Executive Summary

The project is based on the problem incurred during tendering and contracting process of
business to business context in hotel industry. In hotels there are continuous infrastructures
changes happens, for all these it is necessary to go through tendering process. And as some
works are really small, hotels go for single tendering after which they face many issues
regarding quality, payments, advance and delays. Some of the issues and recommendations are
as follows.

In order to procure an order, contractor may quote lower and subsequently may not be able to
deliver on time or compromises on quality. To solve this problem, the hotel should use vendor
management system, two bid systems, Performance Bank guarantee and liquidated damages as
the weapon. Sometimes problems incur when contractors claim for extra work done over and
above the scope of tender to make extra profits. For this purpose, Contract Force Account
method can be used. This method reimburses the contractor for extra work that is identified
after the project has started based on pre-negotiated price.

Sometimes even after paying advance, a developer may fail to construct and handover the
constructed space. Due diligence and background check is important in order to avoid any
frauds. The vendor Due Diligence includes vendor master file management, vendor background
checks, vendor questionnaires, vendor due diligence checklists, vendor monitoring etc. Issues
regarding compliance with various statutory laws relating to labor, workmen compensation,
taxes etc can be solved by ensuring that the tender documentation is complete, relevant and
proportionate to the need. Also it must be ensured that the contract identifies clearly the roles
and responsibilities of both the client and the bidder.
