MICHIGAN AVENUE ~ NINTH FLOOR LANSING, MI18933, TO: ALL OFFICERS, EMPLOYEES, AGENCIES, BOARDS, AUTHORITIES, AND DEPARTMENTS OF THE CITY OF LANSING RE: EXECUTIVE ORDER 2017-02: AUTHORIZING THE TEMPORARY OPERATION OF MEDICAL MARIHUANA PROVISIONING CENTERS UNDER CERTAIN CONDITIONS ‘The State of Michigan enacted the Medical Marihuana Facilities Licensing Act (MMFLA) for the express purpose of licensing and regulating medical marihuana growers, processors, provisioning centers, secure transporters and safety compliance facilities, Pursuant to Section 205 of the MMFLA, he City of Lansing has adopted an ordinance to authorize, license and ‘regulate medical marijuana facilites: Ordinance No. 1217, an Ordinance ty Provide forthe ‘Regulation and Licensing of Medical Marihuana Establishments, also known as Chapter 1300 of the Lansing Code of Ordinances, which took effect on October 7, 2017. The State of Michigan, through the Bureau of Medical Marihuana Regulation, «division ofthe Michigan Department of Licensing and Regulatory Affairs (LARA), has promulgated Emergency Rules, which outline the Bureau of Medical Marihuana Regulation's intent to address the operating status of medical marihuana facilities that may currently be in operation ‘under local municipal authority, ‘The Emergency Rules provide that an applicant curently operating a medical marihuana facility that would otherwise require a state operating license will not automatically impede the applicants eligibility for state licensure ifthe municipality where the applicant's medical ‘marihuana facility is located has adopted an authorizing ordinance pursuant to Section 205 of the /MMFLA prior to December 15, 2017, and additional requirements are adhered to, including that the adoption ofthe ordinance must be (1) attested toby the clerk of the municipality and 2) the ‘municipality must authorize the temporary operation ofthe applicant. ‘The City of Lansing wishes to authorize the temporary continuation of currently operating medical marihuana facilities, under the requirements ofthe Emergency Rules, for those facilities ‘whose complete application has been submitted tothe city and is pending under Ordinance No, 1217 and has not yet been denied fora license by either the city or state. The applicant must also apply fora sate operating license no later than February 15, 2018, er the Emergency Rules. EXECUTIVE ORDER 2017-02 Page Two It should also be noted thatthe temporary authorization to continue operating a medical ‘marinuana facility does not guarantee either a sate or local license. Further, an applicant granted temporary authorization to continue operating must cease and desist any operation of any ‘medical marihuana facility if they have not been issued a stat license by June 15, 2018, oF immediately upon being denied ether a state or local license. ‘In furtherance of the foregoing, and pursuant to the powers vested in me under the Lansing City (Charter, Thereby issue the following executive order, which shall have immediate effect ‘UTIVE ORDER 201 IT IS HEREBY ORDERED: I m1, Vv, Every currently operating Medical Marihuana Provisioning Center in the City of Lansing. ‘that has not submited a complete application tothe City Clerk pursuant to Ordinance No. 1217 (effective October 7, 2017) by December 15, 2017 shall cease and desist all, ‘opetations by December 22, 2017 at 5:00 pam.; and Every currently operating Medical Marihuana Grower Facility, Processor Facility, Safety Compliance Facility and Secure Transporter inthe City of Lansing that has not submitted ‘8 complete application tothe City Clerk pursuant to Ordinance No, 1217 (eltecuve October 7,2017) by December 31, 2017 shall cease and desist ll operations by 5:00 p.m, that day; and ‘Upon denial of licensure by either the City of Lansing o the State of Michigan, any applicant operating under a temporary authorization must immediately cease and desist all operations; and ‘The Office ofthe City Attorney, Lansing Police Department, Code Compliance division of the Lansing Fire Department and the Building Safety and Zoning divisions ofthe Department of Planning and Neighborhood Development are hereby directed to use all available legal and administrative remedies o ensure the closure of non-compliant Medical Marihuana facilities, including: ‘Issuing a civil infraction ticket, which may result ina penalty of upto $1,000.00 per day of violation; ‘+ Declaring the operation a public nuisance and seeking to abate the nuisance; ‘© Seeking court-ordered compliance and/or other injunctive relief, © Padlocking the facility; + Any other legal action deemed appropriate by the Office ofthe City Attorney; Executive Order 2017-02 Page Three This Executive Order, signed on the 11th day of December, 2017, shall remain in full force and effect until tis rescinded or superseded, VIRG me “Mayor of the City of Lansing, Michigan
