This is an example of a controlled delivery search warrant. The face page of the search
warrant has the language “THIS WARRANT CAN BE SERVED ONLY UPON THE
DELIVERY AND ACCEPTANCE OF THE DESCRIBED PACKAGE” inserted
for this specific search warrant. For controlled delivery and/or anticipatory
search warrants, it is preferred to state the contingency on the face of the
warrant, i.e. “THIS WARRANT CAN BE SERVED ONLY IF THE SALE OF
NARCOTICS TAKES PLACE AT THE PRESMISES TO BE SEARCHED”
This example also has language to allow federal agents to assist in the search
warrant.

On August 15th, 2010, Mr. Tom Smith, a Special Agent of the U.S. Customs Service, contacted
Det. Nelson, member of San Luis Beach Police Department. Special Agent Smith told Det.
Nelson that the U.S. Customs Service on 08/14/10, intercepted an envelope addressed to “Janet
Planet” at 1504 Ocean Breeze Ave. in the City of San Luis Beach, Ca. The envelope originated
from Nonthaburi, Thailand, and upon inspection was found to contain a magazine, “culture
mast” which had the inside center of the magazine removed. Inside the cut outs of the magazine
were four clear ziplock baggies containing about 304 Ativan ( Lorazepam) tablets a violation of
21 USC 952 and violation of 11375(b) H&S of the State of Calif. The envelope was transferred
to the U.S. Postal Service for controlled delivery with San Luis Beach Police Department
08/15/10 and received by the U.S. Postal Service. The investigation was assigned to Postal
Inspector Susan Holmes.

A sample of the tablets were submitted to the LASO crime lab on 08-22-10. On 8-23-10 your
affiant was notified by the LASO crime lab (Senior Criminalist Victor Thomas) that the tablets
were tested and identified as lorazepam, a controlled substance requiring a prescription to
obtain/posses.

Your affiant, through departmental resources was able to determine that a Janet Planet resides at
1504 Ocean Breeze Ave. in the City of San Luis Beach, Ca. Your affiant went to 1504 Ocean
Breeze Ave. and saw the vehicles listed on Search Warrant & Affidavit page #3 parked in or
around the property.

Statement of Probable Cause

Based upon the information contained in this affidavit, coupled with your affiants training and
experience, your affiant states that the items of drug paraphernalia and documentation
enumerated on Search Warrant & Affidavit page #3 of this affidavit are articles that are
commonly found in, and associated with, places where controlled substances are found to be
present.

Your affiant has been present during the execution of numerous search warrants. In virtually all
of these instances, your affiant has observed utility bills pertaining to the location and/or
personal letters addressed to the occupants of the location within the residence being searched.
On many occasions, your affiant has observed handwritten notes or papers, photographs, digital
cameras (including memory cards and internal memory storage pictures/video) and video
cameras (including memory cards and internal memory storage pictures/video), keys that fit the
location locks, and wallets, purses, diaries, phone books, and luggage tags, all of which
contained in or upon them some personalization or which tended to identify the owner(s) thereof
and thus circumstantially identified to your affiant the occupant(s) of the premises for the
purposes of arrest, identification and crime charging.

It is also my experience and the experience of other narcotic investigators with whom I have
spoken with, that suspect/s who traffic in narcotics frequently possess computers to enhance their
trade. These suspect/s use computers to house buyers and seller’s lists, track profits and loss,
store recipes, order controlled substances via the internet and to communicate with other
traffickers of narcotics. Thus, I also request if computers are located within the grounds being
searched as authorized by this warrant that I be allowed to seize such computers.

An off site search of the suspect’s computer system, including all storage devices, is needed as
my experience has shown that computer systems can store an equivalent to hundreds of
thousands or even millions of pages of information. Also as suspect’s can disguise or rename
computer files at will. A complete search of all the data on the computer system may be
necessary. This can best be done in a controlled environment with forensic equipment. This will
assist not only my investigations, but also the interests of the suspect in this matter.

Statement of Probable Cause

Page#
In order to assure that the computer system can be forensically examined all peripheral
equipment; computer hardware, software and external storage devices will need to be collected
along with manuals and support documentation. Computer hardware consists of all equipment
which can collect, analyze, create, display, convert, store, conceal, or transmit electronic,
magnetic, optical, or similar computer impulses or data.

As evidence in this matter could be stored either on a computer hard drive or on removable
storage devices, such as, but not limited to, floppy disks, CD’s, or tapes, all removable storage
devices would need to be seized. Due to the storage capacity of removable storage devices an on
scene inspection of them would not be practical. With respect to computer systems and any items
listed above found during the execution with this Search Warrant, the searching Peace Officers are
authorized to seize and book said computer systems and any items listed above and transfer them to
a Law Enforcement Agency location prior to commencing the search of the items. Furthermore,
said search may continue beyond the ten-day period beginning upon issuance of this Search
Warrant, to the extent necessary to complete the search on the computer systems and any items
listed above.

Your Affiant requests that the court authorize the use of Federal Agency personnel to accompany the
Peace Officers executing this Search Warrant for the purpose of assisting in the service and execution of
this Search Warrant as provided for under California Penal Code Section 1530 and 1538. The Federal
Agency personnel can also assist in the computer examinations of the seized items.

On 08/29/10, your affiant and U.S. Postal Service will attempt a controlled delivery of the
aforementioned envelope to “Janet Planet” at 1504 Ocean Breeze Ave. in the City of San Luis
Beach, Ca. The envelope will contain the original magazine and 274 lorazepam tablets and the
envelope will be delivered to Janet Planet. The investigators will wait a reasonable amount of
time for the envelope to be opened before service of the search warrant. If the envelope is not
received by Janet Planet at the listed address then the search warrant will not be served.
