CHILD CUSTODY AND SUPPORT AGREEMENT

THIS CUSTODY AND SUPPORT AGREEMENT (also referred to

herein as this “Agreement”) is made and entered into by and between
_____________________ (“the father”), of legal age, married, and a
resident of ___________________ and _________________ (“the
mother”), of legal age, single, and a resident of
___________________________.

IN CONSIDERATION of the circumstances and mutual covenants set

forth in this Child Custody and Support Agreement, and such other good
and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the parties agree as follows:

WHEREAS, the parties are the biological parents of the minor

_____________________ (minor child) who was born out of wedlock on
__________________;

WHEREAS, the parties wish to enter into this Custody and Support
Agreement in order to settle the care, support and custody of the minor
child;

WHEREAS, the mother shall have sole and exclusive custody of the
minor child and all final decision-making authority related to significant
matters impacting the welfare of the child, including but not limited to,
matters of education, religion and health care. Notwithstanding the
foregoing, the father shall, in every case (except in the event of an
emergency), be provided the opportunity to participate in the decision-
making process as to any such significant matters;

WHEREAS, the mother shall have the residential custody of the

minor child. As such, the minor child will reside at the mother’s residential
address, and the minor child shall be entitled to child support, which will be
paid by the father. In the event of the mother’s death or in the event the
mother is otherwise incapable or unable to perform her responsibilities as
custodial parent for the children, the father will assume all such
responsibilities as custodial parent.

Notwithstanding anything contained in or implied by the foregoing, the

father shall have access to the minor child in accordance with the
agreement otherwise agreed between the parties on a per event basis;

WHEREAS, the father presently pays a monthly amount of

______________ in child support for the minor child;
 WHEREAS, the father has agreed to pay on this date the amount of
_____________________ as child support for the minor child and the
mother hereby accepts the said amount. This amount shall represent as
advance payment for the child support of the minor child for a period
________________________;

WHEREAS, ______________________ or in the event of conflict on

these terms or thereafter, both parties agree to settle the issue of child
support through personal discussion and mediation outside the court;
