Mr. Zaheer Jamali Lung Vs. Chand Bibi

PETITION U/S 25 OF THE GUARDIAN AND WARDS ACT FOR THE


CUSTODY OF MINOR NAMELY MUHAMMAD JAVED KHAN.
APPLICATION FOR AN APPROPRIATE ORDER UNDER SECTION 193 OF
PPC REGARDING FALSE EVIDENCE PRODUCED BY THE RESPONDENT

RESPECTFULLY SHEWETH:-

1. That the petitioner filed the petition under section 25 of the Guardian and Wards Act for
the custody of Minor namely Muhammad Javed Khan which is pending for adjudication
before this Honorable Court and is fixed for today.

2. That in the above-mentioned case the evidence of the parties got recorded and now the
case has been fixed for further proceedings.

3. That the respondent filed suit for dissolution of marriage on ground of Khulla titled
Chand Bibi Vs. Zaheer Jamali Lung adjudicated by the Mr. _______, Learned Judge
Family Court/Guardian Judge, Islamabad.

4. That in the above said suit the respondent categorically stated in para No. 2 of the plaint
that during the wedlock of petitioner and respondent a child namely Muhammad Javed
Khan was born.

5. That the respondent filed her written reply of the petition under section 25 of the
Guardian and Wards Act for the custody of Minor namely Muhammad Javed Khan in
which the respondent categorically admitted that the Minor namely Muhammad Javed
Khan is adopted son, which is mentioned in para No. 5 of the reply.
6. That by this eventuality the respondent has categorically produced false evidence before
this august Court.

7. That if the proceedings under section 193 are not initiated against respondent regarding
producing the false evidence in the judicial proceedings then the petitioner will suffer an
irreparable loss.

PRAYER:

Under these circumstances, it is therefore, respectfully prayed that the proceedings under section
193 of PPC may kindly be initiated against the respondent and any other enabling law which is
in the best interest of justice.

Any other relief, which this honorable court may deem fit and proper, may also be awarded.
