This is in response to an April 25, 1995, ruling request,


submitted on behalf of X by its authorized representative,
concerning the status of X as a "religious order" for purposes of
sections 1402 (c) (4), 3121 (b) (8), and 3401 (a) (9) of the Internal
Revenue Code.
Xis a nonprofit corporation organized under the laws of
State. Xis operated exclusively for religious purposes and
considers itself to be a religious missionary order dedicated to
extending the Kingdom of God through evangelizing unreached
peoples in the countries of y.
Revenue Procedure 91-20, 1991-1 C.B. 524, states that the
Service will use the following characteristics in determining
whether an organization is a religious order:
1. The organization is described in section 501(c) (3) of the
Code.
2. The members of the organization vow to live under a strict
set of rules requiring- 1t10:cal and spiLitu.al st:::lf-sacrifice and
dedication to the goals of the organization at the expense of
their material well-being.
3. The members of the organization, after successful completion
of the organization's training program and probationary period,
make a long-term commitment to the organization (normally more
than two years) .
4. The organization is, directly or indirectly, under the
control and supervision of a church or convention or association
of churches, or is significantly funded by a church or convention
or association of churches.

weekly and a monthly all-night prayer meeting). Members
frequently.help one.another with.such activities as moving into a
home, working on maJor home repair projects, sharing material
goods and assignments, helping care for ill members or
accomplishing major work assignments within deadlin~s.
6. Full-time service. Members work full-time to further the
goals of x. Service as a member of Xis a calling from God.
Members agree not to become involved in other activities or
commitments that would interfere with their commitment to X. As
noted above, upon signing the Statement of Agreement a member
agrees to give his or her life totally to X's goals.
7. Type of Activities. In accordance with its purposes, X
engages in two principal activities. First it informs,
motivates, and encourages Christians in the United States and
other nations to support evangelism in y through prayer,
financial sponsorship, and personal involvement in the short-term
volunteer assistance projects. Second, X provides prayer,
financial support, training, program support, and other resources
to further the evangelical activities of native evangelists,
church planters, and pastors in y. In addition, as required by X,
members routinely engage in private and public prayer and Bible
study, both individually and as a community, including monthly
all night prayer meetings.
With respect to those characteristics set forth in Rev.
Proc. 91-20, X does not meet characteristic number 4. Xis not,
either directly or indirectly, under the control and supervision
of a single church or convention or association of churches, and
it is not significantly funded by a single church or convention
or association of churches. The fact that evangelical churches
independently provide X with significant financial support and
have some influence over X's policies does not satisfy this
requirement.
However, X possesses all the other characteristics in Rev.
Proc. 91-20 to a substantial degree. Accordingly, based on our
consideration of all of the facts and circumstances, we conclude
that Xis a religious order for purposes of sections 1402(c) (4),
3121 (b) (8), and 3401 (a) (9) of the Code.

No opinion is expressed on the tax consequences of the above


transaction under any other section of the Code.

5. The members ?f the organization normally live together as


part of a community and are held to a significantly stricter
level of moral and spiritual discipline than that required of lay
church members.

6. The members of the organization work or serve full-time on


behal~ of.the religious, educational, or charitable goals of the
organization.

7. The members of the organization participate regularly in


activities such as public or private prayer, religious study,
teaching, care of the aging, missionary work, or church reform or
renewal.

The following is an analysis of the above characteristics as


they apply to X.
1. SOl(c) {3) status. ~ obtained a determination letter from the
Service stating that it was exempt from taxes under section
SOl(c) (3) of the Code.
2. Vows. Members of z agree in writing to live a life morally
consistent with Biblical values and commandments and to resist
every appearance of evil. Upon successfully completing a
training program and a probationary period, each member must
agree to and sign X's Statement of Agreement. The Statement of
Agreement commits a member to "give their life totally" to the
tasks of X and the fulfilment of X's mission statement. In
addition,-they agree to abstain from any social habits that might
lessen their ministry's effectiveness, including the use of
illegal drugs, tobacco, alcohol, sexual immorality, immodest
dress, offensive language, 11 R11 or 11 x 11 rated movies, and gambling.
Members of~ are required to develop financial and prayer
support from churches and individuals before beginning service at
X's headquarters. The pay scale for members is based on need
instead of position, education, skills, experience, or tenure.
Many members have agreed to accept lower pay than allowed by the
scale because of their commitment to live frugally.
3. Commitment All members of X, by signing X's Statement of
Agreement, agree to serve at least two years beyond their 90-day
training and probationary period.
4. Church-controlled. X gets a large amount of support from
numerous evangelical churches. However, Xis not, directly or
indirectly, under the control and supervision of one church, or
convention or association of churches, and is not significantly
funded by one church or convention or association of churches.

in your application for recognition of exemption, we have determined you are exempt
from Federal income tax under section 50l(c)(3) of the Internal Revenue Code.

Because you are a newly cre~ted organization, we are not now making a final
determination of your foundntionstatus under section 509(a) of the Code. However,
we have determined that you can reasonably be expected to be a publicly supported
organization described in section 170 (b) (A) (vi) and 509 (a) (1).
Accordingly, you will be treated as a publicly supported organization. and not
as n. private foundation, during an advance ruling period. This advance ruling period
begins on the date of your inception and ends on the date shown above.

Within 90 days after the end of your advance ruling period, .you must submit to

CHANGES IN DIRECTORS
Section 1. Vacancies on the Board shall be filled by the Board of
Directors as they occur.

Section 2. The number of Directors may be changed from time to time


upon a two-thirds majority vote at any given regular or special meeting
of the Board.

ARTICLE IV
OfFICERS
Section 1. The officers of the Corporation shall be chosen by the
directors and shall consist of President, Vice-Preside nt and Secretary.
Section 2. The Board may appoint a director and such other officers
and agents as it shall deem necessary, who shall hold office for such
term and shall exercise such powers and perform such duties as shall be
determined by the Board from time to time.
Section 3. The salaries of all officers and agents of the Corporation
shall be fixed by the Board of Directors or its Designee.
Section 4. No member of the Board shall ever be compensated for his
services as director with any funds which may belong to the
Corporation.
