JOINT AFFIDAVIT OF ARREST

We, PO1 BENJAMIN MAGDANGAL and PO1 CHARLES DIKON,

both of legal ages, bona fide members of the Philippine National Police
(PNP), and presently assigned at Digos City Police Station, after having
been duly sworn to in accordance with law, do hereby depose and state
that:

1) At around 11:00 in the evening of 04 January 2017, ANTONINO R.

QUIRINO, 29 years old, Filipino, single, security guard, and JOEY
Q. ALPAY, 31 years old, Filipino, married, carpenter, both residents
of Purok Islam, Lopez Jaena Extension, Barangay Zone 1, Digos
City, personally appeared at the Digos City Police Station to report
a shooting incident that transpired at around 10:30 in the evening
of the same day at Sweet DG Lodging House and KTV Bar located
at Brgy. San Jose, Digos City and identifying themselves as victims.
A copy of the Police Blotter Report dated 04 January 2017 is
hereby attached as ANNEX "A";

2) Thereafter, our Chief of Police, PSUPT Demetrius Taypin directed

us to respond and proceed to the reported place of incident to
verify the veracity of the aforementioned information, and if
affirmative, to conduct an ocular investigation;

3) With a PNP Team led by Police Inspector (PI) Robert James

Carumba, we acted on the information earlier reported to us and
proceeded to Brgy. San Jose, Digos City;

4) Upon arrival at the place of incident, we were personally informed

by the one of the witnesses, a certain CARLA MACANSANTOS, an
entertainer working at Sweet DG Lodging House and KTV Bar, that
she knows the identity of the suspects and their residences since
the latter are regular customers of the aforementioned bar;

5) Furthermore, we were informed by the said Carla Macansantos

that the suspects hurriedly escaped right after the shooting
incident, carrying with them the hand gun used and thereafter
boarded on two motorcycles as getaway vehicles;

6) While conducting an ocular investigation on the place of incident,

we found four (4) shell casings of bullets. A photograph of the
shell casings of bullets collected in the place of incident is hereby
attached as ANNEX "B";

7) We immediately informed our Office/Unit confirming the incident.

Shortly thereafter, in coordination with Sulop Police Station, and
together with Carla Macansantos, we conducted a hot pursuit
operation in the residence of the suspects at Brgy. McKinly, Sulop,
Davao del Sur;

8) Upon arrival thereat, DONATO BAKNOT A.K.A. "BOY MALDITO",

33 years old, Filipino, laborer, single and FRANCISCO DONGKOY
A.K.A. "PAYAT", 34 years old, Filipino, laborer, married, both
residents of Brgy. McKinly, Sulop, Davao del Sur were both
arrested upon the positive identification made by the witness
Carla Macansantos and recovered from the direct possession and
control of Donato Baknot is one (1) cal. 38 pistol with 1 bullet in
the cylinder bearing Serial No. ABC 12345. A photograph of the
confiscated .38 Caliber Pistol is hereby attached as ANNEX "C";

9) We also confiscated the 2 motorcycles boarded by the fleeing

suspects, namely: 1) Honda XRM, color red bearing Plate No. LA
35578, and 2) Skygo, color blue without a plate number attached;

10) We thereafter brought the suspects to Digos City Police

Station for further investigation and proper disposition. A copy of
the Extract Copy of Police Blotter is hereby attached as ANNEX
"D";

11) The bullet fragments were later forwarded to us by the

Medico Legal Doctor after the victim was rushed to the Provincial
Hospital of Davao del Sur for medical treatment. A copy of the
photograph of the bullet fragments are hereby attached as ANNEX
"E";

12) We execute this affidavit to attest to the veracity of the

aforementioned facts and to support the filing of appropriate
charge/s in court against the arrested suspects.
