Most employees around the globe are entitled to leave benefits. These benefits such as
maternity and paternity leave are available in most countries. With these benefits, male and female
employees are able to receive full pay even on leave in case of the female employees child
delivery and for the male to attend his partners delivery. However, in Philippines, these benefits
are limited. For paternity leave, it is granted only to married male employees, regardless of their
employment status. In addition, the said benefit shall only apply to the first four (4) deliveries of
the employees lawful wife with whom he is cohabiting, and it shall be for seven (7) calendar days
with full pay. The problem is that in Philippines, many employees are living together as husband
and wife without the benefit of marriage. There are many male employees that cannot fully support
his partners childbirth and delivery nor receive any benefit because they are not married and in
other case, it is beyond the first four (4) delivery limit. Thus, our laws governing such benefits
should be improved based on equality for all male employees, married or unmarried, to be entitled
to parental leave benefit and the removal of limit in the application of such benefit to the number
