AFFIDAVIT FOR SEARCH WARRANT

The undersigned affiant, Sergeant RYAN J ARCHULETA of American Fork, upon an


oath or written affidavit subscribed under criminal penalty, declares:

That your affiant has reason to believe:

THAT

On the premises known as 710 N 200 E, American Fork and all outbuildings/travel
trailers within the curtilage of the residence. The residence is covered in a light
colored brick and light colored lap siding. The roof of the residence is covered in
a brownish asphalt shingle. The front door to the residence faces towards 200 E.
The numbers "710" are attached to the right of the front door., further described
as being located on the east side of 200 E two houses north of 700 N.;

On the person(s) described as: anyone present at, or leaving the resident during
the service of the search warrant;

In the City of American Fork, County of Utah, State of Utah, there is now certain
property or evidence described as:

Illegal controlled substances, their paraphernalia, documents, packaging


material, scales, safes, items used for the ingestion of the above mentioned
narcotics and other items associated with the use/distribution of controlled
substances and related paraphernalia.

and that said property or evidence:

Was unlawfully acquired or is unlawfully possessed;

has been used or is possessed for the purpose of being used to commit or
conceal the commission of an offense; or

is evidence of illegal conduct.

Affiant believes the property and evidence described above is evidence of the crime
or crimes of Possession of Controlled Substance 58-37-8.

The facts to establish the grounds for issuance of a Search Warrant are:

That your affiant has served with the American Fork Police Department since
May 2007. Your affiant was trained in Utah criminal law at the Utah P.O.S.T.
Police Academy. Your affiant has received training from CNOA, UNOA and
NNOA . Your affiant has routinely investigated violations of Utah State Criminal
code 58-37-8, more specifically the identification and use/distribution methods
of controlled substances. Your affiant is a member of the American Fork SWAT
team and has experience and training in the execution of high risk warrants.
Your affiant has been assigned to the Utah County Major Crimes Task Force and
investigated numerous cases involving the distribution of illegal narcotics. Your
affiant is currently assigned as Sergeant over the American Fork S.E.T (Special
Enforcement Team), a team that investigates the possession of illegal drugs and
their paraphernalia.

1. Within the last week I received information from an on-line anonymous


complainant regarding a residence in American Fork. The complainant stated they
believed there was drugs being used in the residence with children and that the
children were being neglected.

2. That within the last 72 hours, through an independent investigation, I contacted


an employee with Republic Services. Republic Services Waste is contracted
through American Fork City to collect residential trash placed on public streets.
The address of 710 N 200 E was provided to the employee. The employee was
instructed to take possession of any trash containers in front of the residence
only if the container(s) are up against the street. Prior to the employee taking
possession of the trash container(s), I drove by the residence and observed there
were three trash containers on the street in front of 710 N 200 E. I watched the
Republic Services employee take possession of the containers. I followed the
employee to the American Fork Police Department without making any stops
along the way. I observed the employee unload the trash containers, I then
secured the container in a secured area.

3. I searched through the trash containers from 710 N 200 E and located
correspondence belonging to 710 N 200 E, American Fork. A detective assisting
me searched through one of the trash containers and located an empty cigarette
box inside a plastic bag half way down in the container. Inside the cigarette box
were two hollow pen cases, tin foil with burn marks and two small clear zip lock
baggies. The tin foil had distinctive burn marks on them consistent with ingesting
heroin. In my training and experience the hollowed out pen cases are also used

along with the tin foil to ingest heroin. I used a methamphetamine field test kit to
test the inside of one of the baggies found in the cigarette box, the test showed
positive for methamphetamine.

4. Through my training and experience the items located in the trash taken from
710 N 200 E are consistent with the ingestion of heroin and methamphetamine
and are consistent with the complaint made.

4. In my experience in narcotics investigations, failure to search the residence,


outbuilding, curtilage, and persons and vehicles of individuals present at the
residence will result in officers missing valuable evidence in this investigation.
In my experience, people who use drugs often keep them on their persons, and
because they're small and easily secreted and disposed of, failing to search
those persons would result in loss of evidence. Also, people who use and
store drugs at their houses often keep them in places out of plain sight and
immediate access to guests or small children, so outbuildings are important to
search. In my experience, if persons present at the residence where narcotics are
located are not searched for drugs, important evidence relating to the case can
become destroyed or concealed. I expect to locate items used for the ingestion of
illegal narcotics and other items associated with the use/distribution of controlled
substances and related paraphernalia.

WHEREFORE, your affiant prays that a Search Warrant be issued for the seizure of
said items.

I declare under criminal penalty of the State of Utah that the foregoing is true
and correct.

To any peace officer in the State of Utah:

Proof by Affidavit made upon oath or written affirmation subscribed under criminal
penalty of the State of Utah having been made to me by Sergeant RYAN J
ARCHULETA of American Fork, this day, I am satisfied that there is probable cause
to believe

THAT

or any part thereof, retain such property in your custody subject to the direction of a
prosecutor or an order of this Court.

The personal property listed below or set out on the inventory attached hereto was
taken from the person of anyone present at, or leaving the resident during the service
of the search warrant, by virtue of a search warrant dated the 30th day of March, 2017,
and issued by Magistrate JENNIFER A BROWN of the FOURTH DISTRICT COURT
- ALL DEPARTMENT:

no evidence located

I, Sergeant RYAN J ARCHULETA of American Fork, by whom this warrant was


executed, do swear that the above listed or below attached inventory contains a true
and detailed account of all the property taken by me under the warrant, on the 30th
day of March, 2017.

All of the property taken by virtue of said warrant will be retained in my custody subject
to the order of this Court or of any other court in which the offense in respect to which
the property, or things taken, is triable.

I declare under criminal penalty of the State of Utah that the foregoing is true
and correct.
