SUBJECT : Spot Report re: Violation of Section 28(a) of RA 10591

DATE : November 30, 2017

1. That upon receiving an anonymous call, that certain commotion occurred due to a person with a
gun confronting tricycle drivers and is challenging them into a fight in the vicinity of Barangay San
Josef Norte, Cabanatuan City, the station commander immediately ordered to conduct ocular
inspection and investigate the matters subject of the call.

2. That the operation is conducted with team leader SPO4 Samuel Matias along with two other
policemen namely PO1 Cardo Dalisay and PO1 Israel Bonite.

3. Proper procedure and protocols of warrantless arrest was observed by the arresting officers who
likewise conducted such investigation.

4. Recovered from the suspect is Taurus 9mm pistol bearing serial number TZF 34096 without license
to own and permit to carry firearm outside residence.

5. Arresting team informed the suspect Jovic Catabona Y Magana of his Constitutional rights and
brought to this station as well as the pistol recovered.

6. Verification/Certification that the pistol recovered is indeed unlicensed is being secured while a
criminal charge for Illegal Possession of Firearm/Violation of Section 28 of RA 10591 is being
prepared against the suspect.
