Limitation of Liability Regime

 DMG requires a total liability cap which will provide an overall cap on liability of the Subcontractor
up to a nominated value. This Limitation of Liability regime will also exclude liability associated
with all forms of consequential and indirect loss.
 The Limitation of Liability provision will also need to be included in any Subcontractor’s or
Collateral Warranty required by the Subcontract.
 It is noted that this liability cap does not seek to include or limit any amounts which are recovered
as proceeds of insurance policies, liability associated with personal injury or death, liability arising
from willful misconduct or fraud etc. and any liability which cannot be limited by law.
