denying and delaying tactics to safeguard Prasanta Sircar, Moumita Sircar and Sirsha Sircar by forwarding my RTI application (on the outcome of investigations based on the TEP)to different PIO’s but without taking any concrete action of investigation, attempts of tax recovery and disclosure of the final outcome of the TEP(because no investigation has even started). 9. No investigatory action has been taken up based on my TEP regarding recovery of taxes from Smt. Moumita Sircar and Sirsha Sircar regarding their alleged purchases of huge amount of jewellery as per FIR copy ard chargesheet which are part of articles worth 40 lakhs as claimed (in the FIR and chargesheet, and also confirmed by witness statements of Shri Prasanta Sircar and Moumita Sircar in the chargesheet)to have been given at the time of marriage, which may have been bought with their undisclosed income or Prasanta Sircar’s undisclosed income. 10.As per latest income tax guidelines any person owning immovable property but not paying taxes is open to serutiny investigation by income tax authorities and penalties , since Prasanta Sircar/Moumita Sircar and Sirsha Sircar own the property at FLAT 5, 1ST FLOOR, 102, JODHPUR GARDEN, NEAR LAKE GARDENS, KOLKATA WEST BENGAL — 700045 and joint holder of Property at 31/13,Indrani Park,Tollygunge, Kolkata-700033 and do not pay taxes hence investigation on source of income should take place and adequate tax and penalties as per income tax act should be collected from them. But I believe till date no action has been taken against Shri Prasanta Sircar,Moumita Sircar and Sirsha Sirear to recover the income tax, wealth tax & any other taxes on Rs.40 lakhs. Request & Relief sought: 1. Shri Prasanta Sirear & Smt Moumita Sircar, may give a baseless plea that the fir is not done by them, because the FIR has taken place through Lake Police Station whom they have requested for FIR in the application submitted by my wife Smt Sirsha Sircar(Ghose) D/o Shri Prasanta Sircar in her own handwriting, and as per chargesheet (copy attached as annexure-12)and witness(Prasanta Sircar & Moumita Sircar) statements all three have admitted to have given articles worth 40 lakhs including Gold jewellery and other luxurious items, further misusing & misguiding the Government Machinery. 2. Shri Prasanta Sirear & Moumita Sirear, may misguide the Income Tax Authorities with malafide intentions of cheating with the Government machinery by evading taxes
