AFFIDAVIT OF UNDERTAKING
I, TERESITA F. PONCE, of legal age, widow, and with residence address in
Barangay Sapang Putol, San Ildefonso, Bulacan, after having duly sworn in accordance
with law, hereby depose and state, to wit:

1. That, I am the owner of a proposed extension of commercial building located at

Daang Maharlika Road, Sapang Putol, San Ildefonso, Bulacan. Covered by
Transfer Certificate Title No. T-6344 registered in the name Andres M. Ponce
and Teresita F. Ponce;

2. That, the scope of work is the Proposed Extension of the Commercial Building
which includes the addition of a second (2nd) floor of an already existing first (1st)
floor building constructed several years ago;

3. That, the undersigned applied for a DPWH Clearance last October 1, 2017 but
was denied in a letter dated November 2, 2017. DPWH states that the road right
of way width of the primary national road, Daang Maharlika Highway, is 30
meters and that the subject has encroached in the right of way by 3.1 meters. It
measured 15 meters from the carriage way (or the structure is 11.9 meters from
the center line of the road);

4. That, I declare and undertake that I will proceed with the construction of the
proposed extension (2nd floor) of the commercial building in the absence of a
DPWH Clearance. This undertaking is on the ground that the existing first (1st)
floor was already there years ago at a time when the road right of way was 20
meters;

5. That, I am releasing any person including the Building Office of the Local
Government of San Ildefonso, Bulacan from any liability that may arise for
issuing a building permit in the absence of DPWH Clearance;

6. That, should the government will exercise its power of eminent domain, I will
voluntarily subject to the same provided the rules set for are complied with and
proper determination of the area needed was established under the terms and
conditions amendable to both parties.

IN WITNESS WHEREOF, I have hereunto set my hands this 3rd day of January
2018 at San Ildefonso, Bulacan.
