CHAPTER 1
INTRODUCTION

SECTION 1: NAME, SUPREMACY AND MEMBERSHIP


a. This shall be the constitution of Ilawe Student’s Union, Ilawe-Ekiti, here in after refer to as the
Union
b. This constitution is supreme and its provisions shall have binding force on all arms and members
of Ilawe Students’ Union
c. All chapter President or any person in charge of various Institution must register their institution
with the sum of N2000
d. The Union shall not be governed, nor shall any person or group of persons take control of the
government of Ilawe Students’ Union, except in accordance with the provision of this
constitution.
e. If any other law directive or action is inconsistent with the provision of this constitution, this
constitution shall prevail and such law, directive or action shall, to the extent of the inconsistency
be null and void
f. Membership of the Union shall consist of the Students of Ilawe Ekiti origin who have paid the
required union dues, honorary life memberships and patron
g. Person(s) shall become registered members upon proven evidence of studentship. Excluding
member of the national youth service corps.
h. Students from Secondary Schools and other lesser institution shall be regarded as members and
shall be exonerated from payment of Union due.

SECTION 2: MOTTO
The motto of the Union shall be Unity, Service and Progress

SECTION 3: AIMS AND OBJECTIVE


a. To promote unity among members and the entire population of Ilawe-Ekiti
b. To assist in progress moves in the Town
c. To promote educational advancement in the Town
d. To protect the good image of the Union and that of Ilawe-Ekiti by enhancing their pride and
prestige through activities like Sports and other Socio-Economic activities
e. To foster and protect the interest of the members in pursuance of its aims and objectives
f. To contact cooperation and exchange ideas with other external organization whose aims are
acceptable to the union
g. To render reasonable assistance to the needle

SECTION 4: SITUATION CLAUSE


a. The Union shall have chapters in the various institution all over the world with its headquarter in
Ilawe-Ekiti
b. The National Secretariat therefore is situated in Ilawe-Ekiti.
c. All past Honorable shall be addressed and called Senator

SECTION 5: PATRON/MATRON
a. The Union shall appoint Patron/Matron whose number, not exceeding five, shall be determined by
an act of the Ilawe Students Senate Council
b. Such person or persons to be appointed as Patron/Matron must be known to have identified
himself or herself with words and spirit of the preamble to this constitution
c. A person appointed as Patron under the provisions of this section shall hold the office for five
parliamentary session and such appointment may be renewed at the expiration of his tenure of
office

SECTION 6: LIFE MEMBERSHIP


a. The Student’s Senate Council may confer honorary life membership on any Union official or any
other person as a mark of honors for distinguished services.
b. A person shall be deems to have been conferred with Honorary life membership of the union by a
vote of not less than two thirds (2/3) majority of members of the Students Senate Council
c. Any person so conferred with honorary life membership of the union shall be awarded a certificate
signed by the Senate President of the Student Senate Council and the President of the Student
Union.

SECTION 7: LEGAL ADVISER


There shall be an appointment of the legal adviser on the legal actions of the Union by the executive
subject to the approval of the Ilawe Student’s Senate Council.

SECTION 8: RIGHTS
All member of the union shall have the rights
a. To vote and be voted for in approved election of the union into the Executive Council and Ilawe
Students Senate Council in the accordance with relevance provision of its constitution and subject
to section (e) and (f) and section 54 (a),(b),(c),(d) and (e)
b. To attend meeting as provided by the relevant section of the constitution c. To fair hearing when
standing trial on the offence committed against the constitution.

SECTION 9: PRIVILEGED
a. To use the facilities provided and recognized by the Union
b. To serve in any Committee
c. To wear or display official colour of the Union
d. To have a copy of the constitution at affordable price as agreed upon by the I.S.S.C and in
exemption of the I.S.S.C members and EXCOS

SECTION 10: ARMS OF THE UNION


The Union administration shall consist of the three arms
a. Ilawe Students Senate Council (I.S.S.C)
b. Ilawe Students Union Executive Council (EXCOS)
c. Ilawe Students Union Judiciary Council (ISUJC)
CHAPTER TWO

SECTION 11: LEGISLATURE


The Ilawe Students Senate Council here in after referred to as I.S.S.C shall be the legislative Arm of the
Union and shall also be responsible for the supreme policy making of the union

SECTION 12: COMPOSITION OF THE I.S.S.C


a. There shall be Ilawe Student Senate Council (I.S.S.C) consisting of twenty five (25) members with
representatives from each chapter and there must be proven evidence of representation from the
chapter
b. The I.S.S.C shall have Five (5) principal officers democratically elected among the members and
they shall be the Senate President, Deputy Senate President, Senate Leader, Senate Clerk and
Senate whip.
c. The electoral bodies shall conduct the election of the Senate President
d. The senate president shall conduct the election for the post of the Deputy Senate President, Senate
Clerk, House Leader and Senate Whip
e. Members of the I.S.S.C shall be address as and called ‘’SENATORS’’ except the Senate
President and Deputy Senate President who shall be addressed as and called ‘’
DISTINGUISHED SENATE PRESIDENT’’ and ’’DISTINGUISHED DEPUTY SENATE
PRESIDENT’’
f. The I.S.S.C shall functions for one parliamentary year and should stand dissolved there after
g. The I.S.S.C shall be dissolved not later than the first week of a new year

SECTION 13: FUNCTIONS AND POWERS OF THE I.S.S.C


The Student Senate Council I.S.S.C shall
a. Consider and approve the annual budget of the union at the first business sitting of that council
which must be convened not late than fourteen days after the swear-in of the new EXCOS
b. Receive 20 % of every fund generated every three months by the union through the Senate
President from the treasurer on the knowledge of the President in order to meet day –to-day
running of the activities of the council.
c. Have power to call any of the executive to give account of his or her stewardship
d. Set up any committee as the need arises and as it may be reasonably defined.
e. Adopt resolution on major issues affecting the union
f. Call the executive to summon meeting(s) when the need arises
g. Set up Auditing Committee, Budgetary and Financial Committee, Welfare Committee, Social and
Cultural Affairs Committee
h. Subject to section 52 (a) Set up the electoral commission to conduct election into the executive and
I.S.S.C post.
i. Approved the membership of standing committee set up by the Executive provided they are of
unquestionable character
j. Consider the progress report of various committees and commission of the union and have the
right to accept or reject any committee set up by the provision of this constitution.
k. Upon a petition sign by two-third (2\3) members of the council review any programme proposed
by the Union’s Executive Council.
l. Do all such other things to guarantee the effective achievement of the objectives which are set out
in the preamble of this constitution.

SECTION 14: THE SENATE PRESIDENT OF THE I.S.S.C


a. The Senate President who shall be a member of the I.S.S.C shall be elected from among its
member through the electoral body.
b. The Senate President shall be the HEAD and the ACCOUNTING OFFICER of the I.S.S.C.
c. He shall preside over the I.S.S.C / Joint sittings and shall have power to assign duties to the
Deputy Senate President or any member of the house.
d. He shall impartially direct the proceedings of the I.S.S.C and he shall execute all other functions
conferred on him under the provisions of the constitution.
e. Subject to the provision of Section 20 (d) he shall summon the meeting of the I.S.S.C.
f. He shall at the sitting of the I.S.S.C. interpret the constitution of the Union in good faith and such
interpretation shall be reversible by two-third (2/3) of members of the I.S.S.C. present and voting.
g. He shall conduct election for the post of the Deputy Senate President, Clerk, Deputy, House
Leader and the Senate Whip.
h. The Senate President shall have a casting vote in the event of a tie.

SECTION 15: THE DEPUTY SENATE PRESIDENT


a. The Deputy Senate President who shall be a member of the I.S.S.C. shall be elected from among
its members through the Senate president.
b. He shall assist the Senate President from time to time and shall performed all the duties as may be
assign to him by the Senate President
c. He shall during every sitting of the I.S.S.C. take the role of the members present and shall within
24hours after I.S.S.C. adjoined forward the list of the absentee member to the Senate President for
necessary action in accordance to the provisions of this constitution.
d. He shall not vote but be the electoral officer of the senate.
e. He shall head the constitution review committee.

SECTION 16: THE CLERK OF THE SENATE


a. There shall be a clerk who shall be a member of the I.S.S.C.
b. Shall be elected from among its members through the Senate President.
c. He shall take proper minute of the sittings of the I.S.S.C. and shall perform such other duties as
may be allotted to him by the senate president.
d. Preparing in advance a comprehensive agenda of all the major points to be discussed and
appointment to be made at every sittings of that body. This shall be done in collaboration with the
Senate President.
e. He shall compile the proceeding of the I.S.S.C. for the parliamentary year for documentation in the
union’s library.
f. He shall be secretary at the joint sittings of the I.S.S.C. and executive council.
g. The post shall be reserve to Female Members in the House provided if there is.

SECTION 17: THE SENATE LEADER


a. The Senate leader who shall be a member of the I.S.S.C. shall be elected from among its member
through the Senate president.
b. He shall move a motion when there is no member to move the motion
c. He shall be a code of conduct chairman in the house.
d. All his decision shall be subject to the approval of the Senate President

SECTION 18: THE SENATE WHIP

a. The Senate whip who shall be a member of the I.S.S.C. shall be elected among its member through
the Senate President.
b. The Senate whip shall be refers or addressed as the protocol officer of the I.S.S.C.
c. He shall maintain the peace and order of the house.
d. He shall bear the mace before the Senate President in and out of the house.
SECTION 19: RIGHT OF ATTENDANCE (I.S.S.C. SITTINGS)
a. Any students and other interested persons may attend the sitting of the I.S.S.C. but only the
members shall take part in its proceedings
b. Any person who is not a member of the I.S.S.C. may be allowed by the Senate President or the
members of the I.S.S.C. to address the house.

SECTION 20: MEETINGS OF THE I.S.S.C.


a. The inaugural sitting of the I.S.S.C. shall be held not later than a week after its swear-in ceremony.
b. The I.S.S.C. shall meet at least five times in a calendar year apart from the inaugural sitting.
c. The quorum shall be form by one third 1/3 of the total member of the I.S.S.C. including the Senate
President and the Deputy Senate President
d. Sitting shall be summoned by the Senate President through the Clerk of the Senate with at least a
week notifications to the members before the sittings except in emergency cases.
e. Member of the Executive Council Committee and Commission of the union shall present and
prepared official reports of their sectional activities for debate by the I.S.S.C. at the last business
sitting of the council.
f. Any member(s) of the I.S.S.C. who absent him/herself from two consecutive sittings of the house
without the leave of the Senate President in written or otherwise, shall lose his seat and be
disqualified from been elected into the house again or holding any other Union office again.
g. Any decision taken by the I.S.S.C. shall be a binding force on the members of the union.
h. The Senate President ruling as to whether or not the explanations adduced are good, shall be
subject to its been overruled by at least two-third 2/3 majority of the I.S.S.C. members present in
and voting.
i. Minute of the I.S.S.C. sitting shall be taken and the minute of the last meeting shall be read and
adopted before the proceeding of the new sittings.
j. The Senate President shall have a casting vote in the event of a tie.

SECTION 21: PRESIDING IN THE I.S.S.C. These shall preside at any sitting of the I.S.S.C.
a. The Senate President
b. The Deputy Senate President
c. Where the Deputy Senate President has to preside at any sitting the function under Section 15 (c)
and (d) of this constitution shall be exercise by such member of the I.S.S.C. as the council may
elect.

SECTION 22: EMERGENCY SITTING OF THE I.S.S.C.


a. The Senate President shall summon emergency sitting of the I.S.S.C. whenever he deems it
necessary in the interest of the union
b. The emergency sitting summoned by the Senate President shall be on the receipt of the request
signed by the least one-third (1/3) of the member of the council.
c. Any emergency sitting summoned without the knowledge of the Senate president shall be on the
receipt of the request signed by at least two-third (2/3) of the member of the Senate council
including all member of the principal officer.
d. The procedure of emergency sittings shall be the same by that of ordinary sittings.
e. Notice of emergency sittings of the I.S.S.C. shall be delivered by a text message to the phone or
social network to all the “SENATORS”

SECTION 23: RULES OF DEBATE


a. A member of the house shall stand when speaking and shall address the Senate President and the
house.
b. If two or more member arises at a time the Senate President shall determine to whom procedure
shall be given.
c. If the Senate President has occasion to rise to assert his authority any member pending(s) of the
council standing shall immediately resume his/her seat.
d. Debate must be limited to the immediate pending question(s).
e. The Senate President shall order any members of the I.S.S.C to take care leave of the house for a
specific period of time for disregarding his authority.
f. All member of the I.S.S.C shall remain standing when the Senate President enter the house and
shall sit when he has taken his seat.
g. The President shall seat down while addressing the house.

SECTION 24: MOTION


a. Any I.S.S.C member can sponsor or fill a motion such a motion must be seconded
b. A counter motion can be raised to any motion and such counter motion must be proposed and
seconded in the appropriate form.
c. After a motion has been moved and seconded, the motion shall be opened for discussion and
amended, if however, there is no counter motion, the motion shall be passed accordingly.
d. The mover of a motion reserves the right to accept or reject an amendment to the motion raised by
him. However a rejected amendment or counter motion shall be put to the house for a vote
(referendum) at the instant of the mover of the motion and counter motion, where a simple
majority vote cast decided the case.
CHAPTER THREE

SECTION 25: EXECUTIVE ARM


The Executive Council here-in-after called “EXCOS” shall be the body responsible for the
implementation of decisions of the I.S.S.C and that of the congress.

SECTION 26: EXTENT OF THE EXECUTIVE AUTHORITY


The Executive power of the Union shall include execution and maintenance of this constitution and all
matter with respect to which the I.S.S.C has power to make rules and regulations.

SECTION 27: COMPOSITION OF THE EXECUTIVE ARM


a. The council shall comprise of ten (10) members which shall be democratically elected by the
members of the union in line with section 1(e)
b. Where this provision is in conflict with any of the earlier provisions in this constitution the latter
shall prevail.
c. The executive council shall consist of

I. The President
II. The Vice President
III. The General Secretary
IV. The Assistant General Secretary
V. The Public Relation Officer
VI. The Financial Secretary
VII. The Treasurer
VIII. The Director of Social and Culture
IX. The Welfare Director
X. The Director of Sport The librarian
XI. The Assistant Librarian

SECTION 28: FUCTIONS AND POWERS OF THE EXECUTIVES


Subject to the provision of this constitution the executive council shall:
a. Run the affair of the Union and shall keep the I.S.S.C. constantly informed of their day to day
activities.
b. Set up standing and Ad-hoc committee subject to the approval of the I.S.S.C.
c. Draft the annual budget and present same to the I.S.S.C. for ratification.
d. Incur such expenditure as may be necessary for the management of the union with reference to the
allotment sanctioned by the I.S.S.C.
e. Seek all contentions, grants and assistance for members and the public and enter into such contract
an agreement and as may be necessary and reasonable for carrying on the business of the Union.

SECTION 29: THE UNION PRESIDENT


a. The President shall be the head of the Union and the leader of its Executive Council.
b. He shall be responsible for coordinating the activities of the other officers of the Executive
Council.
c. Have power to summon the meeting of the Executives and Congress through the General Secretary
and request for the meeting of the I.S.S.C.
d. Be one of the principal signatory to the Union account.
e. Have the right to order the closure of a discussion and put it into a vote.
f. Approve all expenditure subject to section 27 (c).
g. Present the annual budget to the I.S.S.C. during the first business meeting and to the congress not
greater than two weeks
h. Have the power to delegate in the true capacity in respect of whom the power is delegated.
i. Have a casting vote in the event of time.
j. Have the right to spend up to Five Thousand Naira (5,000) on the Union activities before the
approval of the annual budget by the I.S.S.C.
k. Have power query any member of the executive who fail to perform his/her duties as stipulated in
the constitution and recommended same to the I.S.S.C. for appropriate sanction.
l. Perform the swearing-in ceremony for the other executive members.
m. Appoint the Editor-in-chief and present him to the house for screening and final approval.

SECTION 30: THE VICE PRESIDENT


The vice president shall:
a. Advise and assist the president in his duties and deputize for him in his absence
b. Automatically become the president if the president resigns or otherwise removed from office.
c. Be the chairman of the student’s union week committee.
d. Give a comprehensive report of the union week anniversary to the executive council not later than
five (5) days after the compilation of the activities and submit the income and expenditure
statement of the programme to the financial secretary.

SECTION 31: THE GENERAL SECRETARY


a. He shall be elected
b. He shall conduct and deal with all official corresponding of the union and shall take minute of
meetings of the Executive Council and of the congress.
c. He shall give full cooperation to the president towards the effective discharge of the executive
duties of the union.
d. He shall on the advice and approval of the Executive Council compile a comprehensive record of
the activities of that council for the parliamentary year and shall thereafter present same to the
I.S.S.C. at the last sitting of the council.
e. Circulate the notice of meeting at least two weeks to the meeting except in emergency cases in
conjunction with the Public Relation Officer.be
f. Be one of the signatories to the union’s bank account.
g. Perform such duties as may be assigned to him by the president as it may be stipulated in the
constitution.

SECTION 32: THE ASSISTANCE GENERAL SECRETARY


a. The Assistance General Secretary of the union shall assist the General Secretary in the discharge of
his duties
b. Shall perform all the duty of the General Secretary in the latter’s absence.
c. Shall do all such other things as may be assigned to his office by the Executive Council.

SECTION 33: THE PUBLIC RELATION OFFICER


a. He shall be responsible for the publicity of all union activities in conjunction with the ISU Press
b. He shall preside at the meeting of the Editorial Board
c. He shall be responsible for the enlightenment of union members and for this purpose organized
lectures, symposia etc.
d. Work hand-in-hand with the General Secretary to issue notices of meetings and other information
to members.
e. He shall discharge his duties with the advice of the Executive Council
SECTION 34: THE FINANCIAL SECRETARY
a. Responsible for preparing the financial records of the Executives.
b. Present the budget of the executive council at the budget meetings of the I.S.S.C provided the
budget statement as been sent to all I.S.S.C members at least 24hours before it is tabled for
approval before the council.
c. Prepare all payment vouchers on all money spent and get the vouchers approved by the President.
d. Issue official receipt for all money received.
e. With the advice and approval of the Executive council, prepare a balance sheet for their financial
transactions and present same to the I.S.S.C at its last meeting provided such balance sheet as been
sent to all member of that council at least 48hours before the said meeting.
f. Without prejudice to paragraph (b) and (g) of this subsection submit both the budget statement and
balance sheet to the budgetary and Financial Committee of the Union at least 72hours before
presenting same to the I.S.S.C.
g. Give financial advices to the Executive council.

SECTION 35: TREASURER


a. He shall collect and deposit all money received on behalf of the union to the bank within 72hours
of collection.
b. Be one of the signatory to the Union account.

SECTION 36: THE DIRECTOR OF SOCIAL AND CULTURE


a. He shall be responsible for the social activities of the union.
b. He shall be primarily a custodian and promoter of the Nigerian culture heritage.
c. He shall be the chairman of the socio-culture Affairs Committee.
d. He shall be responsible for providing recreational facilities for the use of union members.
e. He shall submit to the Financial Secretary the statement of income and expenditure of all Socio-
Cultural activities of the union.
f. He shall in the discharge of his duties take advice from the Executive council.

SECTION 37: THE WELFARE OFFICER

a. The Welfare Officer of the union shall be responsible for matters relating to the General Welfare of
the union members and all union guests.
b. He shall be the chairman of the Union Welfare Committee
c. He shall be in charge of all union properties
d. He shall in the discharge of his duties act on the advice of the Executive Council.

SECTION 38: DIRECTOR OF SPORT


a. The Director of Sport who must be a keen sport man shall explore and adopt suitable means for
improving the current standard of Student Sporting activities.
b. He shall organize and coordinate all the sport activities of the union
c. Submit to the Financial Secretary the statement of income and expenditure of any sport activities
of the Union.
d. He shall publish from time to time information to the general body of students of the progress in
the sporting activities of Union Member.
e. He shall discharge his duties with advice of the Executive Council.

SECTION 39: THE LIBRARIAN


a. He shall be in charge of the Union Library.
b. He shall be a member of Editorial Board.
c. He shall coordinate reading in the Library.
d. He shall be the custodian of the Union Secretariat.
e. He shall discharge his duties with the advice of the Executive

SECTION 40: THE ASSISTANT LIBRARIAN


a. He shall be a secondary school student appointed by the president subject to the ratification of the
I.S.S.C.
b. He shall assist the librarian in the discharge of his duties.
c. He shall do all other things as may be assigned to his office by the Executive Council
d. He shall perform all duties of the librarian in the latter’s absence.

SECTION 41: ISU PRESS


There shall be a corps called ‘’ISU PRESS’’ and they shall consist of fifteen (15) members in
which students from secondary schools and higher institution can join.
a. They shall be a separate body and nobody should control or intimidate them.
b. It shall be headed by Editor-in-Chief (EIC) to be appointed by the president of the I.S.S.C.
c. It shall play a neutral role during the conduction of the election
d. It shall conduct the Press debate for aspirant.
e. It shall from time to time publish the latest development in the Union.
f. It shall interview any members of the Union including the Executive and the I.S.S.C.
g. He shall receive 5% of fund generated every three months by the Union through the treasurer on
the knowledge of the president in order to meet day-to-day running of the activities of the union.

SECTION 42: MEETING OF THE EXECUTIVE COUNCIL


a. The inaugural of the Executives shall be held not later than a week after the swearing in ceremony.
b. The Executive council shall meet as often as necessary for the effective running of the union.
c. A quorum shall be formed by two-third majority of the total number of the Executives
d. Meeting shall be summoned by the President through the General Secretary (Including Emergency
Meetings).
e. The President shall have a casting vote in the event of a tie
f. Any members of the Executive who absents him/herself from two (2) consecutive meeting without
notification or acceptable reasons shall have his/her seat forfeit and shall be banned from holding
any other Union Office again.
g. Minute(s) of the last meeting shall be read and adopted before proceeding on the main agenda.
h. The Executive council shall be individually responsible for all things done by it or other authority
of an officer of the Union, in the Execution of his duties to the I.S.S.C.
i. Officers of the Executive Council shall, in discharging their duties respective functions have due
regard to the opinion and suggestion of the Union President

SECTION 42: CONGRESSIONAL MEETINGS


a. A meeting of all students from various chapters shall constitute the congressional meeting.
b. The meeting shall come up at least five times in the Union calendar year, except in emergency
cases.
c. The meeting shall be summoned by the President of the union through the General Secretary and
the P.R.O.
d. Notice of the meeting shall be published at least two weeks to the meeting except in emergency
cases.
e. The agenda of the meeting must be included in the notice summoning the meeting.
f. The President shall preside over the congressional meetings.
g. The minutes of the earlier meeting shall be taken by the General Secretary and shall read
resolutions to the congress before the meeting closed.
h. Any decision taken in the congress shall have a binding force on any arm and members of the
union with supporting votes of two third (2/3) of the members in attendance.
i. No members shall be allowed to talk in the meeting without the recognition from the President
j. A quorum shall be formed by one third (1/3) of the total numbers of the financial members

SECTION 44: CODE OF CONDUCT


The following rules and regulations shall be binding on all members of the union where when
applicable.
a. Any I.S.S.C. or Executive members who absent him/herself from any sitting without notification
to appropriate quarter shall be liable or fine of reasonable amount as may be decided by the
concerned authority.
b. Disorderly movement, side talks, noise in any meeting shall attract penalty as it may be decided by
the concerned authority presiding over the meeting.
c. Members of the Union such act shall be disciplined for acts likely to disrupt or disturb the function
and progress of the Union and such act(s) shall be deemed to include.
i. Fraud
ii. Misappropriate of fund
iii. Illegally retaining or procurement of the Union properties that may prejudice the progress of
the union.
iv. Contravention of the provision of this constitution.
v. Any act considered detrimental to the Union such as slander, libel etc.
vi. Executive members shall not be flag bear of any political party.
CHAPTER 4

SECTION 45: BUDGETARY AND FINANCIAL COMMITTEE


a. There shall be a budgetary and finance committee of the Union consisting of a Chairman and Four
other members, which shall be appointed by the I.S.S.C. at it first business meeting.
b. Members of the committee shall be draw preferably from the I.S.S.C.
c. The committee shall at the beginning of every parliamentary year receive or call for and deliberate
on the budgets of the Executive Council and submit a report there to the I.S.S.C.
d. The committee shall, if necessary review or draw up financial instruction for each parliamentary
year provided that the new financial instruction shall not take effect until it is ratified by the
I.S.S.C.
e. The committee shall check and audit the balance sheets of the Executive Council and make report
there on to the I.S.S.C.

SECTION 46: WELFARE COMMITTEE


a. There shall be a welfare committee consisting of Five Members with the Welfare Director as its
chairman.
b. The committee shall see to all general welfare mailers.
c. It shall negotiate transport fares with the Driver Union.
d. It shall consult and contact the officials of power Holding Company of Nigeria (P.H.C.N) on the
need for stable electricity in the town.
e. It shall be responsible for doing all such other things that are reasonable incidental to the good of
the Union Members.
f. Members of the committee shall be drawn preferably from within the I.S.S.C. and Congress.

SECTION 47: SOCIAL AND CULTURAL AFFAIRS COMMITTEE


a. There shall be a social and cultural affairs committee consisting of five members with the Director
of Social and Cultures as it Chairman.
b. The committee shall arrange for all Social and Cultural activities of the union and assist the
Director of Socials and Culture in discharge of his duties.
c. Members of the committee shall be drawn preferably from the I.S.S.C. and the congress.

SECTION 48: SPORTS COMMITTEE


a. There shall be sports committee of the union consisting of five members with the Director of Sport
as its Chairman.
b. It shall assist the Director of Sport in the effective discharge of his duties.
c. Members of the committee shall be drawn preferably from the union members who are keen
sportsmen.

SECTION 49: TREASURY


a. The bankers of the Union shall be any commercial bank approved by the I.S.S.C.
b. The expenditure of the Union shall be based on budgets approved by the I.S.S.C. for the
parliamentary year.
c. The I.S.S.C. shall be entitle to a subvention of not less than twenty percent (20%) of all the funds
generated by the executive council for every parliamentary year and such subvention shall be
served as running grants to the I.S.S.C.
d. The ISU PRESS shall receive 5% of fund generated every three months by the Union through the
treasurer on the knowledge of the president in order to meet day-to-day running of the activities of
the union.
e. The judiciary Council shall receive 5% of fund generated every three months by the Union through
the treasurer on the knowledge of the president in order to meet day-to-day running of the
activities of the union.
f. Money collected for annual due during the time of election will be reserve for the incoming
president

SECTION 50: IDENTITY CARD


a. The union identity card is compulsory for all members of the I.S.S.C. and the executive Council.
b. Any students that wish to have the union I.D can obtain it through the Senate President.

SECTION 51: UNION PROPERTY.


a. The welfare Director shall see to the maintenance of all the union properties
b. The welfare Director shall monitor the condition of the union property an d deliver the state of the
condition to the I.S.S.C.
CHAPTER 5

SECTION 52: ELECTORAL COMMISSION


a. There shall be electoral commission consisting of Electoral Officers constituted by the I.S.S.C. at
the end of every parliamentary.
b. He shall consist of five members headed by the Chief Electoral Officer who shall be the Chairman.
c. An Electoral Officer shall hold office for a parliamentary year and shall during the period, not be
eligible to vote and be voted for at Union elections
d. The Electoral Commission shall organize and effectively supervise all Union election and bye
election with utmost good faith.
e. The Electoral commission shall be responsible to the I.S.S.C. in the first instance and shall be
responsible to the congress when the I.S.S.C. stands dissolved but shall not be controlled by any
person, the entire commission can be removed by two thirds majority of votes of the members of
the I.S.S.C. present and voting at a meeting provided quorum is formed.
f. Electoral Officer shall be removed on grounds of misconduct in its official duties and in
accordance with the provisions of this constitution.
g. It shall conduct bye election within fourteen days to fill any vacancy of a Union Office. h. The
membership shall be open to student of higher institution only.

SECTION 53: AUXILIARY PROVISIONS


a. The election shall be between 20th of December of every year.
b. Election of members into the I.S.S.C. shall be in chapter basis and the Name of the representative
shall be forwarded to the electoral commission two days to General Election for proper screening.
c. Election into the executive post shall be secret ballot system.
d. Any members of the Executive who want to contest for any post shall assign his post seven days
before the Election Day.
e. Counting of votes should be done in the presence of the contestant’s agent. SECTION 54:

ELIGIBILITY OF OFFICE
a. Only Members of register Institution will only be allow to contest for any post in the Union
b. Subject to section 54(b) only those that participate in the Union activities for at least a year before
the election shall be qualified to contest for any post in the union (both in the I.S.S.C. and the
Executive).
c. Only those who have previously held an office in the national body of the union shall be eligible to
contest for the post of President and Senate President
d. Any member that is guilty of any offence stipulated in section 20 (f), section 42 (f) and section 44
(c) shall not be eligible to stand for any election.
e. A person shall not be qualified for election to the office of the president if he has been elected to
such office at any two previous elections.
f. Only those who have spent the minimum of four semesters shall be eligible to contest for the post
of the President and the Senate President.

SECTION 55: ELIGIBILITY OF VOTERS


a. Subject to section 1(e) only member of Ilawe-Ekiti origin who have paid their annual due will be
allow to vote during election.
b. Only Student from higher institution will be allow to take part in the election exercise.
c. Admission letter shall be consider compulsory for any member while Attestation, School I.D card
and School Fees will be consider as optional before one can be qualified to vote
SECTION 56: JUDICIARY
The Ilawe Student Union Judiciary Council shall here in after be referred to as the ISUJC and shall
consist of five members nominated by the congress headed by the chief judge appointed by the I.S.S.C.
POWER AND FUNCTION OF THE JUDICIARY COUNCIL
a. The chief judge shall be a law student who is not currently holding office in the Ilawe Students
Union
b. The judiciary committee shall have the power to summon any member of the Union as it deems
necessary during the discharge of its duty.
c. Any member(s) of the union that disrespect the Judiciary committee or any of its members during
the discharge of their duties shall be awarded a penalty as the chief judge deems fit.
d. Any member(s) of the union that refuse to honour the committee’s summon without a justifiable
reason shall be awarded a penalty as the council deems fit.
e. The council shall be well constituted by three members including the chief judge in all matters.
f. It shall determine any dispute between the Executive and the Legislature Arm
g. Receive 5 % of income generated by the union through the chief judge from the treasurer on the
knowledge of the president in order to meet day –to- day running of the activities of the council.
h. The judiciary committee shall have a bailiff and registrar who make proper document of the
committee’s activities
i. Both the bailiff and the registrar shall be appointed by the chief judge.
j. All cases of election malpractice or an irregularities
k. Any question as to whether or not any person has been valid elected in any union election. l. Final
judgment upon the reliable and tenable evidence and its decision shall be binding on the petitioner
l. The committee shall trial members that are referred to them, subject to section 44(c).
m. It shall investigate without prejudice and shall take necessary action at its own discretion vis-a-vis
warning, suspension, withdraw of any membership or any other punishment that commensurate
with degree of the offence.
n. Members of the union alleged or referred to the committee to defend himself before the committee.
o. Every person who is charge with a criminal offence shall be presume to be innocent until he is
proof guilty.

SECTION 57: DISSOLUTION AND TERMINATION OF OFFICE


a. The executive council shall stand dissolved within 20th and 26th of December every year while
I.S.S.C. shall stand dissolved within 25 and 31 of December every year following a motion passed
by a simple majority of the I.S.S.C. meeting.
b. Financial account followed by the auditing committee report shall precede the dissolution of the
executives.
c. The office of an executive and the I.S.S.C. members can be terminated in the followings
I. Resignation
II. Gross misconduct and negligence subject to section 42(c)
III. Truancy subject to section 19(f) and section 40(f).
IV. Vote of no confidence passed by two third majority of the I.S.S.C. and two third of the
congress
V. Any case of misappropriation of fund shall be reported to Patron; and the victim shall be made
to return whatever amount he/she misappropriate. Failure to do so shall be made known to the
generality of the town people beginning from the parent of the victim
VI. He/she shall in addition to the refund made, shall be dismissed from the office; and he/she
shall not be awarded certificate of merit.
SECTION 58: CONDITION FOR IMPEACHMENT
a. Executive members shall be impeached when found guilty of offence stipulated in section 44(c)
subject to the approval of two third majority of the I.S.S.C., present and voting at a meeting
provided quorum is formed.
b. The Senate President shall be removed after a motion for his remover in supported by two third of
the member of the I.S.S.C. present, provided they form a quorum.

SECTION 59: CERTIFICATE OF MERIT


Any office of the Union shall on successful completion of tenure of office be awarded a certificate of
merit duly signed by the speaker of the I.S.S.C., the President and the General Secretary.
CHAPTER 6
MISCELLANEOUS

SECTION 60: AMENDMENT


a. The constitution may be subject to revision or amendment after four years of amendment b. The
constitution shall be subject to revision or amendment upon a resolution passed by not less than two-
thirds of the members of the I.S.S.C. in sitting of that council present and voting.
b. Any proposed amendment to this constitution send in writing through the clerk of the house at least
one week before the said sitting of the I.S.S.C. and he shall forward every member of the council
statement of the amendment at least 24hours before the sitting.
c. The proposed amendment shall be published on the union notice board and such amendment shall
come into full effect when approved by the majority of the student casting vote on the amendment at
a referendum held for this purpose.

SECTION 61: INTERPRETATION


 The ‘’Constitution’’ of ILAWE STUDENT UNION means the law and principle which the
union shall strictly abide by:
 The ‘’Union’’ means ILAWE STUDENT UNION (ISU).
 The ‘’Town’’ means ILAWE EKITI
 The ‘’I.S.S.C. /House’’ MEANS ILAWE STUDENT SENATE COUNCIL (POLICY
MAKING BODY).
 The‘’Officers of the Union’’ means any student serving the union as a result of an election
or appointment in one official capacity or the other.
 The‘’Act of the I.S.S.C.’’ refers to all decisions and directives of the Ilawe Student Senate
Council
 The‘’ Parliamentary year’’ shall refer to life duration of the I.S.S.C. as provided for in
section 57(a) of this constitution
 The‘’ Financial Instruction’’ as provided for in this constitution and as and when amended
shall be incorporated into this constitution as section 44(d)
 The‘’Distinguished’’ is a special term used to distinguish the Senate President and the
Deputy Senate President.
 The‘’Congress’’ means members of the union that hold neither executive posts nor I.S.S.C.
post.
 The‘’Congressional meeting’’ means meeting that are opened to all members of the Union
irrespective of their membership.
 The‘’Standing Order’’ as provided for in section 64 in this constitution shall constitute a
part of this constitution.
 The‘’EXCOS’’ means Executive Council
 ‘’MEMBERS’’ ‘’Financial Member’’ are those members that pay the Union due
 The ‘’Registered Members’’ are those that have evidence of proven studentship
 The “Honorary Members” are those that do not pay annual due in this constitution unless it is
otherwise expressly stated or required by context.
 All masculine pronounce include feminine

SECTION 62: CARE-TAKER COMMITTEE


This section takes care of a situation whereby election into various offices is not fully or partly
conducted.
a. It shall consist of five members appointed to stay in the offices pending when an effective election
shall be held.
b. The appointment of the care-taker committee shall be the joint responsibility of the v and the
Executive Council and it shall take effect in a well constituted joint session
c. While the appointers of members of the care-taker committee shall reserve the power to consider
the fitness of the Chairman before approval.
d. They shall be able to perform the functions of the I.S.S.C. and Executives Council during their
tenure of office.
e. Any disciplinary measure during their tenure shall be referred to the congress for better
ratification.

SECTION 63: COMPOSITION OF THE CARE-TAKER COMMITTEE


There shall be five members and shall comprise of chairman, secretary, accounting officer, welfare
director, and public relation officer (P.R.O) and they shall assume the power and functions of the
Executive Council in section 28

THE CHAIRMAN:
a. He must be a person of power ability, dedicated, and loyal to the Union
b. He shall preside over the committee and assume the role of the President and Vice President
section 29, and section 30 refer

THE SECRETARY:
The Secretary shall assume the role of the General Secretary, Assistant General Secretary, and Director
of Socials and Culture, section 31, section 32, and section 36

THE ACCOUNTING OFFICER:


The Accounting officer shall assume the role of Financial Secretary subject to section 34

THE DIRECTOR OF WELFARE:


He shall assume the roles of Welfare Officer, and Director of Sports subject to section 37, and 38

THE PUBLIC RELATION OFFICER (P.R.O):


He shall assume the roles of P.R.O, Librarian and Assistant Librarian this in line with section 33,
section 39, and section 40.

SECTION 64: STANDING ORDER


a. Only immediate pending question shall be debated on by any member of the congress/House. This
is stipulated in section 23(c).
b. The official Language of the Union shall be English/Dialect
c. Abusive language or violent expression shall be avoided, when used the authority presiding over
the meeting shall make the person(s) to apologies or punish accordingly
d. Point of order, security information, observation and enlightenment must be upheld at all time.
e. Constitutional matters shall be observed at all time and caller should address in constitutional
provision(s).

SECTION 65: OATH OF OFFICE


No members elected into the Union Executive, I.S.S.C. and or any other elective post(s) in the Union
shall begin to perform the functions of such office until he/she has taken the oath of office in
accordance with the provision of this constitution.

SECTION 66: SWEARING IN CEREMONY


a. The outgoing Senate President shall swear-in for the incoming Senate President and members of
the House in the presence of the congress/legal adviser.
b. The outgoing President shall swear-in for the newly elected President and all other Executive
elected.
