00:10 (LTO) Una, ang functions ng LTO should be understood under RA 4136, and the mandate LTO is as
follows; number one is to issue driving licenses, number two register vehicles number three enforce
traffic rules and regulations and administrative provisions of the said law in regards EDSA we do not
have the direct hand in traffic management in EDSA because the control is under MMDA as regarding
traffic charges. So you don’t see us around manning traffic because that is under MMDA. But LTO
apprehends violators under RA 4136, but today MMDA is also doing that under their charter, that is the
reason why people are confuse because there are also agencies doing the same. LTO is apprehending
violators at traffic and administrative cases under RA 4136 and our mandate is nationwide its authority
is on national scope. MMDA is also tasked for traffic direction and control and to apprehension also of
traffic violators as provided by their ordinance their jurisdiction is limited only to Valenzuela, Bulacan at
the North and Pateros and Taguig in the South in other words it is limited to the 17 cities of Metro
Manila and then we have also local government units also apprehend traffic violators using their
ordinance also but their jurisdiction is limited only in their municipality and city so that is how it works

03:03 (Researcher) So how does LTO regulate private vehicles in EDSA or in general

03:13 (LTO) LTO don’t do that as I said we are not into traffic direction and control so if you say regulate
you have different ways in regulating traffic, how do you regulate traffic? Using traffic lights we have
traffic enforcers.

03:37 (Researchers) But in terms po in limiting the number of vehicles.

03:43 (LTO) Kaya nga in regards sa volume of vehicles how do you do that, yung engineering
intervention yung sa traffic lights, pero yung regulate of volume how do you regulate of volume is there
restricting law no we don’t do that you have to ask MMDA that what we do is merely register motor
vehicles.

05:15 (LTO) Yung overlapping hindi naming issue kung may overlapping, why because it is the call of
legislators why do they pass laws? Nagpapasa sila ng batas, kami we implement the law so we are not
the ones that should look into it, so they knew that there is overlapping, you know if you are a sound
legislator you do research and I think they do that nagreresearch naman sila. Legislation is the key, why
do they pass legislation that do that. So nangyayari if may overlapping ng functions and may
contradictory in functions and people are confused what do you do when that happens? You go to the
court you bring the case the court if you are affected by it so you became a party in interest so you go to
the court so that the court will tell you if the functions being exercised by government agencies are
becoming the arm of the law or not. So kung may overlapping dyan ang dapat mag solve nun eh yung
kongreso kasi kaya nandyan yung batas you only have to implement hindi naman pwede kwestyunin yan
kasi batas yan eh. Sino pwede mag question? Ang pwede mag question eh yung mga taong naapektuhan

07:13 (Researchers) Paki clarify na lang po yung enforcement body ng MMDA in regards with your
agency

07:17 (LTO) Yun nga, you have to look in the charter of MMDA and also the RA 4136 probably it could be
in the internet for you to understand the background of MMDA and LTO.

07:57 (Researchers) Regarding po doon sa ipapasa nilang batas na kailangan may garage po muna bago
magkaroon ng kotse ano pong masasabi nyo doon?

08:11 (LTO) Regarding dyan isa yan sa mga pag reregulate isa yan sa mga way to regulate the volume of
traffic yan ang kailangan yung may garahe. Kailangan naman talaga na dapat may garage ka para hindi
yung, kasi private property yan so dapat sa private property mo ilagay. Hindi mo dapat yan nilalagay sa
public property, like highways bakit mo doon ipapark yung sasakyan mo? Eh di dinedeprive mo yung
mga tax payer ng space kasi nilagay yung iyong private property. Isa yan sa mga nagcacause ng
obstruction of traffic, yung free flow ng traffic ay nadidistrupt ng dahil dyan. In Singapore, they are strict
about it because the space is limited you cannot own a car if you don’t own a garage, and before you
own a vehicle you have to take part in a government auction yung right to own a car. Like sa taon na to
ang pwedeng mong bilhin na unit is 300 and yung garage ganito din kailangan may garage na ganito,
kunwari 300 na cars tapos 300 na garage dapat nakikipag bidding ka para maayos yung ganun. Ganun
yung ginagawa nila and that are the ways they do to regulate volume isa pa eh yung tollway, because
everybody cannot go in if someone don’t pay then you cannot go in, eh di nareregulate yung volume.
Pero that is the job of tollway operators yung operators mayroon silang franchise given by the
government that is again legislation.

10:14 (Researchers) Mam such policies na sinabi niyo po, may nagawa po ba ang LTO para ma
recommend yung ganung policies po.

10:19 (LTO) Wala pa kaming ganun, kasi hinihearing pa siya ngayon sa congress, sa committee of
transportation hinihearing yung ganun so wala pa. Wala pang ganung kaming position kasi wala pang bill
na binibigay sa amin to report/react or not.
10:34 (Researchers) Kapag nagpasa na po ba yung ganun policy, sa office po ba ninyo madedelegate
yung policy

10:41 (LTO) As of now di pa alam kasi wala pang copy dito kung ano yung nilalaman noon.

11:00 (Researchers) Mam yung MMDA po di na daw po nila kinukuha yung license unlike sa mga LGU’s
na kinukuha pa yung license, as they said po ina alarm nalang nila sa LTO yon.

11:17 (LTO) Dati ina alarm nila yon dito, gusto kasi nila mangyari hindi sila mahirapan kasi ang
nangyayari nirereklamo sila na kinukumpiska yung lisensya pero pagdating doon kung makikita mo
nawawala yung lisensya kaya yung plaka kinukumpisa nila pero hindi nila pwedeng gawin yon kasi may
supreme court decision na nagsabi na hindi nila pwedeng kunin yung plaka at tsaka yung lisensya kaya
hindi nila pwedeng kumpiskahin kasi pwede silang magkumpiska ng lisensya pero yung ticket na ini issue
nila hindi pwedeng gawing temporary license unlike yung aming traffic citation ticket na ini issue kapag
ikaw ay nahuli ay pwede mong gawing temporary license for 72 hours at least kasi nakasaad yon sa
batas ibig sabihin nun pwede ka pa ring magmaneho pa diretso sa bahay mo, kapag sila kinumpiska nila
yung lisensya mo tapos binigyan ka ng ticket hindi mo pwedeng gawing lisensya yon kasi yung ticket nila
ay resibo lamang para sa kinumpiska ng lisensya pero hindi para maging temporary license hindi na sila
ina allow na yon, kaya sinasabi nila na ina alarma kasi marami na beses na natatalo sila sa supreme court
na wala don sa batas. Kami pwede kaming magkumpiska ng lisensya at plaka, kinatigan na kami ng
supreme court regarding dyan
