Analysis of Land Dispute Cases for Constructing IAIN Sheikh Nurjati Campus Based on
Presidential Regulation No. 71 of 2012

Problem formulation: Is the Land for Campus IAIN Sheikh Nurjati violating Presidential
Regulation No. 71 of 2012?

Legal Framework:
1. Law No. 2 Year 2012 on Land Procurement for Public Interest
2. Presidential Regulation No. 65 Year 2006 concerning Land Procurement for Public Interest
3. Presidential Regulation No. 71 of 2012 on Implementation of Land Procurement for the Public
Interest.

Case Analysis :
The case of IAIN Syekh Nurjati started when buying a land area of 40,190 square meters in
Astapada Village, Central Tengahtani, Cirebon Regency at Rp 8.6 billion in 2014. The plan of
the land will be used to build the campus II IAIN Sheikh Nurjati. The purchased land is part of a
planned purchase of 6.7 hectares of land with a budget of Rp 16 billion. However, the
procurement of the land is allegedly not done based on existing rules. As a result, the land cannot
be transferred its rights on behalf of the state or on behalf of IAIN Sheikh Nurjati.

that in Presidential Regulation 65 of 2006, the state allowed the direct purchase of land

Based on Law No. 2 of 2012 on Land Procurement For Public Interest and Presidential
Regulation No. 71/2012 on Implementation of Land Procurement For Public Interest, no later
than 30 days of land purchased must have switched his right to the state. Based on calculations
BPKP, state losses in the case around Rp 8.2 billion.

Conclusion:
IAIN Sheikh Nurjati has done according to the rules. Because it is clear that in Presidential
Regulation 65 of 2006, the state allowed the direct purchase of land acquisition for public
interest in a deliberation.
So, this case does not violate Law No. 2 of 2012 on Land Procurement For Public Interest and
Presidential Regulation No. 71/2012 on Implementation of Land Procurement For Public
Interest, the no later than 30 days of land purchased must have switched his right to the state.
