address at Solidad Subdivision, Sirao St., Brgy.
Banilad, Cebu City, Philippines, after having been
duly sworn in accordance with law, hereby depose and
say:

That I am executing this affidavit to establish

the matters surrounding the execution of the Deed of
Absolute Sale; defendants receipt of the contract
price; defendants undertaking to immediately vacate
the subject property; and to identify documents in
relation thereto.

Q1: Are you Witt Nays Two, the witness in this

case?
A1: Yes.

Q2: Do you know the plaintiff in this case?

A2: Yes.

Q3: Do you know the defendant in this case?

A3: Yes.
Q4: How do you know the plaintiff and defendant in
this case?
A4: I witnessed the deed of absolute sale executed
by the plaintiff, being the
buyer and the defendant, being the seller.

Q5: When did you witnessed the execution of the

said Deed of Absolute Sale?
A5: On March 28, 2017?

Q6: What is the subject matter of the said Deed of

Absolute Sale?
A6: A parcel of land located at J.P. Laurel
Avenue, Buhangin, Davao City

Q7: Who were the parties in the execution of the

Deed of Absolute Sale?
A7: Glucklich Corporation Inc. as represented by
its President, Jergen M.
Scharwz who was the buyer and Sarah H. Delos
Reyes who was the seller.

Q8: Who signed the Deed of Absolute Sale?

A8: President Jergen M. Scharwz of Glucklich
Corporation Inc. as the buyer and
Sarah H. Delos Reyes as the seller.

Q9: Where was the said Deed of Absolute Sale

executed?
A9: At the office of Notary Public of Davao.

Q10: How much was the consideration for the said

parcel of land?
A10: P6, 500,000.00

Q11: When did the payment given?

A11: On the same day when the Deed of Absolute Sale
was executed. That was on March 28, 2017.

Q8: Did you witness who handed the payment to the

seller?
A8: Yes.

Q9: Who handed the payment to the seller?

A8: Mr. Jergen M. Scharwz

Q9: Was there any receipt of the contract price?

A9: Yes.

Q10: Who gave the receipt?
A10: Mr. Jergen M. Scharwz

Q11: Was there any terms and conditions in the Deed

of Absolute Sale?
A11: Yes.

Q12: What were the terms and conditions in the Deed

of Absolute Sale?
A12: One of the terms was that upon payment of the
contract price to the seller, the latter should
immediately vacate the subject property.

Q13: What else?

A13: The seller also guarantees the right of the
Buyer to take possession of the property subject upon
the signing and execution of the Deed of Absolute
Sale.

Q14: Was there any documents presented with the Deed

of Absolute Sale?
A14: Yes. There was a Copy Certificate of Title
presented by the Seller to the Buyer.
