II. TRANSLATE THIS CONTRACT ( 4 Points)


A contract is a legally binding or valid agreement between two parties. The
law will consider a contract to be valid if the agreement contains all of the
following elements:

1. offer and acceptance;


2. an intention between the parties to create binding relations;
3. consideration to be paid for the promise made;
4. legal capacity of the parties to act;
5. genuine consent of the parties; and
6. legality of theagreement.

An agreement that lacks one or more of the elements listed above is not a
valid contract.

Each of these elements is dealt with in more detail in this section.

Must contracts be in writing?

Not all contracts need to be in writing. Contracts that are required by law to
be in writing include contracts to buy and sell land or to buy a motor car and
door-to-door sales contracts. However, it is always useful to have the terms
agreed between the parties written down and attached to or kept with any
other relevant papers; for example, copies of quotations, brochures,
pamphlets, etc. that were supplied at the time the contract was entered into.
Receipts for money paid should always be kept. If a dispute arises, these
documents will assist in resolving differences between the parties.
A written contract can be drawn up by listing all the terjms agreed between
the parties and getting each of the parties to sign and date the document at
the end.

Un contrato es un acuerdo legalmente vinculante o vlido entre dos partes.


La ley considerar que un contrato es vlido si el acuerdo contiene todos los
elementos siguientes:

1. oferta y aceptacin;
2. una intencin entre las partes para crear relaciones vinculantes;
3. consideracin a pagar por la promesa hecha;
4. capacidad legal de las partes para actuar;
5. consentimiento genuino de las partes; y
6. legalidad del acuerdo.

Un acuerdo que carece de uno o ms de los elementos enumerados


anteriormente no es un contrato vlido.

Cada uno de estos elementos se trata con ms detalle en esta seccin.

Los contratos deben ser por escrito?

No todos los contratos deben ser por escrito. Los contratos que la ley exige
por escrito incluyen contratos para comprar y vender terrenos o para comprar
un automvil y contratos de venta puerta a puerta. Sin embargo, siempre es
til que los trminos acordados entre las partes se anoten y adjunten o
guarden junto con otros documentos relevantes; por ejemplo, copias de citas,
folletos, panfletos, etc. que se suministraron en el momento en que se firm
el contrato. Los recibos por el dinero pagado siempre deben mantenerse. Si
surge una disputa, estos documentos ayudarn a resolver las diferencias
entre las partes.

Se puede redactar un contrato por escrito enumerando todos los trminos


acordados entre las partes y logrando que cada una de las partes firme y
feche el documento al final.
