COMES NOW, JAY F. ROSENTHAL, Deputy Prosecuting Attorney, and moves

this Court that the above-entitled matter, wherein a citation was issued: COUNT l,

FAILURE TO VALIDATE TURKEY TAG UPON HARVEST, tdaho Code 536409(2),

Misdemeanor, be dismissed. As grounds therefore, l\4ovant states:

1 . That on April 21 , 2017, Defendant Visser was cited by an ldaho Fish and

Game Officer for failure to validate turkey tag upon harvest.

2. That this matter was tried before a Boise County Jury on January 9, 2018,

such trial resulting in a "hung" jury and the Court declaring a mistrial and

setting a new trial date of February 13, 2018.

3. l\ilovant and Mr. Visser recognize and agree that the State and Defendant

differ as to the facts herein and their legal consequences.

 4. Movant and Mr. Vissor agreo that it is ln the intereet of both partl€8 to

resolve this matter by a negotiated settlement.

5. To accompllsh such negotlated settlement the State agne€s to dlsmlss the

pendlng charyes agalnst Mr. Vlsser, and Mr. Vlsser agmes that he will not

seek or apply for a ldaho Hunting Llcense nor hunt in ldaho durlng the

year 2018.
