The official has submitted medical reimbursement bills for the period from 17-07-201 to 28-07-
2017. The official is a kidney patient and undergoes Heamodialysis at Continent Hospitals ( a CGHS
empanelled hospital) for thrice a week for 4 weeks in a month on the advice of CGHS and with
permission of the Head of the Office, copies of the same are submitted alongwith bills.

I) Medical bill for Rs.10143/- for the period from 17-7-2017 to 28-7-2017 is scrutinized
and found to be in order for consideration.

II) As per the advice of the CGHS Doctor the official under Left Eye Cyclocryotheraphy
Surgery & Intra Vitreal Injection Lucentis in Left Eye and submitted bill for Rs.4366/-.
The bill for Rs.4366/- is scrutinized and found to be in order for consideration.

The CPMG (as the Head of the Deptt.) is vested with the powers to settle all medical
reimbursement claims for amounts exceeding Rs.5000/- in the case of in-patients as per CS(MA) Rules
1944 and CGHS orders. The above medical reimbursement claims may kindly be considered and
approved please.
 This is regarding request for appointment as Postman under sports
quota case of Sri M Praveen Kumar. The representation received from the
candidate is placed at Sl No. 28/C. In this case, the Honble CAT in OA No. 651 /
2012 vide order dated 31.01.2013 at Sl No. 14-1/C has directed by the respondents
to appoint the applicant for the post of Postman immediately.

In the meanwhile, Sri K Stephen filed WP No. 11641 / 2013 in the

Honble High Court of A.P., Hyderabad making Sri M Praveen Kumar as

 This is regarding issue of post facto approval in respect of case
Sri S Venkatesh, PA, Hyderabad GPO, Hyderabad. The patient i.e., Smt.
Santosha, W/o Sri S Venaktesh who was admitted in the private hospitals which is
not a CGHS recognized hospital in emergency condition.

The details of the case are as follows.

Smt. S Santosha wife of Sri S Venkatesh has admitted in

emergency condition on 24.04.2013 at Lakshmi Priya Surgical & Maternity
Nursing Home, Uppal, Hyderabad 500 039, which is a non-CGHS recognized
hospital as she was suffering from severe pain in the lower abdomen and severe
bleeding PV. The official has also submitted in his representation that as other
CGHS recognized hospitals were far away from his residence, she was admitted
in the above said hospital as she required immediate blood transfusion and
surgery.

The official has not obtained any prior permission either from
CGHS authorities or from the Department. After completion of treatment the
official has paid the bill and submitted the bills along with Med-97 forms for
reimbursement of an amount of ` 34,246/-.

The Chief Postmaster, Hyderabad GPO has stated that as per

CGHS rules, the official has to obtain permission CGHS authorities and also from
the Department to take the treatment. But the official failed to do so. The Chief
Postmaster has also stated that as per the representation of the official dated
26.04.2013, the official was not in a position to admit his wife in a CGHS
approved hospital which was above 10 Kms away from his residence and his
wife condition was very critical warranting urgent blood transfusion and blood
surgery and also the condition of the patient was life threatening, the patient was
admitted by the official in a nearby hospital i.e., Lakshmi Priya Surgical &
Maternity Nursing Home, Uppal, Hyderabad 500 039, a non-CGHS recognized
hospital. The emergency certificate is at Sl No. 29-3/C, Xerox copy of CGHS card
is at Sl No. 29-4/C. Discharge summary and discharge bills are at Sl No.29-18/C
& 29-19/C.

The Chief Postmaster has recommended the case by considering

the genuineness and gravity of the circumstances and also requested for favour of
approval.
 In view of the above, as per the paragraph 2. (ii) of Department of
Health & Family Welfares letter No. S.12020/4/97-CGHS (P) dated 27.12.2006
(which was downloaded from the official website of CGHS through link
http://msotransparent.nic.in/cghsnew/index1.asp?linkid=10&langid=1 ), The Heads
of Department may decide the cases of reimbursement of medical claims in
respect of treatment obtained in emergency at private hospital / private
nursing home / private clinic, subject to item-wise ceiling as per rates
prescribed for CGHS beneficiaries without financial limit on the total
amount to be reimbursed.

And from the paragraphs 3 & 4, the delegation of powers should

be subject to the condition that the Heads of Departments / Ministries may settle
cases up to the limit of ` 2,00,000/- .

Sri Sudarsi Balakotaiah, PA CO has submitted a representation on

11.07.2013 (at 3/C) for post facto approval for medical treatment of his mother at
outside CGHS area on emergency condition. In this regard, kindly see the orders
of DPS (Hqrs) vide notesheet No. 1/N.

As per the rulings If the CGHS contribution were being

compulsorily deducted from the monthly salary of the Government
employee, it would be unfair to deny the Government Servant the benefit of
CGHS facilities merely on the ground that he / she had not applied to the
Administration Branch for getting a CGHS card.

As a matter of fact, if the concerned Office / Department is

regularly deducting the CGHS contribution from the monthly salary of the
Government Servant, it is the responsibility of the said Office / Department to
ensure that a CGHS card is issued to such Government Servants.

In the instant case, the official has applied for CGHS card soon
after joining the Circle Office and CGHS card was issued by the CGHS
authorities on 28.10.2011. Whereas the accident of his mother met on 06.09.2011
and she was discharged on 23.09.2011. After that the official submitted medical
bills for ` 41, 405/- on 11.10.2011 and has requested for issue of post facto
approval for reimbursement of his medical claim.

In view of the above, as per the paragraph 2. (ii) of Department of
