Written Notice of Motion for Consideration (Trustees Ford and Gershon)

In accordance with Board Bylaw 21.1, the following motion is submitted for consideration.

21.1 A matter may be added to the regular meeting agenda by submitting in writing to
the Director, at least seven days in advance of the meeting by:

(a) two or more members of the Board

Review of Disciplinary Hearing Procedures

Whereas, Part XII of the Education Act, Behaviour, Discipline and Safety has not been substan-
tially reviewed since implementation of changes under the Education Amendment Act, Bill 212
in 2007; and

Whereas, members of school boards have expressed that there are limited options for addressing
student needs in adjudicating discipline hearings; and

Whereas, there is no requirement for trustees in Ontario to be trained on disciplinary committee

hearings under the Education Act or its regulations;

Therefore, be it resolved:

(a) That the Chair send a letter to the Minister of Education requesting that the Ministry con-
duct a review of the discipline hearing provisions under Part XII of the Education Act;

(b) That at the conclusion of the review at Part (a), the Ministry of Education develop a plan
for the mandatory training of all members of school boards in the province on adjudicating
discipline hearings;

(c) That a copy of the communication at Part (a) be sent to all four Trustee associations with a
request that the associations support the Toronto District School Boards communication to
the Minister of Education.
