountclaimableassimpleinterestatsuchrate
[62]
andforsuchperiodasthe [Collector]thinksreasonableor
(c)intheformofawrittenusufructuarymortgagebywhichthemortgagorrecognisesthemortgageeas
a landlord and himself remains in cultivating occupancy of the land as a tenant subject to the
payment of rent at such rate as may be agreed upon not exceeding sixteen annas per rupee of the
amountofthelandrevenueinadditiontotheamountofthelandrevenueofthetenancyandtherates
andcesseschargeablethereonandforsuchtermasmaybeagreedon,themortgagorhavingnoright
to alienate his right of cultivating occupancy and the mortgagee having no right to eject the

mortgagorunlessonthegroundsmentionedinsection39ofthePunjabTenancyAct,1887 or
[64]
(d)inanyformwhichthe [BoardofRevenue]may,bygeneralorspecialorder,permittobeused.
(2)Ifinthecaseofamortgageinform(c)themortgagorisejectedorrelinquishesorabandonscultivating
occupancy of the land, the mortgage shall take effect as a usufructuary mortgage in form (a) for such term not
exceedingtwentyyearsfromthedateofejectment,relinquishmentorabandonment,andforsuchsumofmoneyasthe

[Collector]considerstobereasonable.

[(3)The [Collector],ifheacceptstheapplicationofamortgageeundersubsection(1)(b)shallhavepower
toejectthemortgagor,andasagainstthemortgagortoplacethemortgageeinpossession].

7.Rulesapplyingtopermittedmortgages.Inthecaseofmortgagesmadeundersection6
(1)nointerestshallaccrueduringtheperiodforwhichthemortgageeisinpossessionofthelandorin
receiptofrent
(2)ifthemortgageisinform(a)orform(b),thenattheendofsuchperiodofpossessionthemortgagedebt
shallbeextinguished
(3)themortgagormayredeemhislandatanytimeduringthecurrencyofthemortgage,onpaymentofthe
mortgagedebtor,inthecaseofamortgageinform(a)orform(b),ofsuchproportionofthemortgage
[68]
debtasthe [Collector]determinestobeequitableand
(4)inthecaseofausufructuarymortgage,themortgagorshallnotbedeemedtobindhimselfpersonallyto
repaythemortgagemoney

[(5) if a mortgagor who has applied to the [Collector] under subsection (3) proves to the
[71]
satisfaction of the [Collector] that he has paid the mortgagedebt or such proportion of the
[72] [73]
mortgagedebt as the [Collector] has determined to be equitable, or deposits with the
[Collector]theamountofsuchmortgagedebtorofsuchproportionthereof,theredemptionofthe
[74]
land shall be deemed to have taken place, and the [Collector] shall have power to eject the
mortgagee,ifinpossession,andasagainstthemortgageetoplacethemortgagorinpossession].

8.Conditionsinpermittedmortgages.(1)Inamortgagemadeundersection6,thefollowingconditions
maybeaddedbyagreementbetweentheparties:
(a)a condition fixing the time of the agricultural year at which a mortgagor redeeming his land may
resumepossessionthereof
(b)conditionslimitingtherightofamortgagorormortgageeinpossessiontocut,sellormortgagetrees
ortodoanyactaffectingthepermanentvalueofthelandand

(c) any condition which the [Board of Revenue] by general or special order may declare to be
admissible.
(2)Inmortgagesmadeundersection6anyconditionnotpermittedbyorunderthisActshallbenulland
void.

[76]
[8A.Injurytolandnotpermitted.Theexpresspermissioninwritingofanowneroflandattestedbyarevenue
officershallbenecessaryinordertoenableamortgageeorlesseeorpersonholdingafarmthereof,tocommitanyact
which is destructive of, or permanently injurious to, the land for purposes of agriculture and no court, or Official
Receiveractingorpurportingtoactonbehalfoftheowner,shallbeempoweredtogivesuchpermissionwithoutthe
consentinwritingoftheowner,ortheinsolvent,asthecasemaybe.
ExplanationThewordownerinthissectionshallincludeanyotherpersonauthorisedbylawtoactin
thisbehalf].

9.Powertorevisemortgagemadeinformnotpermitted.(1)Ifamemberofanagriculturaltribemakesa
[77]
mortgageofhislandinanymannerorformnotpermittedbyorunderthisAct,the [Collector]shallhaveauthority
toreviseandalterthetermsofthemortgagesoastobringitintoaccordancewithsuchformofmortgagepermitted
byorunderthisActasthemortgageeappearstohimtobeequitablyentitledtoclaim.
(2)IfamemberofanagriculturaltribehasbeforethecommencementofthisActmadeamortgageofhislandin
[78]
whichthereisaconditionintendedtooperatebywayofconditionalsale,the [Collector]shallbeempoweredatany
time during the currency of the mortgage to put the mortgagee to his election whether he will agree to the said
conditionbeingstruckout,ortoacceptinlieuofthesaidmortgageamortgagewhichmayatthemortgageesoptionbe
eitherinform(a)orinform(b)aspermittedbysection6andwhichshallbemadeforsuchperiodnotexceedingthe
[79]
periodpermittedbythesaidsectionandforsuchsumofmoneyasthe [Collector]considerstobereasonable.
(3) If proceedings for the enforcement of a condition intended to operate by way of conditional sale are
institutedorarependingatthecommencementofthisActinanyCivilCourt,orifasuitisinstitutedinanyCivil
[80]
Court on a mortgage to which subsection (1) or subsection (2) applies the Court shall refer the case to the
[Collector]withaviewtotheexerciseofthepowerconferredbythesubsectionapplyingthereto.

[(4) When a mortgagee put to his election under subsection (2) agrees to accept in lieu of his
mortgage,amortgageinform(a)orinform(b)aspermittedbysection6fortheperiodandforthesumofmoney
[82]
consideredbythe [Collector]tobereasonable,andthemortgagorcannotbefound,orfailstoappearwhen
[83]
dulyservedwithnoticetodoso,orrefusesorneglectstoexecutesuchmortgagethe [Collector]shallhave
authoritytoexecutesuchmortgageonsuchtermsastocostsashemayfix,andthemortgagesoexecutedshall
[84]
haveeffectasifithadbeenexecutedbythemortgagor.The [Collector]mayforanyreasonwhichhedeems
sufficientsetasideanyexparteproceedingstakenunderthissubsection].

10. Future mortgage by way of conditional sale not permitted. In any mortgage of land made after the
commencementofthisActanyconditionwhichisintendedtooperatebywayofconditionalsaleshallbenulland
void.

11.Leasesandfarms.Anymemberofanagriculturaltribemaymakealeaseorfarmofhislandforany
termnotexceedingtwentyyears,andanyleaseorfarmmadebyamemberofanagriculturaltribeforalonger
termthantwentyyearsshall,ifthelesseeorfarmerisnotamemberofthesametribeorofatribeinthesame
group,bedeemedtobealeaseorfarmforthetermpermittedbythissection.

12.Restrictiononpowertomakefurthertemporaryalienation.(1)Duringthecurrencyofamortgage
madeundersection6inform(a)orform(b)orofaleaseorfarmunderthisAct,theownershallbeatlibertyto
make a further temporary alienation of the same land for such term as together with the term of the current
mortgage,leaseorfarmwillmakeupatermnotexceedingthefulltermoftwentyyears.
(2)Anysuchfurthertemporaryalienation,ifmadeforalongertermthanispermittedbythissection,
shallbedeemedtobeatemporaryalienationforthetermpermittedbythissection.

13.Ejectmentofmortgagee,lesseeorfarmerremaininginpossessionafterterm.Ifamortgagee,lesseeor
farmerholdingpossessionunderamortgagemadeundersection6orunderaleaseorfarmmadeundersection11
orunderamortgage,leaseorfarmmadeundersection12remainsinpossessionaftertheexpiryofthetermfor
[85]
whichheisentitledtoholdunderhismortgage,leaseorfarm,the [Collector]may,ofhisownmotionoronthe
applicationofthepersonentitledtopossession,ejectsuchmortgagee,lesseeorfarmerandplacethepersonso
entitledinpossession.

[13A. Benami transactions intended to evade the provisions of the Act to be void. (1) When a sale,
exchange,gift,will,mortgage,leaseorfarmpurportstobemadeeitherbeforeorafterthecommencementofthe
PunjabAlienationofLand(SecondAmendment)Act,1938,byamemberofanagriculturaltribetoamemberofthe
same agricultural tribe or of a tribe in the same group, but the effect of the transaction is to pass the beneficial
interesttoapersonwhoisnotamemberofthesametribeorofatribeinthesamegroup,thetransactionshallbe
voidforallpurposes,andthealienorshallbeentitledtopossessionofthelandsoalienated,notwithstandingthefact
thathemayhavehimselfintendedtoevadetheprovisionsofthisAct.
ExplanationAnyalienationmadeinconsequenceofatransactionrenderedvoidbythissubsectionshall
alsobedeemedvoidforallpurposes.

(2)Ifthe [Collector] either of his own motion or on the application of the alienor, is satisfied after
making such enquiries as may be prescribed from the parties concerned, and recording evidence that an
alienationisvoidundertheprovisionsoftheprecedingsubsectionheshall,byorderinwriting,afterrecording
hisreasons,ejectanypersoninoccupationofthelandundersuchsale,exchange,gift,will,mortgage,leaseor
farmandplacethealienorinpossession:

Providedthatthe [Collector]may,inorderingtheejectmentofapersonwhoisabonafidetransfereefor
considerationbeforethe20thJune,1938,andisinoccupationofsuchland,allowtoanysuchperson,otherthanthe
[89]
originaltransferee,compensationforimprovements(asdefinedinsection4ofthePunjabTenancyAct,1887 ,
effected by him while in occupation, up to a sum not exceeding in value the consideration for the original
[90]
transaction.Suchcompensationshallbeassessedbythe [Collector]onsuchprinciplesasmaybeprescribed,and
shallbedepositedbythealienor,andpaidtothepersonssoejected,insuchmannerasmaybeprescribed.

(3)Forthepurposeofenforcinganorderundersubsection(2)the [Collector] may exercise all the
powersofaCivilCourtconferredbyOrder21,Rules97and98oftheCodeofCivilProcedure.

13B. Appeals. An appeal shall lie from any order passed, whether in original or on review by a
[Collector]undersection4orsection13A,asfollows,namely:

(a)tothe [Commissioner]whentheorderispassedbythe [Collector]

(b)tothe [BoardofRevenue]whentheorderispassedbythe [Commissioner] [onlyonapointof
law].

13C. Revision. The [Board of Revenue] may at any time call for the record of any proceedings pending

beforeordisposedofbythe [Collector]undersection4orsection13Aandshallpasssuchordersas [it]
thinksfit:

Providedthat [it]shallnotunderthissectionpassanyorderreversingormodifyinganysuchorder
withoutgivingthepersonsconcernedanopportunityofbeingheard.

13D.Limitationforappeal.Theperiodoflimitationforanappealundersection13B,shallrunfromthe

theagreementunlessthesanctionofa [Collector]isgiventhereto,andshall,untilsuchsanctionisgivenorif
suchsanctionisrefused,takeeffectasifithadbeenmadeforoneyear.

(a)cropsandotherproductsoftheearthstandingorungatheredontheholding
(b)cropsandotherproductsoftheearthwhichhavebeengrownonthelandduringthepastyearand
havebeenreapedorgathered.
16.Executionsaleoflandforbidden.(1)Nolandbelongingtoamemberofanagriculturaltribeshallbe
sold in execution of any decree or order of any civil or revenue court, whether made before or after the
commencementofthisAct.

[(2)Notwithstandinganythingcontainedinanyotherenactmentforthetimebeinginforcenoland
belongingtoamemberofanagriculturaltribeshall,inexecutionofanydecreeororderofanycivilorrevenue
court, whether made before or after the enactment of this subsection, be leased or framed for a period
exceeding20yearsormortgagedexceptinoneoftheformspermittedbysection6].

[And,ifthelandisalreadyunderlease,farmormortgage,theperiodofthelease,farmormortgage
madebythecourtshallnotexceedtheperiod,ifany,remainingafterthetotalperiodoftheexistinglease,farm
ormortgageisdeductedfromtheperiodoftwentyyears:
Provided that the period of any lease, farm or mortgage, made by the owner (a) subsequent to the
institution of the proceedings which have led to the decree or order in execution of which the land is being
alienatedbythecourt,or(b)withintwelvemonths,previoustotheinstitutionofproceedingsreferredtoin(a)
aboveandprovedtobeofafraudulentandcollusivecharacter,shallnotbesodeducted].

[(2A)Everylease,farmormortgagemadeundersubsection(2)shallbedeterminableatanytimeby

owner of that land by tendering to the [Collector] an amount which shall bear to the amount in
considerationforwhichtransferhasbeenmadethesameproportionastheunexpiredperiodoftransferbearsto
thetotalperiodforwhichthetransferhasbeenmade.
ExplanationLeaseincludesatemporaryalienationoflandinsatisfactionofamoneydecree.

(2B)The [Collector]shallgivenoticetothepartiesandafterhearingthemandrecordingsuchevidence
asmaybeproducedshalldeterminetheamounttobetenderedundersubsection(2A).

(2C)Whentheamountasdeterminedhasbeendepositedwiththe [Collector]heshallmakean
order that the lease, farm or mortgage be immediately determined that the owner be put in possession as
againstthelessee,farmerormortgageeandthattheamountindepositbepaidtothepersonentitled.

(2D)Forthepurposeofenforcinganorderundersubsection(2C)the [Collector]mayexerciseall

18.Recordofrights and annual record. (1) Where, by reason of any transaction which under this Act

acquiredshallnotbeenteredintherecordofrightsorinanyannualrecorduntilheproducessuchevidenceof
theorderbywhichsuchsanctionisgivenasmayberequiredbyanyrulesmadeunderthisAct.
(2)NorightclaimedbyreasonofanytransactionorconditionwhichisdeclaredbythisActtobenulland

decreeororder.

appearstothe [Collector]thatanyCivilCourthaseitherbeforeorafterthedatewhenthissectioncomes

apply for the revision of such decree or order to the Court, if any, to which an appeal would lie from such
decree or order or in which an appeal could have been instituted at the time when the decree or order was

passed or in any other case to the [High Court]. And when the Court finds that such decree or order is
contrary to any of the provisions of this Act it shall alter it so as to make it consistent with this Act. Such

applicationshallbemadewithintwomonthsofthedateuponwhichthe [Collector]isinformedofsuch
decreeororder.

(3)WhenanysuchAppellateCourtpassesanorder,rejectingsuchapplication,the [Collector]may,

withintwomonthsafterthedateuponwhichheisinformedofsuchorder,applytothe [HighCourt]for
revisionthereof.
(4)EveryCivilCourtwhichpassesanorderonanyapplicationmadeunderthissectionshallforthwith

(5) No stamp shall be required upon such applications, and the provisions of the Code of Civil

Procedure ,asregardsappealsshallapplysofarasmaybetotheprocedureoftheCourtonreceiptofsuch
